HomeMy WebLinkAboutZ-219 Definitions ClarifiedO IN CE AN ORDINANCE AMENDING THE CARMEL ZONING ORDINANCE Z-160, AS AMENDED TO BE .PART OF THE MASTER PLAN OF THE CITY OF CARMEL~ INDIANA~ ESTABLISHING AND REGULATING. SUB- DIVISION DEVELOPMENT~ CUL-DE-SACS~ RES- TAURANT PARKING~ STREETS~ FENCE CONSTRUCTION~ INSTITUTIONAL SIGNS~ ACCEL- DECELL LANES AND BONDS. WHEREAS, the Carmel Plan Commission has established a Comprehensive Plan as required by statute and, WHEREAS, it is in the best interest concerning the health, safety and welfare of the citizens of the City of Carmel and Clay Township, Indiana, to establish and regulate subdivision development, cul-de-sacs, restaurant parking, streets,~ fence construction institutional signs, acoel-decell lanes and bonds, and WHEREAS, this ordinance constitutes the least restrictive method to accomplish such regulation, THEREFORE, be it ordained by the Common Council of the City of Carmel~ that: Section 3.6 Definitions shall be emended to read as follows: CUL-DE-SAC. (Court or Dead End Street) A short street having one end open to a through street and being permanently terminated by a vehicle turn around. The length of a cul-de-sac is measured from the center of the turn around to the centerline of the first intersecting through street. The following Zoning Ordinance sections are hereby emended by amend- ing the Parking Requirements for RESTAURANT OR FAST FOOD OPERATION: Section 12.1 - B-1 District Section 13.1 - B-2 District Section 14.i - BJ3 District Section 15.2 B-4 District Section 17.2 B-6 District Section 18.2 B-7 District Section 18A.2 - B-8 District The new parking requirement to be inserted in the aforementioned Zoning Ordinance sections shall read as follows: One space per every 2.5 patron seats, plus one space per employee per largest shift. Section 25.2 Fences is hereby emended to add the following section: Add 25.2.7 No fence shall be constructed within the approved subdivi- sion retention/detention drainage facility easement. SeCtion 25.?.03-2a of the Sign Ordinance, Institutional Uses, shall be amended to read as follows: (ii) NUMBER & TYPE: One (1) identification sign end one (1) change- able copy si~n. A building located on a double-frontage lot is per- mitred two (2) identification st~ns; only one (1) sign shall face on any particular property frontage with a maximum of two (2) signs. Subdivision Regulations, Section 5.7.3Provisions for Financial Per- formance and Maintenance Guarantees for Subdivisions shall ba amended to read as follows: 5.7.3 Upon the completion of the required public facility improve- ments and installations according to the recorded secondary plat, approved development plans, and accompanying data and the standards cited herein, the subdivider shall provide the Department of Community Development with two (2) sets of as-built drawings showingall site improvements, including but not limited to drainage and sewerage systems, water distribution systems, signs, and monuments as they were constructed and installed, and ingludimg certificates by a Professional Engineer or Land Surveyor that all improvements were installed as shown end in conformance with this ordinance and all applicable standards and requirements of the appropriate governmen- tal jurisdictions. -The subdivider may then request the release of the per- formance guarantee posted with the proper authority. Upon the receipt ora maintenance guarantee, as specified herein, the proper authority shall release the performance guarantee within sixty 60 days.' The perfor.m~ce guarantee for each individual public facility improvement or installation may be handled separately and shall in no way be contingent on the comple- tion of any of. the other individual public facility improvements and in- stallations or their performance guarantees. Ail cul-de-sacs shall terminate in a circular right-of-way with a minimum diameter of 100 feet and a minimum pavement diameter of 76 feet, or other approved arrangement for t~e turning of all vehicles conveniently within the right-cf-way. Where cul-de-sac streets extend from another cul-de-sac or dead-end street, the total, length of both streets shall not exceed 600 feet. SUBDIVISION REGULATIONS Section 6.3 Street Layout and Design Stand- ards shall be amended to include the following sections= 6.3.2] Subdivisions consisting of 15 lots or more shall have at least two points of access. This access is co be from a through street (feeder, arterial, or collector) or, where the Plan Commission finds it to be appropriate, the continuation of existing, planned or platted streets on adjacent tracts, or the extension of proposed streets to the boundary of the subdivision. 6.3.22 Where subdivision access is from a Primary or Secondary thoroughfare, or a collector street, acceleration]deceleration lanes and a passing lane shall be provided at each intersection per the following chart: (Chart available for inspection at the Department of Community Development located at 40 E. SUBDIVISION REGULATIONS Section 8.9 Sidewalks shall be emended to read: The installation of sidewalks in all subdivisions within the entire jurisdictional area of the Commission shall be mandatory, said sidewalks being installed on both sides of the street in front of the house in ac- cordance with the current standards of the City of Carmel. This includes sidewalks on existing roads within and bordering a subdivision.
