AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL,
INDIANA, AMENDING AND CORRECTING EXHIBIT B TO ORIGINAL
ORDINANCE NO. C-242, AS AMENDED
WHEREAS, this Council adopted Amended Ordinance C-242 (the "Annexation
Ordinance") on September 16, 2002 annexing certain territory to the City of Carmel; and
WHEREAS, Exhibit B to Amended Ordinance C-242 purported to be a legal description
of the territory which was the subject of the Annexation Ordinance; and
WHEREAS, the document attached as Exhibit B to the Annexation Ordinance did not
accurately describe the territory which the Common Council and the public understood was
subject to the Annexation Ordinance; and
WHEREAS, Exhibit B attached hereto is a true and accurate copy of the actual legal
description of the territory which this Common Council and the public understood was the
subject of the Annexation Ordinance.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Carmel, Indiana, as follows:
1. The above recitals are incorporated herein by reference as though fully set
forth herein below.
2. Exhibit B to Amended Ordinance C-242 as adopted on September 16,
2002 is hereby replaced with Exhibit B attached to this Amended
Ordinance.
3. All prior Ordinances or parts thereof which may be inconsistent with any
provision of this Ordinance are hereby repealed. The paragraphs,
sentences and words of this Ordinance are separable, and if any portion
hereof is declared unconstitutional, invalid, or unenforceable by a court of
competent jurisdiction, such declaration shall not effect the remaining
portions of this Ordinance.
4. This Ordinance shall be in full force and effect from and after the date of
its passage and signing by the Mayor.
