ORDINANCE NO. Z-431-03
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL,
INDIANA, REZONING DISTRICT CLASSIFICATION
Rezoning the Lenape Trace Park from the R-4/Residence District Classification to the p-1/Parks
& Recreation District Classification
WHEREAS, pursuant to Indiana Code 36-7-4, the Common Council has lawfully adopted
a zoning ordinance, the terms of which are applicable to the geographie area consisting of the
incorporated area of the City of Carmel, Indiana, and the unincorporated area of Clay Township,
Hamilton County, Indiana, which zoning ordinance has been codified in Chapter 10 of the
Carmel City Code; and
WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to
amend the map that is part of the zoning ordinance; and
WHEREAS, the Carmel/Clay Plan Commission has favorably recommended the rezoning
of the real property, the legal description of which is attached hereto as Exhibit A.
NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of
Cannel, Indiana, as follows:
Section 1. That the Official Zoning Map accompanying and made part of the Zoning
Ordinance is hereby changed to designate the real property from the R-4/Residence District
Classification to the P-I/Parks & Recreation District Classification.
Section 2. All prior Ordinances or parts thereof inconsistent with any provision of this
Ordinance are hereby repealed.
Section 3. This Ordinance shall be in full force and effect from and after its passage and
signing by the Mayor.

A part of the South Half of the Southeast Quarter of Section 12, Township 17 North, Range 3
East, Hamilton County, Indiana, and being a part of the real estate described in Deed Book 330,
pages 631-632, in the Office of the Recorder of Hamilton County, Indiana, and being more
particularly described as follows:
Commencing at the southwest comer of the Southeast Quarter of Section 12, Township 17 North,
Range 3 East, Hamilton County, Indiana, and being more particularly described as follows:
Commencing at the southwest comer of the Southeast Quarter of Section 12, Township 17 North,
Range 3 East, Hamilton County, Indiana; thence South 89 degrees 26 minutes 54 seconds East on
the south tine of said Southeast Quarter a distance of 33.00 feet to as point on the easterly right-
of-way line of the Monon Railroad, said point also being the Point of Beginning of the herein
described real estate; thence continuing South 89 degrees 26 minutes 54 seconds East on said
south line a distance of 870.94 feet to a point on the prolongation of the southwesterly line of
