HomeMy WebLinkAboutBPW-11-23-76 MINUTES OF BOARD OF PUBLIC WORKS November 23, 1976 The regular meeting of the Board of Public Works ~as called to order at 3:05 PM by Mayor Pickett. All members and Clerk-Treasurer were present. Mr. Kern moved to dispense with the reading of the minutes of the last regular meeting and approve them as received, Mr. Hohl seconded it. Mr. Hohl then moved to amend the motion to cl~uge size of floor jack in fifth paragraph on page I from 2 1/2 ton to ~ 1/2 ton, Mr. Kern seconded it and it passed unanimously. Motion to approve minutes passed unanimously. POLICE CAR BID: 0nly one bid was received for new police cars. Bid was from Don~!Hinds Ford, Inc. and was 9pened by Mr. Kern. Mr. Kern moved the bid be rejected for sole purpose of allowing the City to again advertise for bids hopin~we will receive more than one bid, Mr. Hohl seconded it and it passed unanimously. Bids to be advertised for December l~th meeting. BOND RELEASES: Mr. Hohl moved to release the following bonds: Principal Item Amount Central Eng. & Const. RUssell, Inc. for sidewalk between High Drive and Fairbanks for $2,980.00~ Mr. Kern seconded it and it passed unanimously. EASEM~,, RELEASE ~0T#ll EDEN GLEN: Mr. Hohl stated on Lot #ll Eden Glen, there was a very large area which was considered a drainage easement. These people ~az~ted to build a swimming pool and they discovered about one-half of their back yard was a stray piece of easement. Mr. Hohl stated we would need a legal form to release this easement. He stated he would have to double check the details. He stated in his opinion it would be all right to release the easement. Mr. Kern stated if it was a drainage easement the Council would have to give release. Mr. Kern stated he would prepare an ordinance and release for them. BROOKSHIRE VILLAGE CONDOMINIUMS: Mr. Hohl stated the original developers of Brookshire Village had paid the sewer availability fees for the 16 acres and the connection charges for 15 buildin~s amd one permit was issued. Cost of the permit Page 2 11/23/76 was calculated at the then current price $110.00 per connection, condominiums were counted as apartment units so that was multiplied by 7~ arriving at $77 per connection. The project did not complete. A different group took it over. They are now under construction. They have come in for sewer permits and Mr. Hohl stated he was desirous of voidi~ the original sewer permit for bookkeeping reasons because they can't very well go out and do 30-40 seperate sewer installa- tion inspections on one permit paper. Mr. Hohl stated there was also the question of the contract which the City signed at the time Justus Development put in part of the sanitary sewer. It was a three party agreement signed by Carmel Multi- School Corp, Justus and City of Carmel. It included the fact that Justus had paid these permits and this agreement was binding on the assigns of Justus. Mr. Hohl stated he did not feel we could go back and charge them a higher fee. Mr. Kern moved to approve Mr. Hohl's recommendation that the sewer connection fees and availability be considered paid on this project subject to his looking at the contract, Mr. Hohl seconded it and it passed unanimsouly. Mr. Kern stated we needed a resolution stating the fees are only good for one or two years. ~6TH STREET CHANGE ORDER: M~yor Pickett read letter from Mr. P~aswamy of Clyde E. Williama and Associates requesting change order for $4,875.00 for re-locating the sampli~ point for chlorine residual analysis at the 96th St. wastewater treatment plant. Mr. Ramaswamy stated inasmuch as the Board of Public Works felt this item should have been included in the original plans and specifi- cations, it would be agreeable for Clyde E. Williams to pay to the City of Carmel a sum of $158.00 being the City's share of the price difference estimate had the item been in the 1974 bid as compared to today's prices. Mr. Kern stated he didn't feel the federal government should pay for the mistake of the engineer. Mr. Dougherty, Utilities Manager, stated the chan~e had already been done by the contractor upon authorization of someone other than the City. Mr. Hohl moved to table the approval of the change order and direct Clyde E. Williams & Associates to approach us with their solution and method of handling on an official basis all of the outstanding problems we have at.the 96th Street Wastewater Treatment Project, Mr. Kern seconded it and it passed unanimously. CLAIM: Mr. Hohl moved to approve ~laim ~4801 for $17.96 for mileage for Debbie Cline, Mr. Kern seconded it and it passed muanimously. There being no further business the meeti~ was adjourned at 4 PM.
