PZ-2021-00160 CA Commitment Amendment for C2 Rezone Z-611-16 DATE: December 10, 2021 Please find information on the following item, a proposal to amend the Commitments from Z-611-16, approved by Carmel City Council in March 2016. Commitment Amendment to West Main Street C-2 Rezone The City is seeking to amend the Commitments which accompany the C-2 Rezone ordinance Z-611-16, for the one block area in the Carmel Arts & Design District, generally bound by West Main Street, 4th Avenue SW, 1st Street SW and 3rd Ave SW, comprising 6 lots in the R-2/Residence District, within the Old Town District Overlay Zone and C2 Mixed Use District. The properties are identified by the following addresses: 311, 321, 331 West Main Street; 320 1st Street SW; and 20 3rd Avenue SW and 0 3rd Avenue SW. Main Street Monon Blvd. 331 321 311 320 20 0 4th Ave. SW 3rd Ave. SW 1st Street SW Summary: The Commitment Amendment proposal is to terminate the Z-611-16 Commitments - which may occur pursuant to a decision of the Carmel Plan Commission made at a public hearing after proper notice has been given - as delegated to the Plan Commission by City Council in 2016. The request to terminate the Commitments will allow completion of the 2016 C-2 Mixed Use District Rezone for the identified lots by extending the C-2 Mixed Use District over the entire block. This action will further position the property to be consistent with the City’s plan; allow for coordinated redevelopment of the block and facilitate mixed-use development over time. The Plan Commission and City Council spent several months in 2015 and 2016 reviewing this rezone proposal. There was a wide range of discussion, including the exploration of other potential zoning district options, splitting the blocks, and potential building scenarios. Ultimately, it was determined that the C-2 District was the best long-term solution because it allows for both single family residential and a long-term mixed use and walkable vision. While impossible to address all concerns, several commitments were proposed to address many of the concerns, which are illustrated in the map below. Commitments were drafted for each property to address several issues that are either not covered or would be more restrictive than the C-2 District, including: • Maximum Building Heights • Permitted Uses • Landscaping – Parking Screening, Foundation Plantings • Mechanical Screening and Dumpster Locations • Architecture and Phasing Copies of the property specific Commitments are found at the end of this report ZONING MAP PUD R-1 Residential C2 Mixed Use OLD TOWN OVERLAY ZONE BOUNDARY MAP SITE SITE Since adoption of this rezone there has been considerable change to the area which reduce the uncertainty that existed at the time and which help to minimize the need to commitments, including: • completion of Monon Boulevard • approval and construction of Monon & Main Redevelopment, with a 4-story 35,000 sq. ft. mixed use building; 14,000 sq. ft. restaurant building, 7 townhouses and a three-level - 200 space parking garage. • UDO Amendments adopted to C-2 Mixed-use District, including landscaping and transition provisions The Department believes the termination of the commitments is in the best interest of the community to facilitate a mixed-use development plan within the Arts and Design District. CONCEPT PLAN FOR AREA From 2012 Midtown Plan Recommendation: The Department of Community Services recommends the Plan Commission vote to suspend the Rules of Procedure and vote to terminate the Z-611-16 Commitments for the identified lots. EXHIBIT: (Ardalan) STATEMENT OF COMMITMENTS COMMITMENTS CONCERNING THE USE OR DEVELOPMENT OF REAL ESTATE MADE IN CONNECTION WITH A REZONING OF PROPERTY In accordance with I.C. 36-7-4-1015, the owners of the real estate located in Hamilton County, Indiana, which is described below, make the following COMMITMENTS concerning the use and development of the Real Estate: Tax Parcel ID: 16-09-25-16-01-002.000 0.24 acres 16-09-25-16-01-003.001 0.09 acres Addresses: 321 W. Main Street, 0 W. Main Street Docket No.: 15030009 Z Council Ordinance: Z-611-16 Statement of COMMITMENTS: 1. Maximum Building Height: a. Main Street: 45’ 2. The design and construction of new buildings on parcels with frontage on Main Street shall be per the Old Town Overlay Zone District Guidelines in 23D.03.03.B, Main Street District Sub-Area. 3. The design and construction of a new Principal Building on the Real Estate shall allow access from Tax Parcel 16-09-25-16-01-003.001 (via Third Avenue SW) only, and further commits to full closure and removal of the Main Street driveway at 321 W Main Street (Tax Parcel 16-09-25-16-01-002.000). 4. Dumpster Location: Commercial trash storage and removal shall be internal to the site and not visible from a public street. Removal shall not occur from a public street. 5. Phasing: Development proposed on a parcel adjacent to one or more existing homes in the same block shall be part of an overall master development plan for the entire block. These COMMITMENTS shall be binding on the owners, subsequent owners of the Real Estate and other persons acquiring an interest therein. These COMMITMENTS may be modified or terminated by a decision of the Carmel Plan Commission made at a public hearing after proper notice has been given. COMMITMENTS contained in this instrument shall be effective upo n the adoption of Ordinance Z-611-16 by the Carmel Common Council changing the zoning classification of the Real Estate from the R-2/Residence District zoning classification to the C-2/Old Town District zoning classification. These COMMITMENTS may be enforced by the Carmel Department of Community Services or the Carmel Plan Commission. The undersigned hereby authorizes the Secretary of the Carmel Plan Commission to record these Commitments in the office of the Recorder of Hamilton County, Indiana, upon fina l approval of Ordinance Z-611-16. EXHIBIT: (Birden) STATEMENT OF COMMITMENTS COMMITMENTS CONCERNING THE USE OR DEVELOPMENT OF REAL ESTATE MADE IN CONNECTION WITH A REZONING OF PROPERTY In accordance with I.C. 36-7-4-1015, the owners of the real estate located in Hamilton County, Indiana, which is described below, make the following COMMITMENTS concerning the use and development of the Real Estate: Tax Parcel ID: 16-09-25-16-01-019.000 0.20 acres Addresses: 20 3rd Avenue SW Docket No.: 15030009 Z Council Ordinance: Z-611-16 Statement of COMMITMENTS: 1. Permitted Uses: Residential Uses and Parking 2. Landscaping: a. All surface or structured parking located along 1st Street SW shall be screened so that headlights are not visible from across the street. Screening may include any combination of plantings, walls or other opaque materials. The minimum planting area shall be at least six (6) feet in width and include four (4) shade trees and (20) twenty shrubs per 100 linear feet. b. Foundation plantings shall be required along any occupiable building facade within twenty (20) feet of 1st Street SW. Planting beds shall be at least five (5) feet in width, with exceptions for pedestrian access to building entrances. The primary landscaping materials used shall be shrubs, ornamental grasses and ground cover. Plantings shall cover 75% of the planting area. 3. Dumpster Location: Commercial trash storage and removal shall be internal to the site and not visible from a public street. Removal shall not occur from a public street. 4.
