C-Z4 A SPECIAL Oi~DINANCE pROVIDING FOR THE ANNEXATION OF CERTAIN cONTIGUOUS TEtLI{ITORY TO THE TOWN OF CARMEL, INDIANA, AND FIXING A TIME WPIEN THE SAME SHALL TAKE EFFECT WHEREAS, certain contiguous territory to the TOWN OF CARMEL, JJqDIANA, is urban in character and is an economic and social part of the said TOWN, and said TOWN is financially able to provide the entire contiguous area described herein below with all municipal services now provided to the citizens residing elsewhere within the TOWN OF CARMEL, excepting, however, that portion of the annexed territory situated within the area in which AMERICAN SUBURBAN UTILITIES, INC. was granted the right to render sanitary sewage disposal service by the Public Service Commission of Indiana on January 27, 1967, by Certificate of Territorial Authority No. 60, said territory being subject to all of the te~-nis and condition s of AP~BITI~ATION outlined in "EXHIBIT B" to an agreement between the TOWN OF CAKIvIEL and AMERICAN SUBURBAN UTILITIES~ INC. dated March 28, 1967, a copy of which is on file in the office of the Clerk Treasurer of the Town of Carmel and may be examined during business hours by any interested person. Adoption of this ordinance by the Board of Trustees of the Town of Carmel, Indiana, shall serve as notice to all persons residing or owning property within said area that AMERICAN SUBURBAN UTILITIES, lNG. has the first right and obligation to provide sanitary sewage disposal service therein, and no other notice will be issued or posted regarding such territorial rights pertaining thereto: and WHEI~EAS, said contiguous territory forms a compact area abutting WHEKEAS, the te~n~s and conditions of said anneXation are fair in that immediately upon annexation of said contiguous territory, the citizens residing therein will be considered to receive all benefits and services now afforded to the citizens residing elsewhere within the corporate limits of the TOWN OF CARMEL, all at the current, prevailing rates now received by the TOWN therefor as soon thereafter as the same may reasonably be provided, with the exception of sanitary sewage disposal service within the area granted to AMERICAN SUBURBAN UTILITIES, INC., as above referred to, NOW THEREFORE: BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF CARMEL, INDIANA: That the following described territory in Hamilton Gounty, Indiana, be and the same is HEREBY ANNEXED to and shall hereafter be a part of the TOWN OF CARiVIEL, INDIANA: Part of the Southeast quarter of Sec. 26, Twp 18 N, Range 3 East as follows: beginning at a point on the east line of the east haL[ of the Southeast quarter section, which point is located 355.75 feet south of the northeast corner of the said southeast quarter; thence northwesterly 168.00 feet, more or less, to a point on the easterly right-of-way line of U.S. Highway #31, which point is 236.00 feet southwesterly of the northerly corner of Lot #1 in I~.A. Franke's Subdivision as per plat thereof recorded in Plat Book 128, page 197 in the office of the Recorder of Hamilton County, Indiana; thence northeasterly on and along aforesaid right of way continuing to the point where said easterly right of way line intersects thewest line of the Southwest Quarter of Sec. 25, Twp. 18, Rg. 3, which point is 67 feet south of the Northwest corner of the Southwest quarter of said Section 25; thence south on and along said west line a distance of Z88.75 feet to the place of beginning. ALSO: All of the West Ha[/of the Southwest Quarter of Section 25, Township 18 North, Kange 3 East, EXCEPTING therefrom the following: Beginning at the Southeast corner of said West half; ........ ,~ ~-~ ~ .~o~ ~,~ ~¢ ~ W~st I-tall a distance section; thence south along said west line 654.0 feet to the Southwest corner of said west ha)f; thence east 1310.8 feet to the place of beginning; And said Board of Trustees of the Town of Carmel, Indiana, do hereby declare that thi~ ordinance shall be in full force and effect immediately from and after its passage according to law.
