PEAKC~ ~ HOWARD ORDINANCE ~7'- ] ~ ~HEREFORE, it is in the best interest of the City of Carmel, Indiana to amend as hereinafter set out, those sign regulations as heretofore previously ordained by the City of Carmel, Indiana and such signed regulations and ordinances numbered 25.7 through and inclusively 31.1.9, as per referenced of the City of Carmel, Indiana code of said City, such amendments as hereinafter set out having been previously ordained and approved by the City of Carmel and the Mayor of the City of Carmel within the time limits prescribed by the laws and statutes of the State of Indiana and the same now heretofore being set in writing so as to be manageable and legible in legal form for future reference; NOW Tt~REFORE BE IT OPd)AINED as follows: 25.7 SIGNS 25.7.01 GENERAL PROVISIONS 25.7.01-1 PURPOSE A~ND INTENT. The purpose of this section is to regulate signs which can be viewed from the exterior of structures so as to protect health, safety and morals and to promote the public welfare. The intent is to recognize the need for adequate business identification while promoting an attractive appearance throughout the community through use of sensible quality control, through adequate maintenance and inspection, and by reasonable guidelines formulated to minimize clutter. '"This section is designed to authorize signs which are: (1) Designed, constructed, installed and maintained in such a manner that they do not endanger public SMITH, PEARCE ~ HOWARD AI'TOKNEYS AT LAW -2- safety or traffic safety; (2) Comoatible with the objectives of proper design and zon{ng amenities; (3) Allowing and promoting optimum conditions for' meefiing the sign user's needs while at the same time pro- moting the amenable environment required to serve the public welfare; (4) Legible, readable and visible in the circumstances in which they are used; and (5) Respectful of the reasonable rights of other advertisers whose messages are displayed. 25.7.01-2 GENERAL SIGN STANDARDS BY ZONES. The following sign standards by districts are intended to include every zone in the City of Carmel and Clay Township. The zones are as defined by the zoning ordinance and official zone map. Only signs as described herein and as may be described under temporary signs and exceptions will be permitted in each particular zone. 25.7.0.-3 EXE>~PTED SIGNS. The following types of signs are exempted from all provisions of this section, but must be established and maintained in such a manner as to not cause safety hazards. No procedures, approvals, permits or fees are required for the following signs: a. Dwelling Unit Signs b. Holiday Signs c. Integral Signs d. Parking Signs e. Soft Drink Dispensing MachineS 1. Public Building Signs m. Temporary Awning Signs 25.7.01-4 PROHIBITED SIGNS. The following types of signs are prohibited. mo Signs which contain statements, words, or pictures of an obscene, indecent, or immoral character, such as will offend public morals or decency. Signs which contain or are in imitation of an official traffic sign or signal or contain the words "stop", "go slow", "caution", "danger", "warning" or similar words, unless permitted in another section of this ordinance. Signs which are of a size, location, movement, content, coloring, or manner of illumination which may be con- fused with or construed as a traffic or street sign or signal. Signs which advertise an activity, business, product or service no longer conducted on the premise upon which the sign is located. e. Signs which move by design or have a major moving part. f. Signs consiSting of banners, posters, pennants, ribbons, streamers, strings o~f~-~-~ bulbs, spinners or similar devices, unless they are permitted specifically by other sections. SMITH, PI~ARCE ~ HOWARD -4- ho 25.7 Signs which swing or otherwise noticeably move as a result of wind pressure because of the manner of their suspension or attachment and whose movement can be construed as dangerous by the Administrator. Signs which are located in such a manner as to obstruct the view of the intersection of a street or highway with a railroad crossing. Signs which are located upon, over, or in any street or highway right~of-way, except for official highway signs. Signs which are portable or moveable, except as permitted under provisions of this section. Signs which are established on trees. Signs which advertise goods, products, services or facilities or directs persons to a different location from where the sign is installed; (Off- premise signs require a variance from the Board of Zoning Appeals). Suspended signs and projecting signs, except in Old Towne Carmel Signs which are not included under the types of permitted in