ORDINANCE NO. Z-476-05
AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF CARMEL, INDIANA
An Ordinance amending building height restrictions in the C-1/City Center District and C-2/Old
Town District of the Carmel Zoning Ordinance
WHEREAS, pursuant to the Advisory Planning Law of the State of Indiana (contained in
IC 36-7-4), each unit of local government that wishes to adopt land use and zoning ordinances
must first approve by resolution a comprehensive plan for the geographic area over which it has
jurisdiction; and
WHEREAS, the 2020 Vision Comprehensive Plan (the "Comprehensive Plan") Docket
No. 16-96 CP was given a favorable recommendation by the Carmel/Clay Advisory Plan
Commission on August 20, 1996, and duly approved by Resolution No. CC-09-03-96-03 of the
Common Council on September 24, I996, and is therefore the official. Comprehensive Plan of
the City of Carmel hnd Clay Township; and
WHEREAS, the City wishes to amend development standards in the Zoning Ordinance
to match the plans for the redevelopment of the City Center and Old Town areas by increasing
building height restrictions; and
WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to
amend the text of the zoning ordinance; and
WHEREAs,. pursuant to Indiana Code 36-7-4-610 and City of Carmel Ordinance No. D-
1600-02, the Carmel Zoning Ordinance is incorporated by reference into the Carmel City Code;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Carmel, Indiana, that, pursuant to lC 36-7-4-600 et seq. and after Docket No. 05020023 OA
having received a favorable recommendation from the Carmel Advisory Plan Commission on
Tuesday, April 19, 2005, it hereby adopts this Ordinance to amend the Carmel Zoning Ordinance
(Ordinance No. Z-289, as amended), to read as follows:
Section I:
CHAPTER 20E: C-l/CITY CENTER DISTRICT
a. Amend Section 20E. 04. 01:. Maximum Height - Residential Uses to read:
20E.04.01 Maximum Height- Residential Uses:
1. Adjacent to any residential use or zone: One hundred fifty (150) feet measured from
street grade.
2. Adjacent to all other uses: One hundred fifty (I 50) feet measured from street grade.
b. Amend Section 20E. 04. 02; Maximum Height - Commercial and Civic Uses to read:
20E.04.02 Maximum Height - Commercial and Civic Uses:
~ 1. Adjacent to an existing or platted single-family residence or residential subdivision: One
hundred' fifty (150) feet measured from street grade.
2. Adjacent to all otber uses: One hundred fifty (l 50) feet measured from street grade.

CHAPTER 20F: C-2/OLD TOWN DISTRICT
c. Amend Section 2OF. 04. 01: Maximum He?ght to read:
20F.04.01 Maximum Heieht: Sixty (60) feet, comprising no more than four (4) stories. Floor-to-
ceiling height shall be a minimum often (I0) feet at the first story and eight (8) feet at the second
and third stories.
Section II: All prior Ordinances or parts thereof inconsistent with any provision of this
Ordinance are hereby repealed.
Section III: This Ordinance shall be in full force and effect from and after its passage and
signing by the Mayor.

Commission (Docket No. 045020023 OA) to Amend Chapters 20E: C-1 City Center and 20F: C-2 Old
Town, in order to modify the maximum height development standards.
The Carmel Advisory Plan Commission's recommendation on the petition is FAVORABLE.
At its regular meeting on April 19, 2005, thc Commission voted nine (9) in Favor, zero (0) Opposed, zero
(0) Abstaining, to forxvard to the Common Coancil the proposed Ordinance No. Z-476-05 with a
Favorable Recommendation,
Please be advised that by virtue of the Commission's Favorable Recommendation, pursuant to IC 36-7-4-
607(e)(3), the Council has ninety (90) days to act on this petition before it becomes effective as Certified
by the Commission. Ninety days from the date of' the original Certification (April 20, 2005) is Tuesday,
July 19, 2005.
