SIGN ORDINANCE

WHEREFORE, it is in the best interest of the City of Carmel, Indiana to amend
and restate, as hereinafter set out, those sign regulations as heretofore previously ordained by the
City of Carmel, Indiana and such signed regulations and ordinances numbered 25.7 through and
inclusively 31.1.9, as referenced in the Code of the'City of Carmel, Indiana; such amendment and
restatement as hereinafter set out having been ordained and approved by the City of Carmel and
the Mayor of the City of Carmel within the time limits prescribed by the laws and statt[es of the
State of Indiana and the same now heretofore being set in writing so as to be manageable and
legible in legal form for future reference; NOW THEREFORE BE IT ORDAINED as follows:
25.7 SIGNS
25.7.01
GENERAL PROVISIONS
25.7.01-1 PURPOSE AND INTENT. The purpose of this section is to regulate signs
which can be viewed from the exterior of structures so as to protect health, safety and morals and
to promote the public welfare. The intent is to recognize the need for adequate business
identification to conduct business while promoting an attractive appearance throughout the
community through the use of inspection, and by the application of reasonable guidelines
formulated to ensure compliance by ail present and furore signs with the ordinance. This
ordinance is designed to authorize signs which are:
Designed, constructed, installed and maintained in such a manner
that they do not endanger public safety or traffic safety;
Compatible with the objectives of proper design and zoning amenities;
Established in such a way as to allow and promote optimum conditions for
meeting the sign user's needs while at the same time promote the amenable
environment required to serve the public welfare;
Legible, readable and visible in the circumstances in which they are used; and
e. Respectful of the reasonable rights of other advertisers whose messages are
displayed.
25.7.01-2 DEFINITIONS. Definifi~)ns contained herein are terms not already defined.
in the Cannel Zoning Ordinance and/or the Subdivision Ordinance. All terms underlined in this
chapter are defined within this sign ordinance. The word "sign" as used herein shall have the
meaning set forth below although it is not underlined. In case of a difference in definition of a
term, the definition given here will be the one of authority in dealing with Chapter 25.7.
ADMINISTRATOR
The Administrator of this Ordinance shall be the Carmel Director of Community
Development. The Administrator is hereby authorized and directed to enforce and carry out all
the provisions of this section, both in letter and spirit and is further empowered to delegate the
duties and powers granted to and imposed upon him under this Ordinance. As used in this
section, '*Administrator" shall include his authorized representative(s).
AWNING, PERMANENT
A permanent shelter supported entirely from the exterior wall of a building and composed
of rigid or non-rigid m~terials. (See definition of wall sign).
AWNING, TEM~PORARY
A temporary shelter, erected and in place for less than six (6) months of any given year,
supported entirely from the exterior wall of a building and composed of non-rigid materials
except for the supporting framework. One identification sign per business, with a sign area no
greater than ten (10) square feet, may be established on a ~. (See Section
25.7.01-3 Exempted Signs).
BANNER
A temporary sign composed of lightweight material either enclosed or not enclosed in a
rigid frame, secured or mounted so as to allow movement of the sign caused by movement of the
atmosphere.
BUILDING FRONTAGE .
The linear length of the primary frontage of the building or segment thereof facing the
street on which the sign shall be established. (Applies to ground floor only).
CENTER IDENTIFICATION GROUND SIGN
Applicable only in a multi-tenant building complex. Copy is limited to the name and/or
address of the multi-tenant building complex plus permitted changeable copy.
CHANGEABLE COPY
Characters, letters or illustrations that can be changed or rearranged non-electrically or
non-electronically without altering the face or surface of the sign.
COMMERCIAL USES
This term includes cemetery, clinic or medical health center, general commercial uses,
general industrial uses, day nursery, commercial greenhouse, helicopter/airplane facilities,
commercial kennel, kindergarten, farm, mineral extractions, nursing/retirement/convalescent
center, plant nursery, raising non-farm animals/fowl, riding stable.
COPY '
The wording on a sign surface either in permanent or removable letter form.
COPY AREA
The area in square feet of the smallest geometric figure(s) which describes the portion of
the sign which encloses the actual copy of the sign.
DIRECTORY SIGN
A sign identifying the names and locations of the occupants of a building. A directory
sign may utilize ~. For the purpose of this Ordinance a directory si~n is not
counted as a ground sign even if it is supported from the ground.
DWELLING UNIT SIGN
A nameplate with a sign area not exceeding one (1) square foot.
ESTABLISH
This term shall mean attach, alter, construct, paint, or move.
FREEWAY
State Road 431', U.S. Hwy. 421, U.S. Hwy. 31 and Interstate 465.
GROUND SIGN
A sign supported by one or more uprights or braces placed in the ground, not attached
to any building or structure. No display or advertising sign shall be attached to the standard of
a ground sign other than the display surface originally constructed as a part of such sign.
HEIGHT OF GKOUND SIGN
The vertical distance measured from the ground level upon which the sign is established
to the highest point of the ~-
HOLIDAY SIGNS
Temporary signs or displays of a primarily decorative and non-commercial nature, clearly
incidental and customary and commonly associated with any national, state, local or religious
holiday.
IDENTIFICATION SIGN
A sign which is limited tO the name and/or address of a building, institution or person;
to the activity carried on in the building or institution; the occupation of the person; and/or the
logo. A log0, if desired, representing the building, business or institution on a sign in a unified
center is limited to twenty-five percent (25%) of the si_ma area.
ILLUMINATION
Artificial light which shall not be blinking, fluctuating or moving. Light rays shall shine
only upon the property within the premises and shall not spill over the property lines in any
direction, except by indirect reflection.
INTEGRAL SIGN
A sign which is limited to the name of the building, the date of erection, a historical
marker and/or a commemorative building tablet such as a cornerstone, when carved into stone,
concrete or similar material or made of bronze, aluminum, or other permanent type construction
and made. part of the structure. Integral signs, are not intended to be used as a means or
promotion, advertising or identification other than as outlined above.
INSTITUTION
A non-profit organization created for public, charitable, educational or religious purposes
such as, church, college or university, hospital, school.
INSTITUTIONAL SIGN
Any sign setting forth the name of any public, charitable, educational or religious
institution, located entirely within the premises of that institution.

