NO. C-185
WHEREAS, the Common Council of the City of Carmel, Indiana ("Common Council") is
desirous of annexing to the City of Carmel, Indiana, the real estate described on Exhibit "A" hereto
("Real Estate"); and
DttEREAS, the Real Estate is contiguous by at least one-eighth (1/8) of its aggregate
extemal boundaries to the present boundary of the City of Carmel, Indiana; and
WHEREAS, the City of Carmel, Indiana has heretofore defined the corporate boundaries of
the City of Carmel and is now desirous of annexing the Real Estate;
NOI~V, THEREFORE, BE IT ORDAINED by the Common Council that the Real Estate
be, and hereby is, annexed to and shall hereafter be a part of the City of Carmel, Indiana.
BE IT FURTHER ORDAINED by the Common Council that the Real Estate is assigned
to Council District 4.
BE IT FURTHER ORDAINED by the Common Council that this Annexation Ordinance
No. C-185 shall be in full force and effect sixty (60) days after its final publication pursuant to I.C.
5-3-1.

Part of the Northeast Quarter and Southeast Quarter of Section 27 and part of the Northwest
and Southwest Quarters of Section 26 of Township 18 North, Range 4 East of the Second ~
Principal Meridian, Clay Township, in Hamilton County, Indiana, described as follows:
Beginning at the intersection of the south 16.5 foot half right of way line of 13 1ST Street
with the west 16.5 foot half right of way line of River Road, (being 16.5 feet south and 16.5
feet west of a brass plug at the southeast comer of said northeast quarter of Section 27,
thence South 89 degrees 59 minutes 50 seconds West (assumed beating) along said south
right of way line, parallel with the south line of said northeast quarter a distance of 108.02

James J. Nelson, upon first being duly sworn upon his oath, says:
1. That Affiant is an attorney duly admitted to practice in the State of Indiana and
is a partner in Nelson & Frankenberger, who caused to be prepared an Annexation Ordinance
which was duly adopted by the Common Council of the City of Cannel on the 4th day of
November, 1996. as Ordinance No. C-185, and was recorded in the Office of the Recorder of
Hamilton County, Indiana on January 24, 1997 as Instrument No. 9709702699.
2. That said Annexation Ordinance No. 185 contains a Scrivener's uror, in that the
fifth line of the second paragraph of Exh~it "A" of such Annexation Ordinance now maxis:
"right of way line parallel with the south line of said northeast quarter a distance of 108.02",
when, in fact, the said fifth line of such paragraph should correctly mad:
"right of way line parallel with the south line of said northeast quarter a distance of 1082.02".
