WHEREAS, the Common Council of the City of Carmel, Indiana ("Council"), is desirous of
annexing the attached described real estate in Exhibit 'A', and
WHEREAS, the attached described real estate in Exhibit 'A' is more than one-eighth (1/8) of the
aggregate external boundaries of the real estate which coincides with the corporate boundaries of the City
of Carmel, lndiana, and
WHEREAS, the City of Carmel, Indiana, has heretofore defined the corporate boundaries of the
City of Carmel, Indiana, and is desirotis of annexing the described property in Exhibit 'A';
NOW THEREFORE IT BE ORDAINED by the Common Council of the City of Carmel,
Indiana, that the attached described real estate in Exhibit 'A', in Hamilton County, Indiana is owned by
RDJ Custom Homes, Inc. 'Cherry Tree Estates' be and hereby is annexed to and shall hereafter be a part
of the City of Carmel, Indiana, effective January 3, 2000.
The Common Council of the City of Carmel, Indiana, declares that this Annexation Ordinance
shall be in full force and effective sixty (60) days after its final publication pursuant to I. C. 5-3-1.
PASSED by the Common Council of the City of Carmel, Indiana this ~:,~(~ day of

As reque~;lc~l, Ihis office has reviewed thc legal descriptions and drawing submiltcd for the proposed
annexation of thc subdivision to be muned Cberry Tree Estates. We offer file following comments:
1. The legal descriptions for fl~e properly and for tile remainder of Ihe right-of-way of Cherry Tree Road
appear to be in order.
2. The drawing of Cherry Tree Estates is missing two bearings, which should be included in the drawing
snbmilted for annexation. The drawing submission should ,also include the Cherry Tree Road right-of-.
, way and ,'ill appropriate bearings.
3. This parcel is contiguous to thc Spring Creek Subdivision, specifically to Annexation Ordinance C-179
that was approved by Cannel City Council on October 16, 1995 and recorded on Janu,xry 2, 1996. I
am enclosing a copy of this ordinance. The contiguous bearings for tile proposed annexation match
fllose of Ordinance C-179. The overall perimeter of lhe proposed annexation, including Cherty Tree
Road, appears lobe 2,298.89 linear feet. The contiguous perimeter totals 781.19 linear feet or 34.0 %.
The description submitted meels and exceeds file one-cigbth-configuity rcquiremenl. Therefore, tiffs office
approves this annexation description for thc Cherry Tree Estates subdivision.
I am enclosing annexation procedures from tile office of the Clerk-Treasurer for your information, in case
you do not lmve a copy. I mn 'also enclosing ,an ex,'m~ple of an annexation with an exhibit of the legal

RESPONSE LETTER
This letter is in response to your items as noted in your April 6', 1999, Review
Letter of the legal descriptions and primary plat previously submitted to your
office for your review.
The following items directly correlate with your letter:
Legal descriptionS for the property and the balance of the Cherry .Tree
16-1/2' Cherry Tree Road right-of-way lying east and adjacent to
property are as shown on the Primary Plat.
The curve length distance at the curve along Cherry Tree Road has
been added to the Primary Plat and correlate with.the regal description
on Sheet No. 1. The line table for Line Lll near the southwest corner
of the property depicts the bearing and distance which matches the
Legal Description on the Primary Plat.
3. Thank you for your copies of the attached Spring Creek Ordinance and
additional information iq regards to annexation .process.
Attached for your review, comment and use, are two 11 x 17 copies of the

The undersigned (hereinafter the "Petitioner"), the owner of the real estate described in Exhibit 'A" attached
· hereto and made part hereof, in support of this Petition for Annexation, states as follows:
1 .) The Petitioner is the owner of the real estate described in Exhibit 'A' (real estate),
2.) The Common Council of the City of Carmel, Indiana ("Council"), by ordinance, has defined the corporate
boundaries of the City of Carmel, Indiana.
3.) More than o~e-eighth (1/8) of the aggregate external boundaries of the real estate coincides witl~ the
corporate boundaries of the City of Carmel, Indiana.
WHEREFORE
The Petitioner requests that the Council adept an ordinance annexing the rea~ estate to the City of Carmel,