LANDSCAPE
To make a plot of ground more attractive by adding plantings other than grass and which
may include mounding per this Ordinance.
LEGAL NON-CONFORMING SIGN
Any sign which was lawfully established (has received a sign permit) and maintained prior
to such time as it came within or under the terms of this Code, November 5, 1981 or the prior
Sign Code, May 23, 1973 and any amendment thereto, and which fails to conform to all
applicable regulations and restrictions of this Ordinance, or a non-conforming sign for which a
variance has been granted by the Board and for which a ~ has been issued. (See Section
25.7.08).
LOGO
The official emblem or insignia of an organization, corporation or institution.
MOLrNDYNG
For the purpose of sign placement slopes whose ratio are in excess of 1 (vertical): 10
(horizontal) 1:10 (10%) slopes require approval by the Commission per architectural design,
lighting and signage review. Approval of mounding must be a part of the overall site landscaping
plan.
MULTI-FAMILY HOUSING CO1VfPLEX
A building(s) for residential purposes with three (3) or more dwelling units, having
common or party walls, on a single lot.
MULTI-TENANT MULTI-LEVEL BUILDING
An office or commercial building, occupied bY two (2) or more businesses, which cannot
be classified as a multi-tenant ground floor building.
MULTI-TENANT GROUND FLOOR BLrlI,DING
An office or commercial building, occupied by two (2) or more businesses in which every
business occupies space on the ground floor and every floor existing above.
MULTI-TENANT BUILDING COIVIPLEX
Two (2) or more buildings designed to function as a unit or one (1) building w/th seven
(7) or more tenants.
MULTI-TENANT BUILDING COMPLEX DIRECTORY SIGN
A directory si~n in a multi-tenant building complex only if approved by the Commission
when presented as part of a total sign package (B-4, B-7, B-8, M-3 and U.S. 31 Overlay Zone).
Copy. is limited to the names and/or locations of the bu/Idings in the multi-tenant building
complex. Said sign shall have a maximum sign area of twenty (20) square feet and a maximum
height of five (5) feet.
NAMEPLATE
A non-electrical wall sign identifying only the name and occupation or profession of the
occupant of the premises on which the sign is located. If any premises include more than one
occupant, refers to all names and occupations or professions as well as the name of the building
and directional information.
OLD TOWN CARMEL
See Map on Page M-1.
PARKING SIGN
Any sign used to designate parking areas of spaces for public or 'private use. Signs
identifying parking areas shall be used solely for identification purposes, with only one parking
sign per property frontage, including alleys for the purpose of this definition only, permitted.
Signage used to indicate the reservation of a parking space for a specific person is permitted but,
copy shall be limited to the name or title of the person for whom the space is reserved. (See Sec.
25.7.01-3 Exempted Signs).
POLITICAL CAM~PAIGN SIGN
Any sign having reference to a candidate for elective public office or a public question
or issue to be submitted to the voters au 'a general, special or primary election.
PORCH SIGN
A sign attached to a porch or overhang. A maximum sign area of six (6) square feet
This type of sign shall be permitted only in Old Town Carmel.
PORTABLE SIGN
A sign not permanently anchored or secured to either a building or the ground.

