AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL,
INDIANA, REZONING DISTRICT CLASSIFICATION
Rezoning ora portion of Lot 9 in Williams Creek Farms Subdivision (consisting of ~ 1.4 acrea9
WHEREAS, pursuant to Indiana Code 36-7-4, the Common Council has lawfully adopted
a zoning ordinance, the terms of which are applicable to the geographic area consisting of the
incorporated area of the City of Carmel, Indiana, and the unincorporated area of Clay Township,
Hamilton County, Indiana, which zoning ordinance has been codified in Chapter 10 of the
Carmel City Code; and
WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to
amend the map that is part of the zoning ordinance; and
WHEREAS, the Carmel/Clay Plan Commission has favorably recommended the rezoning
of the real property, the legal description and location map of which is attached hereto as
Exhibit A.
NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of
Carmel, Indiana, as follows:
Section 1. That the Official Zoning Map accompanying and made part of the Zoning
Ordinance is hereby changed to designate the real property from the S-2/Residence District
Classification to the B-6 Business District Classification.
Section 2. All prior Ordinances or parts thereof inconsistent with any provision of this
Ordinance are hereby repealed.
Section 3. This Ordinance shall be in full force and effect from and after passage, and
presentation to and approval by the Mayor.
Ordinance No. Z-468-04 PASSED by the Common Council of the City of

recorded in Plat Book 8, Pages 1-3 in the office of the Hamilton County Recorder,
containing 1.40 acres, more or less. Also described as follows:
Part of the East Half of the Northwest Quarter of Section 35, Township 18 North, Range
3 East in Hamilton County, Indiana, described as follows:
Commencing at the Southeast corner of the Northwest Quarter of Section 35, Township 18
North, Range 3 East; thence South 88 degrees 52 minutes 28 seconds West (assumed bearing) on
the South line of said Northwest Quarter 1328.33 feet to the Southwest comer of the East Half of
said Northwest Quarter, said corner being collinear and equidistant between said Southeast
comer and the Southwest comer of said Northwest Quarter; thence North 00 degrees 01 minutes
21 seconds West 984.12 feet to the southeast corner of Lot Numbered 12 as recorded in the Plat

Civic Square, Carmel, indiana, 46032 will hold a Public Hearing with respect to the: Application

Dear Members:
The Carmel Plan Commission offers you the following report on the application (Docket No. 04100031 Z)
of the Lauth Property Group petitioning the Commission for a favorable recommendation to rezone a
property located northwest of Old Meridian Street and Old Meridian/US 31 (commonly known as North
Meridian Medical Pavilion) from the S-2/Residence Zoning Classification to the B-6/Business Classification.
The Carmel Plan Commission's recommendation on the petition of the applicant is "FAVORABLE."
At its regularly scheduled meeting on November 16, 2004, the Carmel Plan Commission voted nine (9) in
Favor, zero (0) Opposed, zero (0) Abstaining, to forward to the Common Council the proposed Ordinance
No. Z-468-04 with a Favorable Recommendation.
Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant to IC 36-7-
4-608(0(4), the Council has ninety (90) days to act on this petition before it becomes effective as Certified
by the Commission. Ninety days from the date of this Certification (November 18, 2004) is Wednesday,
February 16, 2005.
