ZoningOrdinance No. -~-~ 2 7 AN ORDINANCE TO PROMOTE THE PRESERVATION OF OPEN SPACE IN RESIDENTIAL NEIGHBORHOODS IN CONFORMITY WITH THE 2020 VISION COMPREHENSIVE PLAN. WHEREAS, the Carmel/Clay Plan Commission, at the direction of the Common Counc~ and through its Residential Open Space Ordinance task force, has reviewed the requirements of State and Federal law and has recommended to the Common Council that the Zoning Ordinance as it applies to design of residential subdivisions should be amended so as to promote the preservation of open space in accordance with the wishes of the Carreel/Clay community as expressed in the land use policies contained in the 2020 Vision Comprehensive Plan; NOW, THEREFORE, be it ordained by the Common Council of the City of Cannel, Indiana, that, pursuant to IC 36-7-4-600 et seq., it adopts this ordinance as an amendment to the text of the Zoning Ordinance as follows: 5.0 5.1 5.2 29 S-1 RESIDENCE DISTRICT Purpose and Intent. The purpose of this district is to provide for the development of innovative residential environments in keeping with the rural character of this district, by providing for a development process that allows a high degree of flexibility in the design of single-family subdivisions. Further, it is the purpose of this diswia to provide for a development process that allows for more efficient use of the land through the introduction of open space and conservation lands within subdivisions. It is the intention of this district to protect remaining significant natural features within this dismot by placing an emphasis on less intensive urban land uses. Permitted Uses: 5.1.1 Home occupatim Kennel, residential Single-family dwelling 5.1.2 Area Density Requirements for qualifying subdivisions shall be regulated on a sliding scale based upon the mount of open space provided. (see subdivision regulations, seaion 7.0) Special Uses: (See Section 21.0 for additional regulations.) 5.2.1 Artificial lake or pond (not part of a plat) 5.3 5.2.2 5.2.3 Cemetery Church, temple or other place of worship College or University Commercial greenhouse Country club Day nursery Golf course Kennel, commercial Kindergarten Mineral extraction, borrow pit, top soil removal and their storage Plant nursery Power transmission line, m excess of 129 KVA Priv-Ae airplane or helicopter landing and/or service facility Private recreational development or facility Private water treatment and/or storage facilities Radio or television transmission tower Raising and breeding of non-farm Fowl and animals (not a kennel) Kiding stable School of general elementary or secondary educa~on (accredited by the State) Minimum Area Requirements: U~e Minimum Area (Acres) Cemetery 30 Day nursery 1 Kindergarten 1 Plant nursery 10 Other Requirements: Mineral extraction, pit, top soil Removal and their storage Other Requirements Minimum perimeter Natural Open borrow Space buffer (as defined in 7.3.B of the Subdivi~on Regulations) of 300' when adjoining or abutting any residential use or district Accessory Building and Uses (See Section 25.0 For additional regulations.) 5.3.1 Accessory uses and structures are permitL~ under the Following conditions: (1) They do not alter or change the character of the premises; (2) They are on the same property as the principal structure to which they are accessory, (3) They are not attached to the principal structure, with the exception of an allowable uniform and continuous roof supported by customary supports or joists, and no other connection or attachment between the structures exists; (4) They are not erected prior to the erection of the principal building; (5) They do not exceed eighteen (18) feet m height; (6) When detached From the principal building, they are set back seventy-five (75) feet or more from the Front lot line. A private swimming pool may be permitted as an accessory use. No swimming pool or its deck, shall be closer than ten (10) feet to the property line or less than the minimum setback, whichever is greater. For purposes for safety, the following shall apply: (1) (2) O) (4) walls or fencing deemed to be impenetrable by the enforcing authority, that is not less than five (5) feet high completely surrounding the swimming pool and the deck area with exception of self-closing and latching gates and doors, both capable of being locked; other means not less than five (5) feet high and deemed impenetrable by the enforcing authority at the time of construction and completely surrounding the pool and deck area when the pool is not used; and a combination of subdivisions (1) through (2) that completely surrounds the pool and deck with the exception of self-closing and latching gates and doors which are capable of being locked; and a safety pool cover may be used provided that: (a) there is a continuous connection between the cover and the deck, so as to prohibit access to the pool when the cover is completely drawn over the pool; Co) it is mechanically operated by key or key and switch such that the cover cannot be drawn upon or retracted without use of a key; (c) it is capable of supporting a four hundred pound imposed load upon a completely drawn cover; (d) it is installed with a track, rollers, rails or guides; (e) it bears an identffication tag indicating the name of the manufacturer, name of the installer, installation date, and applicable safety standards, if any. AMENDED BY Z-261 & Z-272. (f) that it is in compliance with the Indiana swimming pool code, 2d Edition, effective date September 13, 1989, as amended. Tennis courts may be permitted as an accessory use but shall be located only within a side or rear yard. Open wire mesh fences surrounding tennis courts may be erected to a height of 16 feet if such fences only enclose a regulation court area and standard apron areas. Lighting of the court area shall not create more than five foot candles of light 25 Feet from the court perimeter. Quarters for bona fled servants employed by the occupants of the dwelling are permitted. One guest house with cooking facilities may be permitted as an accessory building on lots coming not less than one (1) acre. Accessory lighting is permitted; however, no lighting shall cause illumination at or beyond any lot line in excess of 0. 