PROJECTING SIGN
A sign attached to and supported by a building and which extends out at any angle
therefrom. This type of sign shall be permitted in Old Town Cannel only and shall be limited
to twent~ (20) square feet maximum sign area
PROPERTY FRONTAGE
The length of properly line of any one premises parallel to and along one (1) public
and/or one (1) private street.
PUBLIC EVENT SIGN
A temporary sign announcing function of public interest. This does not include SALE
signs.
PUBLIC SIGN
Official notices posted by public officers or employees in the performance of their duties.
REAL ESTATE SIGN
Any sign advertising the sale, rental or lease of the premises or part of the premises on
which the sign is located.
RECREATIONAL USES
This term includes counter club, golf course, park or recreational facility.
ROOF CROWN
Cutter line
ROOF SIGN
A sign established and maintained upon the roof of a building which is located between
the roof line and the roof crown. Roof signs are prohibited on residences which have been
converted to office, business and/or manufacturing uses.
SET BACK
The measured distance between a ~ and the street right-of-way.
SIGN
Any structure, fixture, placard, announcement, declaration, device, demonstration or
insignia used for direction, information, identification or to advertise or promote any business,
product, goods, activity, services or any interests.
SIGN AREA
The area of a sign shall be calculated by multiplying its maximum vertical dimension by
its maximum horizontal dimension, excluding the structural support. The gross sign area of a
ground sign or projecting Sign with back-to-back identical cop~ mounted on the same standard(s)
shall be the total area on one (1) side of the sign.
SIGN FACE
The part of the sign area that is intended primarily for or can be utilized for
communication purposes.
SIGN PERMIT
A permit signed by the Administrator stating that a proposed sign has met with the
general provisions of this Ordinance.
SIGN STRUCTURE
Any structure which supports, has supported or is capable of supporting a sign, including
decorative cover and planter boxes.
SINGLE-TENANT BUILDING
An office or commercial building in which all space is occupied by one tenant.
STREET
A fight-of-way other than an alley, 'dedicated or otherwise legally established for the
public use, usually affording the principal means of access to abutting property.
SUSPENDED SIGN
A ground sign suspended from and installed on an arm or spar attached to one (1) upright,
decorative pole. The pole and arm and/or spar are limited to a maximum 16 square inch cross-
sectional area. No display or advertising sign shall be attached to the standard of a suspended
sign other than the display surface originally constructed as a part of such sign. (Twelve 12
square feet maximum sign area). This type of sign shall be permitted only in Old Town Carmel.
TKAFFIC DIRECTIONAL SIGN
Sign directing traffic movement onto and/or within a premise, not exceeding three (3)
square feet in sign area for any one (1) sign; and shall not be higher than three (3) feet above
ground level. Standard traffic directional signs, such as STOP and YIELD signs, shall comply
with the "Uniform Manual For Traffic Control Devices".
UNIFIED CENTER
A grouping of businesses or buildings designed to function as a [mit including converted
residential structures with more than one (1) occupant space.
VEHICLE SIGN
A sign on a vehicle of any kind, provided the sign is painted or attached directly to the
body of the original vehicle and does not project or extend beyond two (2) inches from the
original manufactured body proper of the vehicle. The vehicle to which the sign is attached shall
be in proper working order and shall bear a current license plate and shall not be permanently
parked on a public street or street right-of-way.
WALL SIGN
A sign established on the wall of a building with the face in a parallel plane to the plane
of the building wall, and which projects from that surface less than twelve (12) inches at all
points. Said sign shall not extend beyond the edges of the wall upon which it is mounted nor
above the roof line. perrn~ attached to the building shall be considered a part of
the structure, and signs established on ~ shall be considered wall Signs.
WINDOW AREA
The total area of all windows along a ~.
WINDOW SIGN
Any building sign, picture, symbol or combination thereof, designed to communicate
information about an activity, business, commodity, event, sale or service, that is: (a) placed (i)
inside of and within 2 feet of a window; or (ii) upon the window panes or glass; and (b) visible
from the exterior of the window.
25.7.01-3 EXElV[PTED SIGNS. The following types of signs are exempted from all
provisions of this section, but must be established and maintained in such a manner as to not

