HomeMy WebLinkAboutZ-113 Define/Condo.Single Dwell AN ORDINANCE k~ENDING THE ZONING ORDINANCE WHICH IS A PART OF THE MASTER PLAN OF THE TOWN OF CARMEL, INDIANA ORDINANCE NO. Z-113 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE TOWN OF CARMEL, INDIANA, ORDINANCE NO. Z-t as AMENDED, PASSED BY THE TOWN BOARD OF TRUSTEES OF THE TOWN OF CARMEL, INDIANA ON THE 21st DAY OF DECEMBER, 1957, UNDER AUTHORITY OF CHAPTER 174 OF THE ACTS OF 1947, AND ALL ACTS, AMENDATORY OR SUPPLEMENTAL THERETO, OF THE GENERAL ASSEMBLY OF THE STATE OF INDIANA. Be it ordained by the Board of Trustees of the Town of Carmel, Indiana that Ordinance No. Z-l, as amended, is hereby amended as follows: SECTION 1. Section 5, "DEFINITIONS" is hereby amended as follows: a. The following definitions shall be added. 1. CONDOMINIUM. One or more structures, each structure having two or more units for occupancy, each structure having common or party wall or walls and wherein provisions have been made for separate ownership of each individual dwelling unit. 2. DETACHED SINGLE FAMILY CLUSTER DWELLING. A structure for single family use, having no common or party wall; and utilizing common open space with other detached single-family cluster dwellings arranged in close proximity to one another and wherein provisions have been made for separate ownership of each individual dwelling unit. SECTION 2. Condominiums and/or Detached Single Family Cluster Dwellings shall conform and be subject to the provisions of Carmel Town Ordinance Z-59 and any amendments thereto as such ~ordinance relates to "Garden Apart~ent Use" and shall, for purposes of the Ordinance, be treated as Garden Apartments, excepting Section 3 of this Ordinance. Provided however: a. That no angular vehicular parking areas shall be permitted in any street in areas containing such residential units. SECTION 3. Condominiums and/or Detached Single Family Cluster Dwellings shall conform to and be subject to the provisions of Carmel Town Ordinance Z-14 and amendments thereto entitled, "An Ordinance amending the Subdivision Control Ordinance, Town of Carmel, Indiana", provided however: a. The definition of "street" in said Ordinance Z-14, for purposes of this Section, shall exclude off-street vehicular parking areas and entrances thereto. b. It shall not be a requirement that the streets of Condominiums and/or Detached Single Family Cluster Dwelling Developments be dedicated to the public. c. That the sidewalk requirements and the right- of-way requirements as set forth in the Subdivision Control Ordinance shall not apply to Condominiums and/or Detached Single Family Cluster Dwelling Developments. d. That the Lot requirements as set forth in Section 4 of Article 4 of the Subdivision Control Ordinance shall not apply to Condominiums and/or Detached Single Family Cluster Dwelling Developments. SECTION 4. This Ordinance shall be in full effect from and after its passage.
