AN ORDINANCE AMENDING ZONING
ORDINANCE NO. Z-289, AS AMENDED
AN ORDNANCE AMENDING THE ZONING ORDINANCE NO. Z-289, AS ~vIENDED,
OF THE CITY OF CARMEL AND CLAY TOWNSHIP, HAMILTON COUNTY, INDIANA
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF C.~RMEL, INDIANA,
THAT ORDINANCE NO. Z-289, AS AMENDED, IS HEREBY AMENDED AS FOLLOWS:
That the zone nmp accompanying and made a pa~ of Zoning Ordinance Z-289, as amended, is
amended to reclassify the following described real estate from the R-2/Residence District to the,
B-7/Business District:
LEGAL DESCRIPTION:
Lots numbered 2 and 3 in Newark Village replat of Lots 61-63, an addition in Hamilton
County, Indiana, as per plat thereof recorded in Plat Book 15, Page 65-66 in the office of
the Recorder of Hamilton County. Indiana.
The above-described real estate is located at the northwest corner of Paunee Road an~;'
Winona Drive within the corporate limits of the City of Carmel, Indiana.
This Ordinance shall be in full 'force mxd effect from and after its passage.

Dear Members:
The Cannel/Clay Plan Commission offers you the following report on the Rezone petition
filed by Paul G, Reis, Esq., on behalf of Carmel Ace Hardware, Inc., to change the Official
Zone Map for the City of Carmel and Clay Township to reclassify a .7 acre tract of land
located at the northwest corner of Paunee Road and Winona Drive from K-2/Kesidence
District to B-7/Business District, Ordinance No. 354, copy attached.
The CarmeFClay Plan Commission's recommendation on the petition of the applicant is
FAVORABLE.
At its regularly scheduled meeting of September 19, 2000, reconvened on September 21,
2000, the Carreel/Clay Plan Commission approved the requested rezone by a vote of 12 in
favor, none opposed, none abstaining.

ZONING CONSENT
Fredrick C. Schneider and Carole M, Schneider, owners of real estate described in
Exhibit "A," attached hereto and made a part hereof, hereby authorizes Carreel Ace Hardware,
Inc. and its attorney, Paul G. Reis, of Paul G. Reis, Esq., LLC, to file a Rezone, Development
Plan, ADLS and Developmental Standards Variance applications and all other zoning
documentation necessary for the rezoning and development of the Real Estate and hereby
consents to the rezoning and development of the Real Estate.
This consent shall remain in effect until revoked by a written statement filed with the
Department of Community Services for the City of Cannel, Indiana.
