ANNEXATION 13.00
WHEREAS, the Common Council of the City o~f Carmel, Indiana, is desirous of annexing
the following described real estate, and
WHEREAS, the following described real estate is contiguous to the existing City
boundaries by at least one-eighth of its aggregate external boundaries and perimeter borders to
the present boundaries of the City of Carmel, Indiana, and
WHEREAS, the City of Carmel, Indiana has heretofore defined the corporate boundaries
of the City and is desirous of annexing the following described property.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Carmel, Indiana, that the following described real estate in Hamilton County, Indiana, owned by
John Kirk, with contract purchaser being Buckingham Properties, Inc., hereby is annexed to and
shall hereafter be a part of the City of Carmel, Indiana, effective January 3, 2000, said property
being more particularly described as shown in Exhibit A.
The Common Council of the City of Carmel, Indiana, declares that this Annexation
Ordinance shall be in full force and effect sixty (60) days after its final publication pursuant to
I.C. 5-3-1.

PETITION FOR ANNEXATION
Buckingham Properties, Inc., an Indiana corporation, ~ hereinafter the "Petitioner"), states
as follo~vs:
I. That the Petitioner is the Contract purchaser of the real estate described in Exhibit A
attached hereto and made a part hereof (the "Real Estate").
2. That the undersigned Property Owner, John Kirk, is the fee simple owner of the Real
Estate.
3. That the Common Council of the City of Carmel, Indiana, by ordinance, has defined the
corporate boundaries of the City of Carmel, Indiana.
4. That more than one-eighth (I/8th) of the aggregate extemal boundaries of the Real Estate
coincides with the corporate boundaries of the City of Carmel, Indiana, and the Real Estate,
therefore, is contiguous to the corporate boundaries of the City of Carmel, Indiana.
WHEREAS, the Petitioner requests that the Common Council of the City of Carmel adopt an
ordinance annexing the Re.a! EStae to the City of Carmel, Indiana.

This office Itas reviewed rte annexation nmterial received on September 24, 1999. We offer file following
connnents:
· The properly is 100% contiguous with existing boundadcs of file City of Cannel. Please find anclosed
a copy of this area from our annexation map. You may want to refer to file contiguous annexation
ordinances wben you prepare your exhibit for annexation.
· Them is some duplication of annexed area, namely on file Old Meridian perimeter of fllis properly.
The entire right-of-way of Old Meridian was annexed on October 17, 1977 by Annexation Ordim'mce
C-59, which was recorded on January 17, 1978. We don't see fl~is as a problem.
· We would suggest an 8 V2 x 11 or 8 V2 x 14 Exlfibit B dmciing that depicts the annexation legal
description and existing corporate boundaries.
