HomeMy WebLinkAboutZ-284 B-6 to B-5/Penn Pkwy Ordinance No. Z - 284 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF C~RMELv INDIANAv ANENDING CHAPTER 10~ ~RTICLE 2~ SECTION 31~ OF THE CiM~IEL CITY CODE~ AS ANENDED~ WHEREAS~ AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CARMEL, INDIANA, ORDINANCE Z-160, AS AMENDED, PASSED BY THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ON JANUARY 21, 1980, UNDER AUTHORITY OF ACTS OF 1979, PUBLIC LAW 178, SECTION 1, et seq., (I.C. 18-7-4-101 et seq.) AND ALL ACTS AMENDATORY OR SUPPLEMENTARY THERETO. WHEREAS, THIS AMENDMENT CHANGES THE OFFICIAL ZONING MAP FOR THE CITY OF CARMEL AND CLAY TOWNSHIP, FROM A B-6 ZONED DISTRICT TO A B-5 ZONED DISTRICT ON THE PREMISES COMMONLY KNOWN AS .401 Pennsylvania Parkway, Indianapolis, IN 46280 NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AS FOLLOWS: Section I. Chapter 10, Article 2, Section 31~ of the Carmel City Code, is hereby amended to include in the B,5 Zoned District the following described real estate~ to-wit: See attached legal description Section II. All buildings or uses permitted and placed upon said descrfbed real estate shall fully conform with all the provisions of the Carmel/Clay Zoning Ordinance and shall have obtained the proper permits. SectiOn III. This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor. PASSED BY.~HE COMMON COUNCIL OF THE CITY OF CARMELv INDIANA, THIS ~0~ DAY OF ~~ , 19~ · The original rezone and conceptual site plan for Meridian Corporate Plaza required the three-story building, now known as Two Meridian Corporate Plaza, to be located entirely on property zoned B-5. The B-5 zoning limited the height of any structure that could be built on this portion of the property. Unfortunately, an incorrect legal description was recorded and does not match-up with the original B-5 zoning legal description. Therefore, we currently have a situation where a small portion of the Two Meridian Corporate Plaza site is zoned B-6 and the building is not in conformance with the B-6 setback requirements. We would like to down-zone this property to B-5 as it was originally intended to be zoned to meet the letter and the spirit of the original re-zone request and allow the Two Meridian Corporate Plaza building to meet all setback requirements.
