Z-367-01 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA REZONING DISTRICT CLASSIFICATION Rezoning Lots 8, 9, 10, 11, lla, 12, and 13 within the North Augusta Subdivision from the S- I/Residence and B-2/Business District Classifications within the US 421/Michigan Road Overlay Zone to the B-2/Business District Classification within the US 421/Michigan Road Overlay Zone WHEREAS, the Carreel/Clay Plan Commission has favorably recommended the rezoning of the real property, the legal description of which is attached hereto as Exhibit A. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section I: That the Official Zoning Map accompanying and made part of the Zoning Ordinance is hereby changed to designate the real property from the S-I/Residence and the B-2/Business District Classifications within the US 421/Michigan Road Overlay Zone to the B-2/Business District Classification within the US 421/Michigan Road Overlay Zone. SectionlI: AllpriorOrdinancesorpartsthereofinconsistentwithanyprovisionofthisOrdinance are hereby repealed. Also, Lots 11, 1 la, and 12 in North Augusta Re-Subdivision, recorded as Instrument No. 3981 in Deed Book 134, Pages 521-522, in the Office of the Recorder of Hamilton County, Indiana. 3 / CERTIFICATION OF CARMEL/CLAY PLAN COMMISSION'S RECOMMENDATION TO AMEND THE CARMEL CLAY ZONING ORDINANCE Z-289, TO CHANGE THE OFFICIAL ZONING MAP FOR THE CITY OF CARMEL AND CLAY TOWNSHIP PURSUANT TO INDIANA CODE 36-7-4-605 ORDINANCE No. Z-367-01 The Honorable Common Council of the City of Carmel, Hamilton County, Indiana Dear Members: The Cannel/Clay Plan Commission offers you the following report on an Ordinance Amendment to change the official Zoning Map for the City of Carreel and Clay Township as follows: The designation of certain real property from the S-1/Residence and the B-2/Business District Classifications within the US 421/Michigan Road Overlay Zone to the B- 2/Business District Classification within the US 421/Michigan Road Overlay Zone, more particularly described as follows: Certain real estate situated in Hamilton County, Indiana, known as Lots 8, 9, 10, 11, 1 l a, 12, and 13 within the North Augusta Subdivision located northeast of the intersection of West 96~h Street and North Michigan Road.. The Cannel/Clay Plan Commission's recommendation on the Ordinance Amendment is FAVORABLE. At its regularly scheduled meeting held November 27, 2001, the Cannel/Clay Plan Conunission approved the Ordinance Amendment by a vote of 13 in favor, none opposed, none abstaining.
