AN ORDINANCE AMENDING ZONING ORDINANCE B-160
A PART OF THE MASTER PLAN OF THE CITY OF CARMEL, INDIANA
AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF
CARMEL, INDIANA, ORDINANCE NUMBER Z-160, AS AMENDED, PASSED BY
THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ON JANUARY 21,
1980, UNDER THE AUTHORITY ACTS 1979, PUBLIC LAW 178, SECTION 1,
ET SEQ., (I.C. 36-7-4-101 et seq.) AND ALL ACTS AMENDATORY OR
SUPPLEMENTARY THERETO.
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF CARMEL,
INDIANA, THAT ORDINANCE NL~BER Z-160 AS AMENDED, IS HEREBY
AMENDED AS FOLLOWS:
That the zone map accompanying and made a part of the Zoning
Ordinance Z-160, Sections 4.1-4.3, as amended, and the zoning
classifications of Zoning Ordinance No. Z-160 are amended to
reclassify and re-zone the following described property from an
R-2 zoning classification to a B-7 zoning classification within
the zoning districts and on the official zoning map:
Part of the east half of th~ southwest quarter of
Section 25, Township 18 ~Nor~h, Range 3 East, in
Hamilton County, Indiana~, being more particularly
described as follows:
Beginning at the southwest corner of said tract and
run east 30 rods; north 534-5/6 feet; west 30 rods;
south 534-5/6 feet to the place if beginning in
Hamilton County.
This Ordinance shall be in full force and effect from and
after its passage. Passed by the Common Cgzkncil of the City of
Carmel, Indiana, on the ~ff~ day of ~x~ , 1985.

RESTRICTIVE CONVENANT RUNNING WITH THE LAND
WITNESSETH:

South Guilford, Carmel, Indiana, hereby covenants, stipulates
and agrees with the City of Carmel, Indiana (hereinafter
referred to as "Covenantee") for One Dollar ($1.00) and
other valuable consideration the following:
That each and all of the covenants, stipulations
and agreements herein are to have the effect of a covenant
running with the land; the execution of this instrument
binds the Covenantor's successors in interest, to abide
by and carry out said covenants, stipulations and agreements;
that for the benefit of neighboring property owners and
the residents of the City of Carmel, Indiana and as a
limitation upon all future owners of said land and premises;
that in addition to the statutory use restrictions of a
B-7 zoning classification, said land and premises shall
not be used for any regular commercial purposes, either
retail or wholesale or otherwise.
This covenant runs with the land more particularly
described as follows:

The undersigned persons executing this Deed on
behalf of Covenantor represent and certify that they are
herein; and that all necessary corporate
actions for the
making of such covenant has been taken and done.
IN WITNESS WHEREOF, Covenantor has caused this
Restrictive Covenant Running with the Land to be executed
