AN ORDINANCE AMENDING THE CARMEL ZONING ORDINANCE Z-160
AS AMENDED, AND ESTABLISHING A B-8 ZONE CLASSIFICATION
BUSINESS CENTER DEVELOPMENT, WHERE APPROPRIATE
WHEREAS, the Carmel Plan Commission has established a Comprehen-
sive Plan as required by statute, and
WHEREAS, the Carmel Plan Commission is empowered to advise and
recommend to the Common Council of the City of Carmel ordinances and
amendments for the zoning of districts of land within the City of
Carmel and Clay Township, Indiana, and
WHEREAS, pursuant to I.C. 36-7-4-601, in order to secure
adequate lighting, air, convenience of access and safety from fire,
flood and other damage; lessen or avoid congestion in public way;
promote the public health, safety, comfort and morals, convenience
and general public welfare and accomplish the purposes of the
advisory planning law; and
WHEREAS, there exists a need and it is in the best interests of
the citizens of the City of Carmel and Clay Township, Indiana to
provide a business zone district - Business Center Development -
within the City of Carmel and Clay Township, Indiana and to that end
to amend 0rdinanze Z-160, as amended:
BE IT ENACTED BY THE COMMON COUNCIL of the City of Carmel,
Indiana as follows:
1. It is hereby declared that the contents of this
including all text, figures and charts, shall constitute
of the Carmel Zoning Ordinance, Z-160, as amended.
2. It is hereby declared by the Common Council of the City of
Carmel, Indiana that Section 18A - B-8 - Business Center Development
- is hereby adopted and made a part of the Zoning Ordinance, Z-160,
as amended.
3. This Ordinance shall be in

1SA.1 Purpose and Intent
The purpose of this district is to provide for a variety of commercial and
office uses to be developed in a shopping center type enviromnent which may include
one or more unified shopping centers and/or one or more cormmercial and office
buildings.
18A.2 Tract Requirements
The district shall be established in areas where all utilities (public water
supply, sanitary sewers and storm sewers) are available or are to beprovided to the
entire development. Ail streets and roads located in the B-8 district, whether
dedicated or undedicated, shall be built according to existing C~mel standards
including provision of appropriate right-of-way on undedicated streets and roads,
except for traffic patterns which are merely painted on a parking lot surface. The
requirements of this Section, 18A.2, notwithstanding, the streets and reads construct-
ed and in use as of Dec~ber 1, 1982, are not subject to the provisions of Section
18A.2.

18A.5 Common Parking.
The foregoing parking requirements notwithstanding, if the structure is
located in an area where common parking is available to the users of the
facility then parking can be reduced by the amount of common parking
spaces which can reasonably be allocated to the facility. A parking plan
showing roadways, entrances, exits and common area parking in relation
to all structures shall be filed and approved by the Carmel Plan Commission.
18A.6 Accessory Building and Uses. (See 24.0)
Accessory uses of buildings customarily and purely incidental to the uses
allowed in this district are permitted; providing that the building
materials and color are compatible with those of the primary building.
18A.7 Height and Area Requirements. (See 25.0)
18A.7.1 Maximum Height - Fifty (.50) feet
18A.7.2
Minimum Structure Setback - No primary building or acces-
sory structure, including any ground storage area shall
be located within 25 feet of the front right of way line,
or within l0 feet of a side and area property line.
18A.8 Landscaping Requirements.
Where a B-8 district abuts, or adjoins across a street, a parcel zoned or
used for residential purposes, a greenbelt of lawn area with a minimum
width of 30 feet shall be provided along the abutting or adjoining line.
A planting screen, consisting of suitable shrubbery~ shall be planted at
the time of construction and shall be maintained in order to provide
effective screening at all times during the year. The shrubbery may be

planted informally or in rows and shall screen parking areas, outside
storage areas, loading berths, trash and refuse containers and so forth
from abutting and adjoining residential properties. Vision clearance
on corner lots and at the intersections of streets and driveways shall be
observed and maintained. No accessory buildings or uses may be erected
or pursued within the required greenbelt or lawn area with the exception
of sidewalks, decorative or protective items, other landscaping items and
signage as permitted by the Carmel Sign Ordinance. Additional landscap-
ing (such as street trees) may be required by the Carmel Plan Commission
in order to maintain area-wide uniformity.
A landscape plan shall be submitted concurrent with the site plan as
contemplated by this section.
18A.9 Signs.
A Sign Plan for the proposed use shall be presented in the Development
Plan. All signs shall conform to the Sign Ordinance. Signs for each
proposed use shall be uniform in character as to color and architectural
design as approved by the Plan Commission.
1SA. t0 Lighting.
Ail lighting standards within the cevelopment shall be of uniform design
and materials. Parking lot and street lights shall also be of uniform
height. Ail lights shall be of a "down lighting" type with the light
element completely shielded on all sides and top. A Lighting Plan shall
be submitted as part of the site plan.
ISA. 11 Loading Berths.
Loading berths and trash collection areas shall be permitted per the
demand of the business establishments and shall be identified on the
site plan. Trash collection areas shall be properly screened and enclosed.
18A.12 Emergency Access.
Adequate emergency access space shall be provided to the side and rear of
all primary buildings located within the district. Ail emergency access
areas and facilities shall be shown on the site plan and revie~L=d by the
Carmel Chief of Police and Carmel Fire Chief.
18A.13 Plan Commission Approval.
To insure the compatibility of the proposed use with adjoining areas, The
Plan Commission shall review the architectural design, exterior, light-
ing, landscaping andsignage of any proposed use within this B-8 zoning
classification prior to the issuance of an improvement location permit,
by the Department of Community Development. Once approved by the Plan
Commission the architectural design, exterior lighting, landscaping and
signage shall not be materially or substantially changed or altered
without the prior approval of the Plan Corrm~ission_
