HomeMy WebLinkAboutZ-218 Rezone S-1 to B-3ORDINANCE NO.__~_~__~__~ AN ORDINANCE AMENDING OP.I)INANCE Z-160, A PART OF THE MASTER PLAN OF THE CITY OF CARMEL, INDIANA AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CARMEL, INDIANA, ORDINANCE NUMBER Z-160, AS AMENDED, PASSED BY THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ON JANUARY 21, 1980, UNDER THE AUTHORITY ACTS 1979, PUBLIC LAW 178, SECTION 1 ET SEQ., (I.C. 36-7-4-101, et seq.) AND ALL ACTS AMENDATORY OR SUPPLEMENTARY THERETO. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, THAT ORDINANCE NUMBER Z-160 AS AMENDED, IS HEREBY AMENDED AS FOLLOWS: SECTION I That the zone map accompanying and made a part of Zoning Ordinance Z-160, Sections 4.1 - 4.3, as amended, and the zoning classifications of Zoning Ordinance No. Z-160 are amended to reclassify and rezone the following described property from an S- i zoning classification to a B-3 zoning classification within the zoning districts and on the official zoning map: Part of the Southwest Quarter of Section 6, Township 17 North, Range 3 East in Hamilton County, Indiana, more particularly described as follows: Commencing at the Southwest corner of the Southwest Quarter of Section 6, Township 17 North, Range 3 East in Hamilton County, Indiana; thence North 00 degrees 29 minutes 33 seconds East (assumed bearing) on and along the West line of said Quarter 515.66 feet to the point of beginning, said point marked by an iron pin; thence North 70 degrees 35 minutes 25 seconds East 796.84 feet to an iron pin at the intersection with the West right- of-way line of State Highway 421 on a non-tangent curve having a radius length of 17,238.74 feet which bears North 70 degrees 50 minutes 29 seconds East; thence Northwesterly on and along said right-of-way on and along said curve an arc distance of 591.90 feet through a central angle of 1 degree 58 minutes 02 seconds to the Northeast corner of the land described in Deed Record 171, page 328 of the Hamilton County Recorder's records; thence South 86 degrees 59 minutes 33 seconds West on and along the North line of sgid land 560.84 feet to the Northwest corner of said land; thence South 00 degrees 29 minutes 33 seconds West on and along the West line of said Quarter 797.74 feet to the point of beginning; containing 10.52 acres, more or less. SECTION II This Ordinance shall be in full force and effect from and after its passage. Passed by the Common Council of the City of Indiana on this ½ day of ~ , 1987. Pearson, III, by his attorney, petitions the City of Carmel to rezone the following described real estate pursuant to I.C. 36-7-4-607 et seq.: Part of the Southwest Quarter of Section 6, Township 17 North, Range 3 East in Hamilton County, Indiana, more particularly described as follows: Commencing at the Southwest corner of the Southwest Quarter of section 6, Township 17 North, Range 3 East in Hamilton County, Indiana; thence North 00 degrees 29 minutes 33 seconds East (assumed bearing) on and along the West line of said Quarter 515.66 feet to the point of beginning, said point marked by an iron pin; thence North 70 degrees 35 minutes 25 seconds East 796.84 feet to an iron pin at the intersection with the West right- of-way line of State Highway 421 on a non-tangent curve having a radius length of 17,238.74 feet which bears North 70 degrees 50 minutes 29 seconds East; thence Northwesterly on and along said right-of-way on and along said curve an arc distance of 591.90 feet through a central angle of 1 degree 58 minutes 02 seconds to the Northeast corner of the land described in Deed Record 171, page 328 of the Hamilton County Recorder's records; thence South 86 degrees 59 minutes 33 seconds West on and along the North line of said land 560.84 feet to the Northwest corner of said land; thence South 00 degrees 29 minutes 33 seconds West on and along the West line of said Quarter 797.74 feet to the point of beginning; containing 10.52 acres, more or less. Subject to any legal easements or rights-of-way. And in support of its petition respectfully shows the City legislative body as follows: 1. The real estate to be rezoned is owned entirely by petitioner, John S. Pearson, III. 2. The Carmel Plan Commission and various subcommittees have consented to the requested rezone. 3. The Petitioner has complied in all respects with the requirements of I.C. 36-7-4-607. WHEREFORE, Petitioner requests the Common Council of the City of Carmel to amend the Zoning Ordinance in the form sub- mitred herewith.