this Ordinance. · 02 DEFINITIONS. Definitions contained herein signs are terms not already defined in the Carmel Zoning Ordinance and/or the Subdivision Ordinance. All terms underlined in this chapter are defined within this zoning ordinance. In case of a difference in definition of a term, the definition given here will be the one of authority in dealing with Chapter 25.7. ADMINISTRATOR The Administrator of this ordinance shall be the Carmel Building Commissioner. The Administrator is hereby authorized and directed to enforce and carry out all the provisions of this SMITH, PEAl[CE ~ HOWAP, D ATTORNEYS AT LAW -8- non-commercial nature, clearly incidental and customary and commonly associated with any national, state, local or religious holiday. HOUSING PROJECT Subdivision, multiple-family housing complex, mobile home park. (Permanent signs identifying housing projects must obtain Plan Connnission approval. IDENTIFICATION SIGN A sign which is limited to the name, address, and/or number of a building, institution or person; to the activity carried on in the building or institution; the occupancy of the person; and/ or the logo representing the building, business or institution. A logo,if desired on a sign in a unified center, is limited to twenty-five percent (25%) of the sign area. ILLUMINATION Illumination shall be white and not colored light and shall not be blinking, fluctuating or moving. Light rays shall shine only upon the sign or upon the property within the premises and shall not spill over the property lines in any direction, except by indirect reflection. INTEGRAL SIGN Name of building, date of erection, monumental citation, commemorative tablet and the like when carved into stone, concrete or similar material or made of broze, aluminum, or other per- manent type construction and made an integral part of the structure SMITH, PEARCE ~ HOWARD -9- INSTITUTION A non-profit organization established for public, charitable, educational or religious purposes such as, church, college or university, hospital, school. INSTITUTIONAL SIGN Any sign setting forth the name of any public, charitable, educational or religious institution, located entirely within the premises of that institution. LANDSCAPING To make a plot of ground more attractive by adding plantings other than grass. LOGO The official emblem or insignia of an organization, corp- oration or institution. MULTI-TENANT BUILDING (Horizontal Space) An office or commercial building, occupied by two or more businesses, which cannot be classified as a Multi-Tenant Building (Vertical Space). MULTI-TENANT BUILDING (Vertical Space) An office or commercial building, occupied by two or more businesses in which every business occupies space on the grotmd floor and every floor existing above. NAMEPLATE A non-electrical wall sign identifying only the name and occupation or profession of the occupant of the or the premises SMITH, PEARCE & HOWARD ATTOI~NEY$ AT lAW -10- on which the sign is locatedi If any premises include more than one occupant, refers to all names and occupations or professions as well as the name of the building and directional information. NON-CONFORMING SIGN (LEGAL) Any sign which was lawfully established and maintained prior to such time as came within or under the terms of this Code or a prior code, any amendment thereto, and which fails to conform to all applicable regulations and restrictions of this section, or a non-conforming sign for which a special permit has been issued. (See Section 25.7.05) PARAPET A low, flat wall, extending around the perimeter of a build- ing, at the edge of a roof or balcony. PARKING SIGN Any sign used to designate parking areas or spaces for public or private use. Signs identifying parking areas shall be used solely for identification purposes, with only one identification sign per property frontage, including alleys for the purpose of this definition only, permitted. Signage used to indicate the reservation of a parking space for a specific person is permitted but, copy shall be limited to the name or title of the person for whom the space is reserved. (See Section 25.7.01-3 Exempted Signs.) POLITICAL CAMPAIGN SIGN Any sign having reference to a candidate for elective public SMITH, PEARCR & HOWARD -11- office or a public question or issue to be submitted to the voters at a general, special or primary election. PORTABLE SIGN A sign not permanently anchored or secured no either a building or the ground. TRAFFIC DIRECTIONAL SIGN Sign directing traffic movemenn onto and/or within a premise, not exceeding three (3) square feet in sign area for any one (1) sign; and shall not be higher than three (3) feet above ground level. Said