CITY COUNCIL MEETING
MARCH 15, 1976
The regular meeting of the City Cotuucil was called to order at 7:30 p.m. by M~yor
Albert Pickett. All members, City Attorney and Clerk-Treasurer were present.
Councilman Reiman g~ve the invocation and Mayor Pickett led the pledge of allegiance.
~uncilmanSwift move~ to dispens~ with reading of the minutes of the last regular
meeting and approve them as received, Councilman Dean seconded it and it passed un-
animously.
Water Service Area: Mayor Pickett stated the Board of Public Works had authorized
Clyde E. Williams to proceed with study ~ recommended at last Council meeting.
Couneilm~u Dean asked why the Board of Public Works did not follow the Councils recommen-
dation to ask the builders to put their portion of the study in escrow. Mayor Pickett
instructed City Attorney to proceed with drawi~ up a contract with the builders requir-
i~ them to place their portion in escrow.
Property Committee: Mayor Pickett stated he did not attend the last meeting of the
property committee, however he understood there was discussion on the Talbert-Roessler
property. Mayor Pickett then read a report he had put together for information pur-
poses. His report indicated con~nmuitys input of a desire to keep the City buildi~
in the "downtown" Carmel area. He stated he viewed the $100,000 price for the Talbert-
Roessler property to be reasonable inasmuch as it adjoins present property and con-
sidering the price property is selling for at this time. He stated two observation wells
from the downtown well field are on Talbert-Roessler property and ou~ heavy equipment
and salt are stored on this property. We presently are in violation of EPA and State
Board of Health requirements concerning disposal of brine from softeni~ eq~pment at
the downtown water plant amd m~y be forced to put in treatment facilities adjacent to
the downtown plant. He also stated the aerator tower has encroached on the Talbert-
Roessler property. Mayor Pickett also stated a number of retired people on fixed in-
come live in the downtown area and it is economical to them to walk to pay the utility
bills. Utilities Man~ger and City Engineer were present to answer the Councils questions
and re-iterated the M~yors concern for need for storage space. Cotuucilman Reiman stated
she did not like to rush into buyiD~ the property just to store six pieces of equipment.
Councilman C~rretson stated he liked the way the Mayor presented the subject but pointed
out the Council needed more insight into possibility of also purchasing the corner lot
and other alternatives, and when the committee came up with these figures then the
Council could take some action.
R~ilroad Depot: Couneilman Meacham stated the Clerk-Treasurer had written a letter
to L & N R~ilroad Co. stating the City would like to purchase or lease the property
the depot was on but had not received a reply.
Cla~ Jr. Him Annexation: City Attorney stated he had discussed with Councilman Swift
the fact thatthere is a parcel of land between the Clay Jr. High School, which had
petitioned the City for annexation~and property in the City now. If we did not annex
that parcel of land we would h~ve to strip annex and he felt we should not do that if
we could prevent it. The owner of the property, Nels Ackerson, was present and stated
he would be happy to work with the City on that subject and stated he was surprised
annexation proceedings would be going forth without them being contacted. Councilman
Coots stated it was his understandi~ that the school was concerned of the safety -
security etc. and felt in an instance when a City was annexing a school within its
school district and the fact they would not be affecti~ property owned by anyone else
other than a police car traveling down the road running alongside the property from time
to time no permission was needed from the other property owner, and he understood an

annexation ordinance was to h~ve been prepared for the Councils consideration this
evening. Councilm~n Garretson stated he was not in favor of strip annexation but felt
the school should be annexed as soon as possible. CouncilmauSwift stated Gray Road
between 126th and ~23~ is in poor condition and if we annex the property straight across
we will end up with that section of road. He stated farther that 126th out to the Jr.
High School has been rebuilt and is in pretty good shape. Councilman Coots stated he
envisioned a requirement by the Plan Commission that thatroad be upgraded to Class I
standards before development of the property could be completed. Councilman Coots moved
in accordance with discussion held at the last meeti~ and tonight that the City
Attorney prepare for the Councils consideration at the meeting to be held April
ordinance annexing by legal description the 70 acre site of Clay Jr. High School.
Councilman Doane seconded it. Councilman Swift moved to amend the motion to include the
entire right-of-way of 126th Street from the present east City limits to the eastern
edge of Carmel Clay schools 70 acre plot. Councilman Reiman seconded it and it passed
unanimously. Amended motion passed unanimously.
Salar~ Ordinance ~-~2: City Attorney presented proposed 0rd ~D-92 concerni~ salaries
of all personnel and City Attorney not covered by previously enacted ordinances.
Councilman Meacham moved to pass on the ordinance tonight, Councilman Coots seconded it
and it failed ~ ayes 3 nays. Councilmen Swift, Relman and Dean voting nay. Councilman
Garretson moved for adoption of first reading of the ordinance, Councilman Swift seconded
it and it passed unanimously.
Utility Expenditures & BudB~t: Councilman Garretson moved to table item ~6, maximum
expenditures and budget for the utilities. Councilman Swift asked if a budget for the
Utilities would be required for 1977. Councilman Coots stated he was of the opinion
a budget for the Utilities would be as binding as another City department. City
Attorney stated if the Utilities were requested to make a budgetby the Council or the
Board of Public Works they would have to do it but it would not have the same effect as
other City departments. It could be done by ordinance or the Board of Public Works
could do it orally. Mayor Pickett read report of income and expenses of the Utilities
submitted by the Clerk-Treasurer. Councilman G~rretson stated he would remake his motion
to table this discussion, Councilman Deane seconded it and it passed unanimously.
