Classification ~anual of 1972~ Office of Management and Bu~get~ ss amende~ and suppl~ente~ under the following Divisions: Division A ~ Agricu!ture~ Forestry an~ Fishing~ Division B ~ ~ining; Division D ~ ~u facturing; Division E ~ Trans~rtation~ Co~unications~ Electric~ Gas and Samita~y Services~ and Division I ~ Se~ices~ The Non-Industrial Class shall inclu~e a~l ~omestic and gover~ental users ~ those inaustrial~ co~ercial an~ users whose wastes are segregate~ do~(~estic ~astes or wastes from sanitary con veniences where regular ~estic ~astes are those wastes generate~ by ~omestic activity as dete~ine~ by the Boar~ of Trusteeso 2.4 "Recovery Period" shall mean that period of time during which the Federal Grant amount, awarded to the Town of Carmel, Indiana under EPA Project No. C180445 allocable to the treatment of wastes from industrial users is recovered from the industrial users of such works; and said Recovery Period for EPA Project No. C180445 is hereby set at 30 years commencing from June 1, 1976. 2.5 "Recovered Amounts" shall mean the Federal Grant amounts, awarded to the Town of Carmel, Indiana under EPA Project NO. C180445, allocable to the treatment of wastes from industrial users and which must be recovered from such users by the Town of Carmel during the recovery period. 2.6 "Retained Amounts" shall mean 50 percent of recovered amounts of EPA Project No. C180445 to be retained by the Town of Carmel and used as follows: 2.6A "Trust Funds" - 80 percent of retained amounts including any interest earned thereon shall be placed in a bank account separate and apart from all other Town funds and shall be used by the Town of Carmel solely for eligible costs of future reconstruction and expansion of treatment works, and no amount of the Trust Funds shall be expended by the Town of Carmel without prior written approval of the Regional Administrator, Region V, Environmental Protection Agency. 2.6B "Discretionary Funds" - 20 percent of retained amounts, including any interest earned thereon, may be used by the Town of Carmel in any manner and for any purpose deemed necessary by the Board of Trustees within the Sewage Works. 2.7 "Payments to the U.S. Treasury" - the Town of Carmel shall, at least once per year, pay to the U.S. Treasury an amount equal to the remaining 50 percent of recovered amounts together with all interest earned thereon. SECTION 3 - INDUSTRIAL COST RECOVERY SYSTEM 3.1 Facilities constructed under EPA Project No. C180445 shall be defined particularly by the plans and specifications prepared for this project by Clyde E.' SS 2,190~000 lbs. McFadden President, Town Board of Trustees Town of Carmel Town Hall Carmel, Indiana 46032 September 23, 1975 Re: Treatment r'7orks Grant C180445 Dear Mr. McFadden: ?;e have completed a review of the Town's proposed user charge system (UCS), industrial cost recovery system (ICRS), and sewer use ordinance along with all supporting information. From the information provided, it appears the proposed UCS will enable the ~own to generate revenue from each recipient of wastewater treatment services, proportunate to costs for operation, maintenance and replacement of facilities employed. In addition, the total revenue appears sufficient for Carmel to provide adequate treatment on a continuing basis. The proposed ICRS (recognizing a survey is currently being undertaken to identify industrial dischargers (if any) pursuant to Resolution 9-9.75-1) appears to offer a petential for generating recovered amounts and administering retained amounts in accordance ~;ith applicable regulations. The proposed sewer use ordinance, required by 40 CFR 35.935-16, a basic part of both revenue systems, also appears to be satisfactory. Accordingly, the UCS, ICRS and sewer use ordinance are hereby approved and Special Grant Condition No. 3 is considered to have been satisfied.