sign shall display no advertising. Standard traffic directional signs, such as "STOP" and "YIELD" signs, may comply with the Uniform Manual on Traffic Control Devices. PROJECTING SIGN A sign attached to and supported by a building and which extends out at any angle therefrom. This type of sign shall be permitted in Old Towne Carmel only and shall be limited to twenty (20) square feet maximum si~n area. PROPERTY FRONTAGE The length of the property line of any one premises parallel to and along a public or private street. PUBLIC EVENT SI~ A temporary sign announcing a function of public interest. This does not include "SALE" signs. PUBLIC SIGN Official notices posted by public officers or employees in SMITH, P~:AP, C~ & HO~VARD -12- the performance of their duties. RE~L ESTATE SIGN Any sign advertising the sale, rental or lease of the premises or part of the premises on which the sign is located. RECREATIONAL USES This term includes country club, golf course, park or recreational facility. ROOF CROWN This shall mean either the highest edge of the roof of the top of the parapet, whichever forms the top line of the building shihouette. Where a building has several roof levels, this roof or parapet shall be the one belonging to that portion of the building on whose wall the sign is located. ROOF LINE Cutter line. ROOF SIGN A sign established and maintained upon the roof of a building which is located between the roof line and the roof crown. SET BACK _The measured distance between a sign structure and the right-of-way. SIGN Any identification, description, illustration or device illuminated or non-illuminated which is visible from any public SMITH, PI~AKCB ~ HOWAKD -13- place or is located on private property and exposed to the public and is designed to attract attention, and which directs people to a business including any permanently installed or situated sign designed to advertise, identify or convey informa- tion, with the exception of window displays and the American Flag. For the purpose of removal, signs shall also include all sign s t ructures. SIGN AREA The area of a sign shall be calculated by multiplying its maximum vertical dimension by its maximum horizontal dimension, excluding the supporting structure. SIGN FACE The part of the sign area that is intended primarily for or can be utilized for communication purposes. SIGN PERMIT A permit signed by the Administrator stating that a proposed sign has met with the general provisions of this ordinance. SIGN STRUCTURE Any structure which supports, has supported or is capable of supporting sign, including decorative cover and planter boxes. SINGLE-TENANT BUILDING An office or commercial building in which all space is occupied by one tenant. SUSPENDED SIGN A ground sign suspended from and installed on an arm or spar SMITH, PEARCE & HOWARD AT~OKNEYS AT LAW -14- attached to one (1) upright, decorative pole. The pole and arm and/or spar are limited to a' maximum 16 square inch cross- sectional area. No display or advertising sign shall be attached to the standard of a suspended sign other than the display surface originally constructed as a part of such sign. (Twelve (12) squar~ feet maximum sign area). This type of sign shall be permitted only in Old Towne Carmel. UNIFIED CENTER A grouping of businesses or buildings designed to function as a unit. VEHICLE SIGN A sign on a vehicle of any kind, provided the sign is painted or attached directly to the body of the original vehicle and does not project or extend beyond two (2) inches from the original manufactured body proper of the vehicle. The vehicle to which the sign is attached shall be in proper working order and shall bear a current license plate and shall not be permanently parked on a public stregt or right of way. WALL SIGN A sign established on the wall of a building with the face in a parallel plane to the plane of the building wall, and which projects from that surface less than twelve (12) inches at all points. Said sign shall not extend beyond the edges of the wall upon which it is mounted nor above the roof line. Permanent awnings attached to the building shall be considered a part of SMITH. This section applies to all zones designated by the zoning ordinance as S-l, S-2, R-i, R-2, R-3, R-4, R-5 or any subsequently created residential zone. 25.7.03-1 RESIDENTIAL USES. a. Housing Project Permanent Signs. i) SIGN CLASSIFICATION: ground sign. ii) NUMBER & TYPE: One sign per entrance; matching signs which border either side of one entrance into a housing project shall be treated as one sign; however, both sign £aces shall be used to calculate the sign area. iii) MAXIMUM SIGN AREA: fifty (50) square feet per sign