Cross Walk Ordinance: Councilman Swift moved to authorize the City Attorney to prepare
an ordinance providing for the use and enforcement of cross walks in school zones in
the~i~ity of Carmel and D~f~e~the laD~%u~ge and penalties after the Indianapolis
ordinance, Councilman Coots seconded it and it passed unanimously.
Meeting was adjourned at 8:h5 p.m.
Mayor Pickett re-covened the meeting at 8:5~ p.m.
City FlaK: Mayor Pickett stated he had been contacted by Mrs. Ann Zenobia on the pro-
cedure to go through on adopting a City flag. Councilman Doane stated she had already
looked into the designing of a flag for 'the City and presented her design. She also
stated that she would volunteer to pay the cost of the flag. Mrs. Zenobia stated she
had already contacted the schools for a possible contest to have tne children .design
a fla~- for the City. Mrs. Pat Roush, rePresenting the Bi-Centennial Commission, stated
Mrs. Zenobia had not been working with their Commission. Council agreed by consensus
that Mrs. Zenobia should work with the City government structure on this project and
Councilman Doane would serve as a liason.
Police Overtime Ordinance: Councilman Swift stated he had asked that discussion on
a possible police overtime ordinance be put on the agenda with the thinking that
there was some money included in the budget this year for that purpose. He stated
also, that he felt the policemen should get paid for the time spent in court on their
day off. Councilman Swift then moved an ordinance be prepared for the next meeting in
accordance with provisions of public law 281 in the acts of 1971 providing that the

Carmel Police pay overtime wages in the amount of $4.00 per hour. Councilm~u Doane
seconded it and a discussion followed. Councilman Dean asked why another policeman
had not been hired as was allowed for in the budget. Mayor Pickett stated before an
additional employee was hired he would like a complete evaluation on the need. Police
Commission President, Mr. Jenkins, read a report of time bei~ turned in such as lunch
hours, attending community meetings, Boy Scout work ~ud attending Stan Beach's funeral.
Mr. Jenkins stated an ordinance should stipulate what is to be covered. Mr. Jenkins
stated they were in the process of rewriting rules and regulations for the department.
Police Commissioner Stonecipher recommended in the future to have discussion of police
business conducted at a police commissioners meaning. City Attorney suggested draft-
lng the overtime ordinance subject to regulations promulgated by the Board of Police
Commissioners. Councilman Coots stated he was of the opinion some of the basic criteria
should be inserted in the ordinance rather than delegating the sole authority to the
Police Commissioners. City Attorney stated the Board of Police Commissioners by state
statue has complete control over the police salaries. Councilman Swift stated he would
leave his motion the way he made it, allowing for the ordinance to be drawn up with
general wording. Motion passed unanimously.
Transfer Funds Ordinance: M~yor Pickett read proposed ordinance #B-91 transferring
funds within the Plan, Police and MVH budgets. Co~mcilman Ge~retson moved to suspend
the rules and pass on the ordinance tonight, Councilman Reiman seconded it and it passed
unanimously. Councilman Gem~etson moved for adoption of proposed ordinance, B-gl,
Councilman Dean seconded it and it passed 6-1, Counci~ Swift voting n~y.
126th Street Pro~ect: City Engineer gave a summary on the proposed 126th Street project
initiated by the previous Town Board. He stated approximate cost of the project would
be $312,000.00. After the federal funds available for the project was used and the
Local Rd & Street funds, we would still need approximately $25,000.00 ts possibly come
from the Cumulative Capital Imp. fund. M~yor Pickett stated he wanted to make the
Council aware of the situation inasmuch as the local money used would h~ve to be spent
through a special appropriation ordin~uce passed upon by the Council.
4~1 & Carmel Dr. Light: Councilm~n Reiman stated she considered the intersection of
431 and Cam~mel Drive one of the most hazardous in the community and suggested the
M~yor tske it under eonsideration to proceed with haste in getting the state to put
up some sort of traffic signal or the City put up some street lighting. Councilman
Garretson stated the Mayor should prevail upon Representative Donaldson and Senator
Duv~l~ to lend their offices to talk with the Highway Commission to try to get us some
action. He also suggested going to Senator McCormick and the Governor. Mayor Pickett
stated he would follow up and have some information by next meeting.
Dept. Heads: Councilm~u Reiman stated she would like to see department heads at more
meetings. Mayor Pickett stated if the department head needed to be at meeti~°~ to
answer questions the Council should ge through the Mayor and request that they be there.
Stonecipher Sewer Back-up: Councilman Coots asked City E~ineer if the Stonecipher
letter which was discussed at the last Board of Public Works meeti~ h~d been answered.
Mr. Hohl replyed that Mmv. Stonecipher had read the letter in person and her questions
had been answered. He stated he was at a loss to give absolute positive answers to
her questions because the testing and the research program on the problem is not com-
pleted as yet.
Pat Roush Bi-Centennial: Pat Rousch, representing the Bi-Centennial Commission
appeared before the Council to request authorization to block traffic on some streets
during the July 3 and ~ celebration. City Attorney stated the Board of Public Works
could take her request up at their next meeting.
There being no further business the meeting was adjourned at 10:50 p.m.
