CC-10-20-97-02 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA AUTHORIZING JOINDER OF SAID MUNICIPALITY WITH THE CENTRAL INDIANA REGIONAL TRANSPORTATION AUTHORITY WHEREAS, the City of Cannel ("Cannel") desires to join with The Central Indiana Regional Transportation Authority for those purposes for which such Regional Transportation Authority has been created pursuant to Indiana Code 36-9-3-1, and following; and, WHEREAS, Indiana Code 36-9-3-3 provides for the expansion of a regional transportation authority upon the adoption of resolutions indicating the express desire to do so by the fiscal body of a county or municipality wishing to be added to the Authority as well as a resolution adopted by the City of Indianapolis, all in substantially similar form; and, WHEREAS, Indiana Code 36-1-7, et seq., provides for the creation of Interlocal Agreements between municipal corporations for such purposes as are permitted by statute, and upon the adoption of substantially similar resolutions declaring the purpose of such interlocal agreements. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Carreel, Indiana as follows: That the City of Cannel does hereby join The Central Indiana Regional Transportation Authority subject to all of the fights, responsibilities and authority as established by Indiana Code 36-9-3-1 and following and/or any ordinance creating the Central Indiana Regional Transportation Authority and the provisions therein, such joinder to be effective upon the adoption of this resolution and a substantially similar resolution by the City County Council of the City of Indianapolis. That the City of Carmel does hereby enter into an Interlocal Agreement with those certain other municipal corporation identified on Exhibit B attached hereto and made part hereof, for the purpose of identifying the means and methods of financing those activities deemed suitable and the amounts of money for which each of such participants is responsible. That pursuant to such Interlocal Agreement, the City of Cannel will honor the invoice/claim for said sum as identified on Exhibit B when submitted. That the Interlocal Agreement provided for herein may be executed in as many counterparts as there are participating municipal corporations and said agreement shall be effective upon the adoption of this Resolution and its counterparts. Cordray, Clerk-T urer INTERLOCAL AGREEMENT 'ROVED AS 0 FORM WHERAS, Indiana Code provides for the adoption of interlocal agreements by common resolution; and, WHEREAS, the City of Carmel, Indiana desires to enter into an interlocal agreement with those other municipalities which plan to participate in the Central Indiana Regional Transportation Authority; and, WHEREAS, Exhibit B attached hereto and made part hereof constitutes the identity of each participating municipality, the amount which each municipality is agreeing to provide to support the activities of the Regional Transportation Authority and the program of works for which such funds shall be used. NOW, THEREFORE, it is hereby Agreed as follows: Section 1. That the City of Carrnel, Indiana shall pay those sums set out in Exhibit B for those purposes identified therein. This Agreement may be executed in as many counterparts as there are municipalities participating. Section 2. This Interlocal Agreement shall be null and void if the Federal, State and City of Indianapolis govemments acting by and through their appropriate jurisdictional bodies do not provide funding at the approximate levels indicated on Exhibit B. Or in the absence of such funding agreements that another source of funding is secured and participating municipal corporations individually agree to proceed with the formation of the Regional Transportation Authority. In no event shall funding levels for individual participating municipal corporations exceed the levels indicated on Exhibit B without that municipal corporation's consent. Invoicing for participating municipal corporations will not occur until all individual funding agreements in excess of $50,000.00 have been secured.
