WHERFAS, it is necessary for the City of Carmel to widen Rangeline
Road and to appropriate right-of-way needed therefor; and
~HEREAS, the City of Carmel has been and will be acquiring inter-
ests in real estate for that purpose; and
WHEREAS, it is not the intention of the City of Carmel by its
acquisition of such interests or by its widening of Rangellne Road to
cause the use of any real estate, and any buildings, structures or
appurtenances thereon to come into violation of the planning and
zoning ordinances of the City of Carmel~
IT IS THEREFORE ORDAINED by the Common Council of the City of
Carmel as follows~
In connection with any acquisition by the City of Carmel in 1978
through 1981 of any interest in land for the purpose of widening
Rangeline Road~
1. It shall not be a violation, and no proceeding shall be
brought charging a violation, of the planning and zoning ordinances
of the City of Carmel whenever any presently existing and conforming
uses of such land or such uses of any existing buildings, structures
and appurtenances on such land come into Doncompliance with such
ordinances solely because of such acquisition, except that this
provision does not permit any encroachment upon the property or
right-of-way so acquired.
2. In addition, whenever such acquisition causes the owner of
such land to remove therefrom any existing and conforming sign, the
owner shall be permitted to relocate the same elsewhere upon such
land. Such relocation shall be done by June 30, 1982 and in compliance
with the planning and zoning ordinances of the City of Carmel to the
extent possible. An application for the appropriate permit, includ-
ing a site plan showing the proposed new location, shall be made to
the Building Commissioner and become a part of official City records,
but no fees shall be charged to said owner for the permit° If such
relocation cannot be done in compliance with such ordinance, then any
violation resulting solely from such relocation is hereby waived,
and the Building Commissioner may determine the most appropriate
relocation site and issue the necessary permit.
3. In the event that any owner of such land desires to replace
an existing sign caused to be removed by the acquisition of any in-
terest in such land with a new sign which is smaller than the one
being removed, and should said new smaller sign still require a
Board of Zoning Appeals variance because of any conditions of the
Sign Ordinance then in effect, no fees shall be charged for either
the variance or the sign permit if said owner applies for the vari-
ance prior to June 30, 1982. However, any owner who desires to re-
place an existing sign with a larger sign at a new location shall be
charged for any required BZA variance as well as for sign permit fees.
