DRAINAGE STUDY FOR COOL CREEK
WHEREAS, Cool Creek flows through and provides a substantial surface water drainage
outlet for certain portions of the City of Cannel (hereinafter referred to as "Cannel"), the Town
of Westfield (hereinafter referred to as "Westfield"), and the unincorporated areas of Hamilton
County; and,
WHEREAS, Cool Creek is not a regulated drain pursuant to the terms of Indiana Code
36-9-27; and,
WHEREAS, the retention and controlled discharge of stom~ and surface water is to the
benefit of all of the citizens of Hamilton County; and,
WHEREAS, the land presently drained by Cool Creek (the Watershed) includes part of
Cannel, West field, and unincorporated areas of the County which have been and are anticipated
to be developed; and,
WHEREAS, certain economies of scale and savings can be achieved by doing a
comprehensive study of the Cool Creek Drainage Shed; and,
WHEREAS, the Board of Commissioners of Hamilton County, acting through the
Hamilton County Surveyor, (hereinafter referred to as "the County"), has agreed to prepare a
request for proposals for a private company to do a comprehensive study of the Watershed; to
receive and evaluate the responses to the request for proposals; and to enter into a contract for a
study of the Watershed for the benefit of the citizens of Carmel, Westfield, and the County.
IT IS THEREBY AGREED by and between the parties hereto as follows:
1. The County agrees to prepare and distribute a request for proposals for a survey of the
Cool Creek Watershed to define and determine a comprehensive drainage plan for the
Watershed, (hereinafter referred to as the "Watershed Study").
2. Prior to the award of a contract for the Watershed Study, the Surveyor shall provide
copies of the proposals to each of the signatories and give them an opportunity to make
comments and to review the recommendations of the Surveyor. The Surveyor shall take into
consideration such comments prior to making a recommendation to the Board of Commissioners
to award the contract.
3. The signatories to this Interlocal Agreement agreed to pay one third (1/3) of the cost of
the Watershed Study but no party shall pay more than Fifty Thousand Dollars ($50,000).
4. Each signatory hereto agrees to pay their share of the cost of the Watershed Study
within thirty (30) days of the notice by the County of the successful bidder.
5. The Hamilton County Surveyor shall be deemed to contact a representative of the
parties to enter into the contract for the Watershed Study.
6. The parties agree that they will communicate and cooperate in providing all
information within their possession for the contractor to perform the Watershed Study.
7. This agreement shall be in full force and effect, binding on the signatories hereto upon
the execution of this document.
8. The units that are signatories hereto may sign on separate counter parts and all parties
consent to copies of counterpart signature pages being attached to this Agreement.
ALL OF WHICH IS AGREED by and between the parties upon approval by execution of
their signatures hereto, and approval of a resolution substantially similar to the attached.
