W~EREAS, the Common Council of the City of Carmel, Indiana,
is desirous of annexin9 the follo~in9 described real estate, and
WHEREAS, the follo~in9 described real estate is contiguous
to the existin9 City boundaries by at least one-eighth of its
aggregate external boundaries and perimeter borders to the p~e-
sent boundaries of the City of Carmel, Indiana, and
the
WHEREAS, the City of Carmel, Indiana as heretofore defined
corporate boundaries of the City and is desirous of annexing
the following described property.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of Carmel, Indiana, that the following described real estate
in Hamilton County, Indiana, be and hereby is annexed to and
shall hereafter be apart of the City of Carmel, Indiana, owned by
Paul Lipps, Sondra K. Lipps, Paul E. Estridge Building Corpora-
tion and Craig Sharpe as contract purchasers and Smokey Row
Development Company, Joseph W. Ricketts, Jr., and Jean Ricketts,
husband and wife, and Edwin L. Duke and JoAnn Duke, husband and
wife, as contract sellers consisting of 12.703 acres, more or

Enclosed is the petition of landowners comprlslng the devel-
opments of Smokey Ridge and Smokey Hollow located on East Smokey
Row Road contiguous to the City's boundary established by the
Brentwood subdivision.
Weihe Engineering has confirmed that the property described
by Exhibits A and B meet the statutory requirements for contigui-
ty to be annexed.
Accordingly, after review by appropriate personnel, I would
ask that this matter be placed on the council's agenda for an-
nexation.

Edwin L. Duke and JoAnn Duke, husband and wife, Contract Sellers,
petition the City of Carmel to annex the following described real
estate to the City of Carmel pursuant to I.C. 36-4-3-9 et. seq.:

labeled as "Exhibit A"
And in support of its petition respectfully shows the City
Legislative Body as follows:
1. The territory to be annexed is contiguous to the exist-
ing City boundaries by more than ~ of its perimeter border.
2. The executive body of the County has consented to the
requested annexation.
3. The area to be annexed is served by municipal water and
sewerage.
4. The territory to be annexed complies in all respects
with the requirements of I.C. 36-4-9-1 et. seq.
WHEREFORE, Petitioners request the common council of the
City of Carmel to adopt an annexation ordinance in the form
submitted herewith.