face. iv) MAXIMUM HEIGHT OF GROUND SIGN: as approved. SMITH, PEARCE & HOWAKD -16- v) LOCATION: at entrance to housing project; sign shall not interfere with vision clearance. vi) COLOR & DESIGN: as approved. vii) COPY: as approved. viii) ILLUMINATION: as approved. ix) LANDSCAPING: optional. x) REQUIRED APPROVAL: must be approved by the Commission, and sign may be established any time after housing project final plans are approved. xi) SIGN PERMIT: required. xii) FEES: required. b. Home Occupation and Boarding House. i) SIGN CLASSIFICATION: wall sign. ii) NUMBER & TYPE: one nameplate. iii) MAXIMUM SIGN AREA: three square feet. iv) MAXIMUM HEIGHT OF GROUND SIGN: not applicable. v) LOCATION: as per definition of wall sign. vi) COLOR & DESIGN: must be compatible with the architectural design and coloring of the structure to which the sign is attached. vii) COPY: as per definition of nameplate. viii) ILLUMINATION: not permitted. ix) LANDSCAPING: not required. x) REQUIRED APPROVALS: all permanent signs requiring a permit that are established in the R-5 zone or the U. S. 31 Highway Overlay Zone require Plan Commission approval. xi) SIGN PERMIT: required. xii) FEES: required. 25.7.03-2 NON-RESIDENTIAL USES. SMITH, PI~AKCE ~ HOWARD A'frORNEY$ AT -17- a. Institutional Uses. i.) SIGN CLASSIFICATION: wall sign or ground sign. ii.) NUMBER & TYPE: one identification sign and one changeable copy sign iii.) MAXIMUM SIGN AREA: identification sign--thirty (30) square feet; changeable copy sign--sixteen (16) square feet. iv.) MAXIMUM HEIGHT OF GROUND SIGN: five (5) feet. v.) LOCATION: no sign shall be located closer than ten (10) feet to the right-of-way. vi. ) COLOR & DESIGN: must be compatible with the architectural design and cOloring of the structure which the sign identifies. vii.) COPY: as per definitions of identification sign an-K'd--changeable copy sign. viii.) FEES: required. 25.7.03-3 TEMPORARY SIGNS. Temporary sign permits can be issued for no more unless than one year's duration, but may be otherwise prohibited. The temporary sign must be removed when the permanent housing project sign is established. Non-Residential Construction Signs. SIGN CLASSIFICATION: ground sign. NUMBER & TYPE: one sign per property frontage. MAXIMUM SIGN AREA: thirty-two (32) square feet. MAXIMUM HEIGHT OF GROUND SIGN: eight (8) feet. LOCATION: shall be set back twenty (20) feet from the street right-of-way ; only one sign may face any particular property frontage. COLOR & DESIGN: no restrictions. COPY: limited to identification of the building, ar--~-6~itects, engineers, contractors, and other individuals or firms involved with the construction but shall not include any advertising or product. ILLUMINATION: not permitted. LANDSCAPING: not required. REQUIRED APPROVAL: none_ SIGN PERMIT: required. See Section 25.7,03-3. FEES: required. TIME: shall not be established until after cons- truction has begun; shall be removed within seven (7) days after the beginning of the intended use of the project. SMITH, PEARCE & HOWARD -20- c. LOCATION: signs of six square feet or less--ten (10) feet from the right-of-way; over six (6) square feet--twentY-five (25) feet from the right-of-way. vi.) COLOR & DESIGN: no restrictions. vii.) COPY: may announce the sale, rental or lease of the premises but she reflect no advertising or promotional material other than to indicate the party listing the property for sale or lease. viii.) ILLUMINATION: not permitted. ix.) LANDSCAPING: not required. x.) REQUIRED APPROVAL: none. xi. ) SIGN PERMIT: required for signs with a sign area over six (6) square feet. See Section 25.7, 03-3. xii.) FEES: required for signs with a sign area over six (6) square feet. xiii.) TIME: signs shall be removed promptly after closing, lease or rental of the property. An "OPEN HOUSE" sign may be posted only when an open hou~ is being conducted on the premises, unless the sign lists the dates and times of a future open house. d. Political Campaign Signs. i.) This section applies to all zones designated by the zoning ordinance as B-i, B-2, B-3, B-4, B-5, B-6, B-7, I-l, I-2, or any subsequently created business or industrial zone. 25.7.04-1 COMFRgRCIAL USES. a. Single-Tenant Building. i.) SIGN CLASSIFICATION: ground sign, wall sign or roof sign. ii.) NUMBER & TYPE: one identification sign per business. Building on double-frontage lots are permitted one identification sign per each property frontage; only one sign may face on any particular property frontage. iii.) MAXIMUM SIGN AREA: per Chart in Section d. iv.) MAXIMUM HEIGHT OF GROUND SIGN: per chart in Section d. v.) Said Commercial uses,in addition to utilizing the signage requirements in Section 25.7.04-1, items a. through d. or item f., may also utilize the signage re- quirements listed in this Section 25.7.04-1, item e. i.) SIGN CLASSIFICATION: window sign. ii.) NUMBER & TYPE: one identification sign per property frontage. iii.) Should any questions arise as a result of the Administrator's decision that a sign is a legal non.conforming use or is illegal, the final determination of such status shall be made by the BZA as provided for in Section 28.6 of this Ordinance. An on going record of existing legal non-conforming signs shall thereafter be maintained as a part of the BZA's permanent records. A legal non-conforming sign shall immediately lose its legal non.