Court Cost/FeesINTERLOCAL AGREEMENT FOR THE CITY OF CARMEL This Interlocal Agmee~ent is entered into'among the City of / Carmel, Indiana, the Pros{cuting Attorney of Hamilton County, Indiana, the Clerk of Hamilton County, Indiana, and approved by the Hamilton County Council. The purpose of this %greement is to provide and share revenue among the parties through the successful collection of judgments and/or fines and costs assessed against violators of ordinances of the City of Carmel. ~he conditions of this Agreement are as follows: 1. This Agreement shall be in effect for a period of one year after the date of signing by all the parties and thereafter on a yearly basis unless notice of termination is given pursuant to this Agreement. 2. Any party to this Agreement may terminate the Agreement upon writ- ten notice to all parties not less than ninety (90) days before such ter- mination is desired. Said termination may be either partial or complete. Upon complete termination of this Agreement, all monies left owing shall become immediately due and payable. 3. The Prosecuting Attorney of Hamilton County agrees to prosecute 911eged violations of ordinances of the City of Carmel on behalf of the City of Carmel. 4. If the Proaecuting Attorney of Hamilton County~ law enforcement agency and/or city agency files the alleged violation in Hamilton County Court the following shall be the procedure: a) The City of Carmel hereby authorizes the Clerk of Hamilton County to collect all costs and judgments and/or fines which arise out of a judgment of a violation of an ordinance of the City of Carmel. (b) Pursuant to I.C. 35-10.5-8-11, the Cierk of Hamilton County agrees to pay to the City of Carmel for ~very judgment which is collected arising out of a violation of an ordinance or of the municipal code of the City of Carmel, the sum of Fifteen .Dollars ($15.00) which represents the town's share of the municipal Prosecutor's fee, plus the full amount of costs, judgments and/or fines assessed and collected for violations of ordinances. Said payment shall be made by the 15th day of each month ~ following the collection of any such j~dgments.~ The remainder of the costs which are collected by the Clerk of Hamilton County shall be retained by said Qlerk on behalf of Hamilton County in consideration for the services in processing the alleged violations of an ordinance of the City of Carmel. Of the fifteen Dollar ($15.00) municipal Prosecutor's fees collected on every judgment and forwarded to the City of Carmel by the Clerk of Hamilton County, the Clerk Treasurer of the City of Carmel shall pay the sum of Five Dollars ($5.00) to the Hamilton County Prosecuting Attorney in consideration for the services of the Prosecuting Attorney in processing and prosecuting the alleged violations of an ordinance or of a section of the municipal code of the City of Carmel. The payment of Five Dollars ($5.00) for every judgment so collected shall be made payable to the Treasurer of Hamilton County ~nd recorded in the Hamilton County Auditor's Office under the Prosecutor's fund entitled "Prosecution of City Ordinances." 5. If the Prosecuting Attorney of Hamilton County, law enforcement agency and/or city agency files its alleged violation in the Carmel City Court, the Clerk Treasurer of the City of Carmel shall pay the'sum of Five Dollars ($5.00) to the Hamilton County Prosecuting Attorney in con slderation for the services of the Prosecuting Attorney in processing and prosecuting the alleged violations of an ordinance or o~ a section of the munlcipal code of the City of Carmel. The payment of Five Dollars ($5.00) for every judgment so collected shall be made payable to the Treasurer of Hamilton County and recorded in the Hamilton County Auditor's Office under the Prosecutor's fund entitled "Prosecution of City Ordinances." .The remainder of the costs and fees for judgments and/or fines which are collected by the Clerk of the Carmel City Court shall be retained on behalf of the City of Carmel for the se.rvices in processing the alleged violations of an ordinance of the City of Carmel pursuant to statute.
