HomeMy WebLinkAboutZ-345 Carmel Zoning DefinitionORDINANCE No. Z-345 AN ORDINANCE ADOPTING PROPOSED AMENDMENTS TO CERTAIN DEFINITIONS IN THE CARMEL/CLAY ZONING ORDINANCE WHEREAS, Certain terms used within Chapter 23C (Michigan Road Corridor Overlay Zone) of the Carmel/Clay Zoning Ordinance Z-289 are not defined in the Zoning Ordinance; and WHEREAS, Several of the terms used within the Zoning Ordinance which relate to Group Homes do not conform to recent changes in Indiana State Law; and WHEREAS, After a public hearing duly noticed and held on March 21, 2000, the Carmel/Clay Plan Commission has given a favorable recommendation to the amendment of Section 3.7 (Definitions) of the Zoning Ordinance. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, pursuant to I.C. 36-7-4-607, it adopts this Ordinance to approve the following changes to Section 3.7 of the Carmel/Clay Zoning Ordinance Z-289. Chapter 3.0 Section 3.7 DEFINITIONS Definitions. Repeal the following definitions: DWELLING, MULTIPLE-FAMILY. A residential building containing three or more dwelling units and occupied by three or more families. DWELLING, SINGLE-FAMILY. A residential building containing only one dwelling unit and not occupied by more than one family. Adopt the following de~nitiorls: ALTERATION,. MATERIAL. Any change to an approved plan of any .type that involves the substitution of one material, species, element, etc. for another. ALTERATION, MINOR. Any change to an approved plan of any type that involves the revision of less than ten percent (10%) of the plan's total area or approved materials. ALTERATION. SUBSTANTIAL. Any change to an approved plan of any type that involves the revision often percent (10%) or more of the plan's total area or approved materials. DIAMETER AT BREAST HEIGHT ('dbh). Diameter of a tree trunk measured at fifbs'-four (54) inches above grade. DWELLING, MULTIPLE-FAMILY. A residential building containing three or more dwelling units and occupied by three or more families. Except as otherwise provided by state statute, a group home shall be considered a multiple-family dwelling and treated as such under this Ordinance. DWELLING, SINGLE-FAMILY. A residential building containing only one dwelling unit and not occupied by more than one family. Pursuant to IC 12-284-7, a group home for the mentally ill shall be treated as if it were a single-family dwelling, unless the group home will be located within three thousand (3,000) feet of another group home for the mentally ill, as measured between lot lines. Pursuant to IC 12-28-4-8, a group home for not more than eight (8) developmentally disabled individuals which is established under a program authorized by IC 12-11 - 1.1 - 1 (e)( 1 ) or IC 12-11 - 1.1 - l(e)(2) shall be treated as if it were a single-family dwelling. FAMILY. One or more persons living as a single housekeeping unit, as distinguished from a group occupying a hotel, club, nursing home, fraternity or sorority house, or group home. GROUP HOME. Any of the following: (1) a residential structure (licensed under IC 12-17.4) in which care is provided on a twenty-four (24) hour basis for not more than ten (10) children; or (2) a facility (licensed under IC 12-28-4) that provides residential services for developmentally disabled individuals in a program described in IC 12-11-1 . 1-1(e)(1) or IC 12-11-1 . 1 -1(e)(2); or (3) a facility (licensed under IC 12-28-4) that provides residential services for mentally ill individuals in a program described in IC 12-22-2-3. SEXU,4LL Y-ORIENTED BUSiNESS. An establishment that has as a substantial portion of its stock-in-trade and offers for sale and/or for viewing, for any form of consideration, any one or more of the following: 1) 2) books, magazines, periodicals, or other primed matter, or photographs, films, motion pictures, video cassettes, slides, or other visual representations that are characterized by an emphasis upon the depiction or description of sexual activities; or instruments, devices, or paraphernalia that are designed for use in connection with sexual activities. Also, a nightclub, bar, restaurant, or similar establishment that regularly features live performances that are characterized by the exposure of less than completely and opaquely covered human genitals, pubic region, buttocks, anus, female breasts below a point immediately above the top of the areolae, or human male genitals in a discernibly turgid state, even if completely and opaquely covered. THROUGH ROAD. A drive, road, street or other motor vehicle path having separate ingress to and egress from an easement, greenbelt, lot, parcel or other similarly established area.