cause safety hazards. No procedures, approvals, permits or fees are required for the following
signs:

25.7.01-4 PROH~ITED SIGNS. The following types of signs are prohibited:
Signs which contain statements, words, or pictures of an obscene, indecent, or
immoral character, such as will offend public morals or decency.
Signs which contain or are in imitation of an official traffic sign or signal or

contain the words "stop", s o , cauu , g , "warning" or similar words,
unless permitted in another section of this Ordinance.
Signs which are of a size, location, movement, content, coloring, or manner of
illumination which may be confused with or construed as a traffic or street sign
or signal.
Signs which advertise an activity, business, project or service no longer conducted
on the premises upon which the sign is located.
e. Signs which move by design or have a major moving part.
Signs consisting of banners, posters, pennants, ribbons, streamers, strings of light
bulbs, spinners or similar devices, unless they are permitted specifically by other
sections of this Ordinance.

Signs which swing or otherwise noticeably move as a result of wind pressure
because of the manner of their suspension or attachment and whose movement can
be construed as dangerous by the Administrator.
Signs which are located in such a manner as to obstruct the view of flue
intersection of a street or highway with a railroad crossing.
Signs which are located upon, over, or in any street or highway tight-of2way,
except for official highway signs.
Portable signs which are portable or moveable, except as permitted under
provisions of this section.
Signs which are established on trees, utility poles and fences.
Signs which advertise goods, products, services or facilities or direct persons to
a different location from where the sign is installed. (Off-premise signs require a
variance from the Board.)
Suspended signs and projectine si~gnS, except in Old Town Carmel.
Signs which are not included under the types of signs permitted in this Ordinance.
Lighter than air advertising devices.
Roof signs on residences which have been converted to office, business and/or
manufacturing uses.
25.7.01-5 MAINTENANCE OF SIGNS. All signs and sign structures shall be kept
and maintained in good repair in a safe condition.