1 footcandles of light. Private radio, television reception and transmitting towers and antennae are pern~ted subject to applicable local, state and federal regulations. No 31 5.4 5.3.8 structure shah be located or permitted within ten (10) feet of a power transmission line. Accessory uses such as public uti/ity installations, private walks, driveways, retaining wails, mad boxes, nameplates, lamp posts, birdbaths and structures of a like nature are permitted in any required front, side or rear yard. Height and Area Requirements (See Section 26.0 for additional regulations.) 5.4.1 Maximum height: 25 feet. 5.4.2 Minimum lot area: A. Lots without service by a community water system and a community sanitary sewer system, 43,560 square feet. B. Lots with service from a community water system, and private septic system, 35,000 square feet. C. Lots with service from a community sanitary sewer system and private water system, 25,000 square feet. D. Lots with community water system and community sanitary sewer system 15,000 square feet. 5.4.3 Minimum Lot Standards. A. Minimum front yard: 40 feet. B. Minimum side yard: single-family home - 10 feet; all other uses - 20 feet. C. Minimum aggregate of side yard: single-family home - 30 feet; all other uses - 50 feet. D. ~um rear yard: single-family home - 20 feet; all other uses - 15 feet. E. Minimum lot width: single-family home - 120 feet; all other uses - 200 feet. F. Maximum lot coverage: 35 percent of lot. 5.4.4 Any lot within a qualifying subdivision, as described in Chapter 7.0 of the subdivision regulations, is exempt from the requirements of sections 5.4.~ and 5.4.3. 32 6.0 SP2 RESIDENCE DISTRICT Purpose and Intent. The purpose of this district is to provide for low density single-family residential development m areas facing conversion from a rural-agricultural nature to a residential nature. The preservation of natural features, and encouragement of open space residential land- use patterns m this district is intended to implement the comprehensive plan*s residential Community objectives. The S-2 District corresponds to the Low Intensity Residential Community on the comprehensive plan's Land Use Map. 6.1 PermittedUses: 6.1.1 Any Use PermilX~ in the S-1 District (Section 5.1). 6.1.2 Density Requirements for qualifying subdivisions shall be regulated on a sliding scale based upon the amount of open space provided. (see subdivision regulations, section 7.0) 6.2 Special Uses: (See Section 21.0 for additional regulations.) Any Special Use Permitted in the S-1 District (Section 5.2) (except Commercial Kennel, garbage disposal plant, Private airplane or helicopter landing and/or service facility and raising and breeding of non-farm fowl and animals). 6.2.1 Minimum Area Requirements: Same as S-1 District regulations of Section 5.2.1. 6.2.2 Other Requirements: Same as S-1 District regulations of Section 5.2.2. 6.3 Accessory BuildinSs and Uses (See Section 25.0 for additional regulations.) Maximum lot coverage: 35 percent of lot. Any lot within a qualifying subdivision, as described in Chapter 7.0 of the subdivision regulations, is exempt from the requirements of sections 6.4.2 and 6.43. 34 7.0 7.1 R-1 RESIDENCE DISTRICT Purpose ~nd Intent: The purpose of this district is to provide for low density single-family residentisl development where adequate public facilities are available. The preservation of natural features, and encouragement of open space residential land-use patterns in this district is intended to implem~ the comprehensive plan's Residential Community objectives. The K-1 District corresponds to the Low Intensity Residential Community on the comprehensive plan*s Land Use Map. Pertained Uses: 7.1.1 Any Use Permitted in the S-2 District (Section 6.1). 7.1.2 Density Requirements for qualifying subdivisions shall be regulated on a sliding scale based upon the amount of open space provided. (see subdivision regulations, section 7.0) 7.2 Special 7.2.1 7.2.2 7.2.3 Uses: (See Section 21.0 for additional r~gulations.) Any Special Use Permitted in the S-2 District (Section 6.2) (except College or University, Commercial greenhouse, Plant nursery, Radio or television transmission tower and Riding Stable). The R-2 District corresponds to the Medium Intensity Residential Conmy on the comprehensive phn's Land Use Map. 8.1 Permitted Uses: 8.1.1 Any Use Permitted in the R-1 District (Section 7.1). 8.1.2 Density Requirements for qualifying subdivisions shah be regulated on a sliding scale based upon the amount of open space provided. The R-3 District corresponds to the Medium Intensity Residential Community on the comprehensive plan's Land Use Map. 9.1 Permitted Uses: 9.1.1 Any Use PermitZed in the R-2 Distact (Section 8.2). The purpose of this distfia is to provide for high density single-, two- and multiple-family development on small lou m distmc~y urbsnized areas. The intent ofthis disuia is to protect and conserve existing residential development, particularly m locations featuring marginally srm~dard housing and facing potential change from original uses, and to preserve natural femxtres, and encourage of open space residential land-use patgems in this district is intended to implement the comprehensive plan's Residential Community objectives. The R-4 District corresponds to the High Intensity Residential Community on the comprehensive plan's Land Use Map. Minimum Tract Requirements. No parcel of ground, platted or unplam~ located within the R-4 Residence District shall be permiu~ to be developed or redeveloped unless served by a community water system and a community sanitary sewer system. PermilXed Uses: 10.2.1 Any use permitted in the R-3 District (Seaion 9.2). 