ORDINANCE NO. Z-440-03
AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
REZONING DISTRICT CLASSIFICATION
Rezoning the property known as Burlingame (as proposed)from the S-i/Residence District
Classification to the R-2/Residence District Classification
WHEREAS, the Carmel/Clay Plan Commission has favorably recommended ~he rezoning
of the real property, the legal description of which is attached hereto as Exhibit A.
NOW, THEREFORE, BE IT ORDAINED by the .Common Council of the Ci!y of Carmel,
Indiana, as follows:
Section I:
That the Official Zoning Map accompanying and made part of the Zoning Ordinance is hereby
changed to designate the real property from the S-i/Residence District Classification to the R-
2/Residence District Classification. ~
Section II: i
All prior Ordinances or parts thereof inconsistent with any provision of th~s Ordinance are hereby
repealed.

Burlingame
Rezone of property commonly known as Burlingame from S-1/Residential to R-
2/Residential. Also described by the following boundary description:
A part of the West Half of the Northwest Quarter of Section 29, and a part of the Southwest
Quarter of the Southwest Quarter of Section 20, all in Township 18 North, Range 3 East, Clay
Township, Hamilton County, Indiana, more particularly described as follows:
Commencing at the Southwest comer of the Northwest Quarter of said Section 29; thence North
00 degrees 03 minutes 21 seconds East along the West line of said Northwest Quarter Section
1,683.82 feet to the POINT OF BEGINNING of this description; thence continuing North 00

Dear Members:
The Carmel/Clay Plan Commission offers you the following report on thc application (Docket No. 126-
03 Z) of Pitmutn Farmers petitioning the Commission for a favorable recommendation to rezone property
generally located along the east side of Shelbome Road, ¼ mile north of 131~t Street from the S-1 /
Residential Estate to R-4 / Residence:
The Carmel/Clay Plan Commission's recommendation on the petition of the applicant is
"FAVORABLE."
At its regularly scheduled meeting of December 16, 2003, the Carmel/Clay Plan Commission voted ten
(10) in Favor, two (2) Opposed, zero (0) Abstaining, to forward to the Common Council the proposed
Ordinance No. Z-440-03 with a Favorable Recommendation.
Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant to IC
36-7-4-608(f)(4), the Council has ninety (90) days to act on this petition before it becomes effective as
Certified by the Commission. Ninety days from the date of this Certification is Tuesday, March 16, 2004.