25.7.02-13 OLD TOWN CARMEL

Town Carmel. Said commercial uses may utilize either the signage
requirements in Section' 25.7.04-1, items a. through d., of this Ordinance
or the signage requirements listed in Section 25.7.04, item f.
SIGN CLASSIFICATION: Suspended sign; projecting sign or porch sign.
(Only in Old Town Carmel are these types of signs permitted.
NUMBER & TYPE: One (1) identifi~ per business in a single-
tenant building or a multi-tenant ground floor building. One (1) Building

PERMITTED BANNERS
Street Banners For Civic Events - a ~banner for
special events designated by the Mayor of the City
of Carmel may be erected no more than thirty (30)
days prior to the event and shall be removed no
more than three (3) days after the event. The
erection of a banner for a special event is further
subject to the approval of the appropriate
governmental agency having jurisdiction over the
proposed location of the banner.
Grand Opening Banners - A banner for grand
openings may be erected no more than fourteen (14)
days prior to the date the business first opens to the
general public and shall be removed no more than
seven (7) days after the date the business first
opens.
Interim Signage Pending Permanent Sign - a
temporary banner attached securely to the wall of a
building on all comers shall be permitted until a
permanent sign is erected. The temporary banner
must satisfy the applicable regulations concerning
maximum sign area and location, and a sign permit
is required. The temporary banner shall not be
displayed for more than ninety (90) days following
the issuance of the sign permit, unless the
Ackninistrator for good cause shown grants an
extension of time not to exceed ninety (90) days.
25.7.05
FAST FOOD DRIVE-THROUGH SERVICE MENU SIGNS
Fast food operations with drive-through service located on properties zoned B-l, B-2, B-3,
B-4, B-5, B-5, B-7, B-8, I-1, M-I, M-2, M-3, in addition to other permit, sd signs, may
also display a menu sign with a maximum sign area of sixteen (16) squxe feet and a
maximum height of six (6) feet for a ground sign.

25.7.06
LEGAL NON-CONFORMING SIGNS
After the enactment of this Ordinance, the Administrator shall make a survey every six
(6) months of the jurisdictional area for signs that do not conform to this Ordinance; and shall
submit the results of the survey, in writing, to the Mayor, Council, Officers of the Board and
Commission. This report is due on January 1, and July 1, of every year and shall include the
sections of this Ordinance with which said signs do not comply, and any necessary proof that
said signs are legal non-conforming signs.
The Administrator shall also use all reasonable efforts to notify the user or owner of the
property on which such sign is located of the signs non-conformity and whether it is legally non-
conforming or is illegal. Should any questions arise as a result of the Administrator's decision
that a sign is a legal non-conforming sim~ or is illegal, the final determination of such status shall
be made by the Board as provided for in Section 28.6 of this Ordinance. An on going record of
existing legal non-conforming signs shall thereafter be maintained as a part of the Board's
permanent records.
A legal non-conforming sign shall immediately lose its legal non-conforming designation
if:
(1) the sign is not kept in good repair and in a safe condition and the state of disrepair
or unsafe condition continues for six (6) months;
'(2) the sign is relocated;
(3) the complete sign and sign structure are replaced; or
(4) the sign permit or variance under which the sign was allowed or permitted expires.
On the happening of any one of the above conditions the sign shall be immediately
brought into conformance with this Ordinance with a new si~n permit secured therefore, or shall
be removed.
Nothing in this Ordinance shall relieve the owner or user of a legal non-conforming sign
or owner of the property on which the legal non-conformin~ sign is located'from the provisions
of this ordinance regarding safety, maintenance and repair of signs.
25.7.07
SIGN PER3ilTS
Except as otherwise provided in this Ordinance, it shall be unlawful for any person to
establish any sign within the jurisdictional area of this Ordinance, or cause the same to be done
without first obtaining a sign permit for each such sign from the Administrator as required by this
Ordinance. These directives shall not be construed to require any permit for a change of copy

