ORDINANCE NO. Z-456-04
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL AMENDING
THE ZONING ORDINANCE NO. Z-289, AS AMENDED, OF THE CITY OF CARMEL AND
CLAY TOWNSHIP, HAMILTON COUNTY, INDIANA.
WHEREAS, the Carmel Plan Commission has recommended approval of the proposed
Rezone Ordinance Z-456-04, filed as Docket No. 04050051Z with the Carmel Plan Commission.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Carmel, Indiana, that Ordinance No. Z-289, as amended, is hereby amended as follows:
Section I: That the Zone Map accompanying and made a part of Zoning Ordinance Z-289,
as amended, is amended to reclassify the following described real estate from the Single Family
Attached Zone (SFA) District to the Multi-Family Housing Zone (MF) District, within the Old
Meridian District Zone.
LEGAL DESCRIPTION:
Part of the Northwest Quarter of the Southeast Quarter of Section 26, Township 18 North, Range
3 East in Hamilton County, Indiana, being more particularly described as follows:
Commencing at the Southwest comer of said Quarter Quarter Section; thence North 88 degrees
44 minutes 05 seconds East along the South line of said Quarter Quarter Section 999.93 feet to
the Southeast comer of land described in Instrument No. 95-54504, recorded in the Office of the
Recorder of Hamilton County, Indiana; thence North 00 degrees 04 minutes 27 seconds West
along the East line of said described land 365.46 feet to the POINT OF BEGINNING; thence
South 89 degrees 55 minutes 34 seconds West 201.48 feet; thence North 00 degrees 10 minutes
07 seconds West 650.00 feet to the North line of said described land; thence North 88 degrees 47
minutes 49 seconds East along said North line 61.97 feet; thence South 01 degrees 12 minutes 11
seconds East 141.56 feet; thence North 89 degrees 55 minutes 33 seconds East 137.82 feet to the
East line of said described land; thence South 00 degrees 04 minutes 27 seconds East along said
East line 509.69 feet to the POINT OF BEGINNING, containing 2.567 acres, more or less.
The above-described real estate is located east and south of the intersection of 131st Street
and Pennsylvania Street within the corporate limits of the City of Carmel, Indiana.
Section II: All prior Ordinances or parts thereof inconsistent with any provision of this
Ordinance are hereby repealed.
Section III: This Ordinance shall be in full force and effect from and after its passage and
signing by the Mayor.