10.2.2 Density Requirements for qualifying subdivisions shall be regulated on a sliding scale based upon the amount of open space provided. Minimum lot width: Fo smgl~-family dwelling - 20 fe~t; all other uses 15 feet. singl~-family dwelling - 1 O0 fete; all other uses - 200 feet Maximum lot coverage: 35 percent of lot. 10.4.4 Any lot within a qualifying subdivision, as described in Chapter 7.0 of the subdivision regulations, is exempt from the requirements of sections 10.4.2 and 10.4.3. 43 11.0 11.1 R-5 RESIDENCE DISTRICT (PLANNED DISTRICT) Purpose and Intent. The purpose of this district is to provide for the encouragement of large scale, diverse residential developments of good design with residential open space, and maximum living amenities. Mixed residential structures, their supporting accessory buildings and uses and limited commercial uses are allowed with maximum layout flexibility permitted. Densities are variable within the district in order to assure versatility of development. Application to the Plan Commission is required for Preliminary Development Plan approval and Final Development Plan approval. Minimum Tract Requirements. A tract of land proposed for an R-5 Residence District shall include a minimum gross area of 10 acres, including the area within the existing improved streets and alleys. No tract shall have an unusually narrow or elongated shape. The shape of the tract shall be adaptable for logical development. The district shall be established in areas where all utilities (public water supply, sanitary sewers and storm sewers) are available or are to be provided to the entire development. Commercial uses shall be permfaed as a special use only where the ~ross area of the tract is 30 acres or more. The commercial use portion shall not be less than 25% of the tract. All streets and roads located in the R-5 District, whether dedicated or undedicated, shall be built according to existing City of Cannel standards, including provision of appropriate right-of-way for undedicated streets and roads. 11.2 Permitted Uses: Any Use Permitted in the R-4 District (Section 10.2). Multiple-family dwelling Recreational uses, related to residential character of district, including open space 11.3 11.3 Special Uses: (See Section 21.0 for additional regulations.) 11.2.1 Amficial lake or pond (not part of a plat) Commercial uses (retail and office) Church, temple or other place of worship Mineral exnction, borrow pit, top soil removal and their swrage Power transmission line, in excess of 129 KVA Private water treatment and/or storage facilities 11.2.2 Minimum Area Requirements: None. 11.2.3 OtherRequirements: Use Commercial uses (retail and office) Other Requirements Total gross area shall not exceed 50 percent of the R-5 District Wact, which shall have a minimum gross area of 30 acres. Also, same as S-1 District regulations of Section 5.2.2. Accessory Buildings and Uses (See Section 25.0 for additional requirements.) Accessory uses or buildings customarily and purely incidental to the uses allowed in this district are permitted. 11.4 11.5 Height. Yard and Density Requirements (See Section 26.0 for additional requirements.) 11.4.1 Maximum height: A. Single- and two-family dwelling - 35 feet; B. Mult~le-family dwelling and all other uses - 45 feet. 11.4.2 Minimum yards: On all outside boundaries of an R-5 District tract adjoining the cited districts, the minimum yards shall be as follows: YARD S-1 AND S-2 R-1 AND R-2 ALL OTHER DISTRICTS FRONT 10' 5' 5' SIDE 75' 75 50' REAR 75' 75' 50' 11.4.3 Dwelling Unit Density shall be regulated on a sliding scale based upon the amount of open space provided. (see subdivision regulations, section 7.0) 11.4.4 Project Open Space. The minimum open space requirement (OSR) shall be designed pursuant to requirements of Section 7.0 of the Subdivision Regulations. 11.4.5 Greenbelt Buffer. A greenbelt buffer shall be provided, and may take the following forms: A. A landscaped transitional area designed consistent with the Plan Commission Guidelines for Landscape Buffering., or B. Open space, design pursuant to the Chapter 7.0 of the subdivision regulations. Application Procedure Procedures and requirements for Planned District approval, set forth in Section 24.0. 45 26.O ABDITIONAL HEIGItT, YARB AND LOT AREA REGULATIONS 26.2 Additional Yard Requirements 26.2.7 Required front yards in residential districts shall be devoted entirely to landscaped area except for guest parking and the necessary paving of driveways and sidewalks to reach parking or loading areas in the side or rear yard. The rain imum front yard of any lot in a qualifying residential subdivision pursuant to Chapter 7.0 of the Subdivision Regulation~ shall be as follows: A. Twenty (20) feet- for structures with a front loading garage, with min. 5-foot garage offset; B. Fifteen (15) feet - for structures with side loading garage, or living area forward of garage (8-foot min offset); C. Ten (10) feet - for structures with rear loading or alley access garages.