for legal ~ or otherwise allowed under this Ordinance, nor for the repainting,
cleaning and other normal maintenance or repair of a sign or sign structure for which a permit
has previously been issued, so long as the sign or sign structure is not modified in any way to
violate the standards or provisions of this Ordinance. No permit is required for signs which are
exempted from permits elsewhere in this Ordinance. No new permit is requiied for signs which
have permits and which conform with the requirements of this ordinance on the date of its
adoption unless and until the sign is altered or relocated in violation of this Ordinance. A permit
must be secured when the fee ownership of the property upon which the sign is located has been
changed, or when the ground upon which the sign is situated has been leased to a new lessee.
Every sign permit issued by the Administrator shall become null and void if the sign is
not established within six (6) months after the issuance of such permit. Signs which require
approval by the Commission must be established within one (1) year after the date such approval
is granted, or such approval shall become null and void. Signs which require variance approval
from the Board shall be established within one (1) Year. (See Ordinance Z-170).
No person shall establish any sign upon any property Or building without the consent of
the owner or person entitled to possession of the property or building if any, or their authorized
representative.
Application for a permit shall be made to the Administrator upon a form provided by the
Administrator and shall be accompanied by such information as may be required to assure
compliance with all appropriate laws and regulations of the City including, but not limited to:

Name and address of the person leasing the premises (if applicable).
Clear and legible drawings with description definitely showing location of the sign
which is the subject of the permit and all other existing signs whose construction
requires permits, when such signs are on the same premises.

' Drawings showing the dimensions, construction supports, sizes, electrical wiring
and components, materials, and design of the sign and method of attachment. The
design, quality, materials and loading shall conform to the requirements of the
Building Official's and Administrative Code (B.O.A.C.), as amended. If required
by the Administrator, engineering data shall be supplied on plans submitted
certified by a duly licensed engineer.
The Administrator shall issue a permit for the establishment of a sign when an application
therefore has been properly made of the city.

The person establishing a sign shall notify the Administrator upon completion of the work
for which permits are required, and shall submit a color photograph of the established sicm to the
Administrator.
All signs shall be subject to an inspection by the Administrator.
The Administrator may, in writing, suspend or revoke a permit issued under provisions
of this Section wtxenever the permit is issued on the basis of a misstatement of fact or fraud after
due notice by and hearing before the Administrator. When a sign permit is denied or revoked
by the Administrator, he shall give written notice of the denial to the applicant together with a
brief written statement of the reasons for the denial.
No permit for a sign issued hereunder shall be deemed to constitute permission or
authorization to maintain an unlawful sign nor shall any permit issued hereunder constitute a
defense in an action to abate an unlawful sign.
An appeal may be taken to the BOard from either the Administrator's denial or revocation
of a permit or from the failure of the Administrator to formally grant or d&ny a permit within
thirty days ~ days. (See Section 30.1 and 30.2).
Permit fees shall be as stated in Section 29.6.5 of this Ordinance.
25.7.08 VARIANCE
A variance from the terms of these regulations may be submitted to the Carmel Board of
Zoning Appeals as stated in Section 30.5 of this Ordinance.
25.7.09
ADMINISTRATION AND ENFORCEMENT
25.7.09-1' ADMINISTRATION. The Administrator is hereby authorized and directed
to enforce.and cmxy out all provisions of this section both in letter and spirit, pursuant to state
statute.
The Administrator is further empowered to delegate the duties and the powers granted to
and imposed upon him under this Ordinance. As used in this section, "Administrator" shall
include any authorized representative(s).
The Administrator is hereby empowered to enter or inspect any building, structure, or
premises in the jurisdictional area of this Ordinance, upon which, or in connection with which
a sign is located, for the purpose of inspection of the sign, its structural and electrical
connections, and to insure compliance with the provisions of this section. Such inspections shall
be carried out during business hours, unless an emergency exists.
