An ordinance amending the Zoning Ordinance of the City of Carmel, Indiana, Ordinance Z-160, passed by the Common CoUncil of the City of Carmel, Indiana, on the 21st day of January, i980. BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana~ under the authority of Acts 1979, Public Law 178, Section 1, et seq and all acts amendatory or supplemental thereto, that Ordinance No. Z-160 is hereby amended as follows: SECTION ONE. Section 23.01-4 is hereby amended by deleting the first sentence therein and substituting therefore the following: The Plan Commission shall approve the development plan for any proposed improvement in the U.S. Highway 31 Overlay Zone excepting additions to existing residential structures which are (1) ~rchitcctura!!y attach~d to the existing residence, (2) follow a similar architectural design, (3) do not exceed forty percent (40%) of the existing structure, and (4) meet the requirements of the underlying zoning~ SECTION TWO. There is added anew section 23.01-16.3 as follows: 23101-16.3 Additions to Existing Residential. Uses and detached structures accessory to Single-Family Dwelling Units are permitted provided that the use and/or structure meets the requirements of the underlying zone district. Additionally, any ~etached structure must (i) be of compatible architectural design with the principle structure; (2) be set back thirty (30) feet from that right-of-way line nearest to and running most parallel with U.S. Highway 3I, and (3) be accompanied by adequate adjacent landscaping. SECTION THREE. Section 23.01-17.1 is hereby amended by adding a new sentence thereto as follows: ~App!~caticn fee.s shall not be required for applications for additions to residential housing required to be reviewed under this section.
