INDIANA, AMENDING AND CORRECTING EXHIBIT B TO ORIGINAL
ORDINANCE NO. C-259
WHEREAS, this Council adopted Ordinance C-259 (the "Annexation Ordinance") on
September 3, 2003 annexing certain territory to the City of Carmel; and
WHEREAS, Exhibit B to Ordinance C-259 purported to be a legal description of the
territory which was the subject of the Annexation Ordinance; and
WHEREAS, the document attached as Exhibit B to the Annexation Ordinance did not
accurately describe the territory which the Common Council and the public understood was
subject to the Annexation Ordinance; and
WHEREAS, Exhibit B attached hereto is a tree and accurate copy of the actual legal
description of the territory which this Common Council and the public understood was the
subject of the Annexation Ordinance.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Carmel, Indiana, as follows:
1. The above recitals are incorporated herein by reference as though fully set
forth herein below.
2. Exhibit B to Ordinance C-259 as adopted on September 3. 2003 is hereby
replaced with Exhibit B attached te this Amended Ordinance.
3. All prior Ordinances or parts thereof which may be inconsistent with any
provision of this Ordinance are hereby repealed. The para~:aphs,
sentences and words of this Ordinance are separable, and if any portion
hereof is declared unconstitutional, invalid, or unenforceable by a court of
competent jurisdiction, such declaration shall not effect the remaining
portions of this Ordinance.
4. This Ordinance shall be in full force and effect from and after the date of
its passage and signing by the Mayor. I~'~ da of ~

Street, said point also being the intersection of the Corporation Boundaries of the City of Carmel as described in

Then proceeding easterly, along the southerly right-of-way of 116m Street and coincident with the southern
boundary line of said Ordinance No. C-117 and with Ordinance No. C-213, to the west line of the Guilford Park
subdivision (formerly parcel number 17-13-01-00-00-003.000 as described in Ordinance No. C-213);
Then coincident with the Corporation Boundary lines of the City of Carmel as described in said Ordinance No. C-
