OF THE CITY OF CARMEL
APPROVING AN INTERLOCAL AGREEMENT
CONCERNING ANNEXATION BETWEEN THE CITY OF CARMEL
AND THE CITY OF NOBLESVILLE ALONG 146TH STREET
WITNESS THAT:
WHEREAS, the Mayor of the City of Carmel and the Mayor of the
City of Noblesville have proposed an Agreement between the cities
concerning annexation along 146th Street; and,
WHEREAS, attached hereto and made a part hereof is the
Interlocal Agreement Between the City of Carmel and the City of
Noblesville Concerning Annexation along 146th Street; and
WHEREAS, it is in the best interests of the health, safety,
and welfare of the citizens of Carmel that the Interlocal Agreement
Between the City of Noblesville and the City of Carmel Concerning
Annexation Along 146th Street be approved.
IT IS THEREBY RESOLVED by the Common Council of the City of
Carmel as follows: ,
1. The Interlocal Agreement Between the City of Noblesville
and the City of Carmel Concerning Annexation which is attached
hereto is hereby approved and shall be in full force and effect
upon passage of this resolution and signature by the Mayor and
Clerk-Treasurer.
2. The Mayor of the City and the Clerk-Treasurer are
authorized to execute the Interlocal Agreement Between the City of
Noblesville and the City of Carmel Concerning Annexation Along
146th Street.
PASSED by the Common Council of the City of Carmel, Indiana this

WITNESS THAT:
WHEREAS, the City of Carmel has traditionally been wholly
contained within Clay Township; and,
WHEREAS, the school children of Clay Township go to Camel
Schools and the citizens of Clay Township have traditional ties
with the City of Carmel; and,
WHEREAS, the City of Noblesville has traditionally been
located within Noblesville Township; and,
WHEREAS, the school children of Noblesville Township gO to
Noblesville Schools and the citizens of Noblesville Township have
traditional ties with the City of Noblesville; and,
WHEREAS, Noblesville Township and Clay Township have a common
boundary along 146th Street; and,
WHEREAS, the City of Carmel and the City of Noblesville agree
that it is in the best interests of the health, safety, and welfare
of the citizens of the respective municipalities that an Agreement
be approved concerning annexation along the common boundary of
Noblesville Township and Clay Township.
IT IS THEREBY AGREED by the parties hereto as follows:
1. The City of Carmel and the Common Council of the City of
Carmel will not seek annexation, either voluntarily or
involuntarily, north of a center line of 146th Street into
Noblesville Township.
2. The City of Noblesville and the Common Council of the
City of Noblesville will not seek annexation, either voluntarily or
involuntarily, south of a center line of 146th Street into Clay
Township.
3. This Agreement has been approved pursuant to Indiana Code
36-1-7 by the Common Council of the City of Camel and the Common
Council of the City of Noblesville by approving Resolutions in
substantially the same form.
4. This Agreement shall remain in-full force and effect for
a period of five (5) years from the date set out herein. The
Agreement shall continue for an additional three (3) years after
the initial five (5) year period unless either party expressly
rescinds the Agreement in writing.
5. Any dispute between the parties shall be submitted to
mediation pursuant to the Indiana Rules for Alternative Dispute
Resolution as a condition pre&edent to the initiation of any
litigation to interpret or enforce this Agreement.
ALL OF WHICH IS AGREED BY AND BETWEEN the City of carmel and
the City of Noblesville on the dates of passage of their respective
Resolutions approving this Agreement.
