Z-195 AN ORDINANCE AMENDING THE CARMEL ZONING ORDINANCE Z-16O, AS AMENDED WHEREAS, the Carmel Plan Commission has established a comprehen- sive plan as required by statute, and; WHEREAS, the Carmel Plan Commission is empowered to advise and recommend to the common council of the City of Carmel, ordinances and amendments for zoning land within the City of Carmel and Clay Township, Indiana, and; WHEREAS, pursuant to I.C. 56-7-4-601, in order to accomplish the purposes of the Advisory Planning Law and promote public health, safety, comfort and morals, convenience and general public welfare, and accomplish the purposes Of the Advisory Planning Law, and; WHEREAS, there exists a need and it is in the best interests of the citizens of the City of Carmel and Clay Township, Indiana, to define certain terms in the Carmel Zoning Ordinance Z-160, as amended: BE IT ENACTED BY THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AS FOLLOWS: 1. Section 5.0, titled Definitions, shall be amended to add the term SANITARY LANDFILL which term shall appear after the term ROW HOUSE OR TOWNHOUSE and before the term SCHOOL OR GENERAL EDUCATION: Sanitary Landfill: a solid waste* disposal facility** wh~c~may i5'61u e a~cinerator, grinder, composting facility or other State Environmental Protection Agency approved facility other than an open dump or facility for storage of contained liquid or semi-solid waste or gas, including, but not limited to environmentally harmful chemicals or radioactive materials of any type. 2. Section 3.0, titled Definitions, shall be amended to add the term SOLID WASTe, which term shall appear after the term SOIL MAP and before the terms SORORITY, FRATERNITY or STUDENT COOPERATIVBS: *Solid Waste: Ail putresible waste in form other than a liquid, semi-solid or gaseous form, whether contained in any form or object, and which is not hazardous waste as defined in I.C. 15-7-1-2 nor waste which contains any biological, chemical, bacteriological, radioactive or any other contaminant which may be harmful or injurious to the public health, safety or welfare, to to domestic, commercial, industrial, agricultural, recreational or conservation concerns of the City of Carmel and/or Clay Township and its citizens. This definition is intended to specifically exclude human bodies and sewage. 5. Section 5.0, titled Definitions, shall be amended to add the term DISPOSAL FACILITY, which term shall appear after the word DMCIBEL and before the word DISTRICT: ~*Disposal Facility: a site or plant where solid waste is subject to treatment, storage, recovery, incineration, grinding, composting, collection or covering by earth. 4. This ordinance shall be in full force and effect from and after the date of its passage.