-conforming designation if: (1) the sign is not kept in good repair and in a safe condition; (2) the sign is demolished by any force whatsoever to the extent of seventy (70%) percent of its use. (3) the sign is altered in any way in structure or copy (except for changeable copy signs and normal maintenance which tends to or makes th~ sign lesS in compliance with the requirements of this ordinance than it was before the alteration. (4) the sign is relocated to a position making it less in compliance with the requirements of this ordinance; (5) (6) (7) the sign is rePlaced; the fee ownership of the property upon which the sign is located has been changed, on the happening of any one (1), (2), (3), (4), or (6) the sign shall be immediately brought into compliance with this ordinance with a new permit secured therefore, or shall be removed. BOX 410 -37- the le.gal non-conforming sign is located from the provisions of this ordinance regarding safety, maintenance and repair of signs, provided, however, that any repainting, cleaning and other normal maintenance or repair of the sign or sign structure shall not modify the sign structure or copy in any way which makes it more non-conforming or the sign may lose its _legal non-conforming status. 25.7.06 SIGN PERMITS. Except as Otherwise provided in this ordinance, it shall be unlawful for any person to establish any sign within the jurisdictional area of this ordinance, or cause the same to be done, without first obtaining a sign permit for each such sign from the Administrator as required by this ordinance. These directives shall not be construed to require any permit for a change of copy on a legal changeable copy sign, nor for the repainting, cleaning and other normal maintenance or repair of a sign or sign structure for which a permit has previously been issued, so long as the sign or sign structure is not modified in any way. No permit is required for signs which are exempted from permits elsewhere in this ordinance. No new permit is required for signs which have permits and which conform with the requirements of this ordinance on the date of its adoption unless and until the sign is altered or relocated. A Permit must be secured when the fee ownership of the property upon which the sign is located has been changed, or when the gound upon which the sign is situated has been leased to a new lessee. SMITH. pEAKCE & HOWARD -38- Every si~n permit issued by the Administrator shall become null and void if the sign is not established within six months after the issuance of such permit. Signs which require approval by the Commission must be established within (2) years after the date such approval is granted, or such approval shall become null and void. Signs which require variance approval from the Board shall be established within one (1) year. (See Ordinance z-170). No person shall establish any sign upon any property or building without the consent of the owner or person entitled to possession of the property or building if any, or their authorized representative. Application for a permit shall be made to the Administrator upon a form provided by the Administrator and shall be accompaniec by such information as may be required to assure compliance with all appropriate laws and regulations of the City including: (1) Name and address of the owner of the sign. (2) Name and address of the owner (fee owner) of the premises where the sign is to be located. (3) Name and address of the person leasing the premises (if applicable). (4) Clear and legible drawings with description definitely showing location of the sign which is the subject of the permit and all other existing signs whose construction requires permits, when such signs are on the same premises. (5) Drawings showing the dimensions, construction supports, sizes, electrical wiring and comoonents, materials, color, and design of the sign an~ method of attachment. Such assurance shall specify a time limit in which such compliance with the ordinance is to be accomplished.
