ORDINANCE NO. Z-222
AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF
CARMEL, INDIANA, ORDINANCE NO. Z-160, AS AMENDED, PASSED BY THE
COMMON COUNCIL OF THE CITY OF CARMEL, INDIANAt ON JANUARY 21,
1980, UNDER AUTHORITY OF ACTS OF 1979, PUBLIC LAW 178, SECTION 1,
et seq., (I.C. 18-7-4-101 et seq.) AND ALL ACTS AMENDATORY OR
SUPPLEMENTARY THERETO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CARMEL,
INDIANA, THAT ORDINANCE NO. Z-160, AS AMENDED, IS HEREBY AMENDED
AS FOLLOWS:
That the zone map accompanying and made a part of Zoning
Ordinance Z-160, Sections 4.1-4.3, as amended, and the zoning
classifications of Zoning Ordiance No. Z-160, are amended to
reclassify and re-zone the following described property from an
R-1 Residence District Zoning Classification to a M-3 Industrial
District Zoning Classification within the zoning districts and on
the official zoning map:
The background deed from which this survey is taken is
recorded in Book 247 on page 71 in the Office of the
Recorder of Hamilton County, Indiana and recited as
follows:
Part of Section 35, Township 18 North, Range 3 East
described as follows: Beginning at a point 40 rods
North of the southwest corner of the Northeast Quarter
of said Section 35, and run East 80 rods; thence North
26 rods, thence west 80 rods, thence south 26 rods to
the place of beginning, containing 13 acres, more or
less.
ALSO, twenty (20) acres off the immediate south end of
the West half of the Northeast Quarter of Section 35,
Township 18 North, Range 3 East.
Due to the uncertainty of the above described parcels,
I am preparing a new metes and bounds description based
upon the adjoining deeds to the North and field work
performed under my supervision during June, 1985 and
July, 1987, described as follows:
Part of the West Half of the Northeast Quarter of
Section 35, Township 18 North, Range 3 East in Hamilton
County, Indiana, more particularly described as
follows:
Beginning at the Southwest corner of said Northeast
Quarter Section; thence along the South line thereof
North 88 degrees 49 minutes 16 seconds East 1326.70
feet to the Southeast corner of the West Half of said
N~rth~a~t Ouarter Section. which said corner is the
North 00 degrees 07 minutes 31 seconds West 1079.02
feet from the point of beginning; thence along said
West line South 00 degrees 07 minutes 31 seconds East
1079.02 feet to the Point of Beginning, containing
32.914 acres, more or less.
Subject to a 25 foot wide sewer easement recorded March
25, 1986 in Easement Record 3~ page 933 in the Office
of the Recorder of Hamilton County, Indiana.
Also subject to the right of way for Pennsylvania
Street along the Westerly side of the above described
tract.
This Ordinance shall be in full force and effect from and
after its passage. Passe ~by the Common Council of the City of
Carmel, Indiana, on the/~ day of c~, , 1987.
