ORDINANCE NO. Z-451-04
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL,
INDIANA, REZONING DISTRICT CLASSIFICATION
Rezoning property generally located at 10640 North College Avenue from
R-3/Residence District to B-l/Business District
WHEREAS, pursuant to Indiana Code 36--/-4, the Common Council has lawfully
adopted a zoning ordinance, the terms of which are applicable to the geographic area
consisting of the incorporated area of the City of CarmeL, indiana, and the
unincorporated area of Clay Township, HamiLton County, Indiana, which zoning
ordinance has been codified in Chapter 10 of the Carmel City Code; and
WHEREAS, pursuant to indiana Code 36-7-4-602 the Common Council is
authorized to amend the map that is part of the zoning ordinance; and
WHEREAS, the Carmel Plan Commission has favorably recommended the
rezoning of the real property, a description of which is attached hereto as Exhibit A,
and incorporated herein.
NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of
Carmel, indiana, as follows:
Section 1. That the Official Zoning Map accompanying and made part of the
Zoning Ordinance is hereby changed to designate the real property from R-3/
Residence District to B-I/Business District Classification.
Section 2. All prior Ordinances or parts thereof inconsistent with any provision of
this Ordinance are hereby repealed.
Section 3. This Ordinance shall be in full force and effect from and after its
passage and signing by the Mayor.

LEGAL DESCRIPTION
Part of Lot Number Two (2) described as follows: Begin Thirty-five (35) feet South of
the Northeast corner of said Lot Number Two (2), run thence South Seventy (70) feet,
to the Southeast corner of said Lot Number (2), thence West One Hundred Forty-five
and Thirty-five Hundredths (145.35) feet, thence North Seventy (70) feet, thence East
One Hundred Forty-five and Thirty-five Hundredths (145.35) feet to the place of
beginning; all of said real estate being in the Dixie Highway Addition as recorded in
Deed Record book 106 at page 7 in the Office of the Recorder of Hamilton County,
Indiana.
GRANT OF PERMANENT RIGHT-OF-WAY
A part of Lot 2 in Dixie Highway Addition, an addition to the Town of Home Place,
Indiana, the plat of which is recorded in Deed Record 106, page 9, in the Office of the
Recorder of Hamilton County, Indiana, and being that part of the grantor's land lying
within the right-of-way lines depicted on the attached Right-of-Way Parcel Plat marked
as Exhibit "B", described as follows: Beginning at the southeast corner of said lot;
thence South 89 degrees 10 minutes 42 seconds West 6.181 meters (20.28 feet) along
the south line of said lot; thence North 0 degrees 23 minutes 27 seconds East 21.336
meters (70.00 feet) to the north line of the grantor's land at point "889" designated on
said parcel plat; thence North 89 degrees 10 minutes 42 seconds East 6.181 meters
(20.28 feet) along said north line to the northeast corner of the grantor's land and the
east line of said lot; thence South 0 degrees 23 minutes 27 seconds West 21.336
meters (70.00 feet) along said east line to the point of beginning and containing 131.9
square meters (1.420 square feet), more or less.
