Z-211 AN ORDINANCE AMENDING THE CARMEL ZONING ORDINANCE Z-160, AS AMENDED TO BE PART OF THE MASTER PLAN OF THE CITY OF CARMEL, INDIANA, ESTABLISHING AND REGULATING THE PLACEMENT OF SATELLITE RECEIVING ANTENNAS AS ACCESSORY USES WITHIN THE CITY OF CARMEL AND CLAY TOWNSHIP, INDIANA WHEREAS, the health, safety and aesthetic considerations of the owners and surrounding land owners require regulation as to the location of satellite receiving antennas; and WHEREAS, this ordinance constitutes the least restrictive method to accomplish such regulation; and WHEREAS, it is in the best interest of the citizens of the City of Carmel and Clay Township, Indiana, to have such regula- tions. THEREFORE, be it ordained by the Common Council of the City of Carmel, that: 1. That Ordinance D-447 title and ordinance regulating the placement of satellite receiving antennas as accessory uses within the city of Carmel, Indiana, is, upon the passage of this ordinance, repealed. 2. The following definitions shall be added to the accessory uses Section 3.6, so that it shall read as follows: a) DISH-TYPE RECEIVING ANTENNA (EARTH STATION OR GROUND STATION): A signal receiving device, the purpose of which is to receive radio communications, television, data transmission or other signals from a satellite or satellites in earth orbit. Considered a structure, thus subject to all ordinances relating to structures. b) LOW NOISE AMPLIFIED (LNA): A signal amplifying device situated within the earth sta- tion; the purpose of which is to magnify the electronic signals received and transfer them through the coaxial cable to the receiver. RECEIVER: A television set, radio, communication device or data input device that utilizes the signals from the earth station. d) DISH: That part of the earth station shaped like a saucer or dish. 2. That the following zoning districts are hereby amended by adding to them an additional paragraph: SECTION 5.3 S-1 DISTRICT 6.3 S-2 DISTRICT 7.3 R-1 DISTRICT 8.3 R-2 DISTRICT 9.3 R-3 DISTRICT 10.4 R-4 DISTRICT 11-4 R-5 DISTRICT 12.3 B-1 DISTRICT 13.3 B-2 DISTRICT 14.2 B-3 DISTRICT 15.4 B-4 DISTRICT 16.3 B-5 DISTRICT SECTION 17.4 B-6 DISTRICT 18.3 B-7 DISTRICT 19.3 I-1 DISTRICT 20.3 I-2 DISTRICT 23-01-8 U.S. 31 OVERLAY 25.1 ADDITIONAL USE REGS. 33.3 CLUSTER HOUSING 18A.6 B-8 (Z-192) The new paragraph to be added to the aforementioned zoning districts shall read as follows: "DEVELOPMENTAL STANDARDS Satellite receiving antennas shall be permitted within all zoning districts of the City of Carmel and Clay Township subject to the following regulations and subject to any and all review and approval procedures within the Carmel Zoning Ordinance. Ail satellite receiving antennas shall be located only within the rear yeard of any residential and commercial principal structure as defined by the Carmel Zoning Ordinance. 3. Satellite receiving antennas shall not be allowed on the roof of any principal or accessory structure. 4. Only one (1) satellite receiving antenna shall be located on any one lot. 5. A satellite receiving antenna and support structure shall be limited to a maximum height of twelve (12) feet. A satellite receiving antenna having printed matter on its surfaces hall be treated as a sign relative to the Carmel Sign Ordinance. 7. A building permit shall be required prior to the erection of a satellite receiving antenna. Ail cables, wires and connectors from a satellite receiving antenna to other equipment shall be buried underground. A satellite receiving antenna shall not be located within five (5) feet of any property line, easement or public right-of-way. 10. Ail satellite receiving antennas shall be obscured from the view of adjacent property owners of public rights-of- way by: buildings, screen wall, fence, berm, evergreen planting or any combination thereof. Such screening devices shall be at least eighty percent (80%) obscuring when viewed from adjacent property or public road right- of-way, as approved by the Department of Community Development, Carmel Plan Commission and/or Carmel Board of Zoning Appeals when applicable. 11. Ail satellite receiving antennas shall be neutral or black in color and, to the extent possible, shall be com- patible with the appearance and character of the neighborhood." APPLICATION FOR PERMIT a. A plot plan showing the proposed location of the satellite receiving antenna. A site plan, showing not only the building locations of the land parcel, but also building locations of proper- ties on all sides of the subject land parcel. c. A statement that the installation complies with all applicable building and electrical codes. Once installed, the satellite receiving antenna shall be inspected by the Carmel Department of Community Development for compliance with all applicable requirements. e. A permit fee of Forty Dollars ($40.00) shall be required for a building permit for a satellite receiving antenna. ADOPTION This ordinance shall be in full force and effect from and after the date of passage by the Common~un~l of the City of Carmel, Indiana, this ~/ day of ~ , 1986.
