CITY COUNCIL MEETING
August 29, 1977
The regular meeting of the City Council was called to order at 7:30 PM by
Mayor Pickett who presided. All members and Clerk-Treasurer were present.
City Attorney was not present.
Councilwoman Doane gave the invocation. Mayor Pickett led the pledge of
allegiance.
Councilman Swift moved to dispense with the minutes of the last regular
meeting and approve them as received, Councilman Meachsm seconded it and it
passed unanimously.
AGENDA ITEM #1: PUBLIC HEARING 1~78 BUDGET: Mayor Pickett opened advertised
public hearing for proposed 1978 budget. There were no comments from the
public. Councilman Garretson moved to adopt Ordinance D-127, 1978 budget,
Councilwoman Doane seconded it and it passed unanimously. Councilman Cerretson
moved to approve proposed Ordinance D-128, setting the tax rate at $1.55 on
each one hundred dollars of taxable property, Councilman Dean seconded it and
it passed unanimously. Mayor Pickett read proposed resolution petitioning the
State Board of Tax Commissioners for relief from levy limitations pursuant to
Public Law 50-1973 as amended. Councilman Swift moved to adopt resolution as
read, Councilman Meacham seconded it and it passed unanimously.
AGENDA ITEM,S2: FIRE AiID POLICE SALARY ORDINANCE: Mayor Pickett read proposed
Ordinance D-129 establishing 1978 salaries for fire and police departments.
Councilman Meachammoved for adoption, Councilwoman Reiman seconded it and it
passed unanimously.
AGENDA ITF~M#3: SECOND READING: Ordinance amendi~ Ordinance ~25 to allow
residents using Indianapolis Water to receive summer sewer rates. Proposed
ordinance which was introduced at last meeting was read again by Mayor Pickett.
Councilman Coots moved to amend proposed ordinance to read that the effective
period of time for the relief to be July, August and September, Councilman
GsmTetson seconded it. Councilman Meacham felt the ordinance should include
all of the City of Carmel. Councilman Coots stated that the rationale for not
giving summer sewer rates was to prevent the residents from watering their law-ns
inasmuch as we do have a water shortage until the new facilities are built. That
rationale does not exist for the Briar Creek people. Motion to amend passed 5-2,
Councilmen Meachsm and Dean votin~nay.
Mr. Tom Coley, 10388 Briar Creek Place, stated he would just like to make a
couple of points for the residents: (1) They would agree to the July, August and
September dates rather than retroactive to May l, as they had requested originally;
(2) They use only Carmel sewer and not the water and they wanted to re-iterate
that the extra charge for sewer was not beio~ fair to them, but they wanted to
pay their fair share. They would agree to a credit being applied to their future
bills rather than a check bei~ issued.
Mr. ~_rthur Bahr, 2~2 Hawthorne Dr., stated he felt the City should tax the use of
water rather than the system. It seemed to him we were going to the wroD~ end of
the horse to take ca~e of the problem.
Mr. Ted Johnson, 317 Concord Lane, stated he ~greed with Mr. Bahr. The rate
system should be looked into for possible amendment.

Councilman Ga~retson, stated that the only reason given for not giving s~mmer
sewer rates was the argument of conserving water. Now that we are through
the critical time of summer and we didn't run out of water he would suggest
that we give a retroactive relief to all of the City.
Councilman Coots, stated without some basis for making a Judgment ~on the cost
of such a proposal, he did not feel he could support it. He also stated he
did not feel it would be fair to reward the people who ignored the request to
conserve water.
Councilwoman Re,man, suggested the Council act on the ordinance before them
and perhaps give some additional consideration to Councilman Garretson's
suggestion at the next meeting.
MaFor Pickett, stated he would have the water company look into the impact of
revenue and report back at the next meeting.
Mayor Pickett called for the question and it passed 5-2, Councilmen Dean and
Meachamvotingnay.
NEXT CITY COUNCIL MEETING: Councilman Garretson moved to hold the next City
Council meeting September 19th, Councilman Dean seconded it and it passed
unanimously.
AGENDA ITEM#U: CARMEL CITY COUNCIL COMMIT'±'~.',: INVESTIGATIVE REPORT -RECOMMENDATIONS:
Councilman Coots moved to add the Council investigative committee report on the
agenda, Councilman Ga~retson seconded it and it passed unanimously. Councilman
Coots stated this report was prepared after three sessions of investigative
hearings by members of the City Council and the report has been prepared in concert
through the contributions by each member of the City Council where they deemed
appropriate, editin~ and compilation by himself. Councilman Coots then read
the report. Copy attached to original minutes as a permanent record. Councilman
Coots moved for adoption of report, Councilman Dean seconded it and it passed
unanimously. Mayor Pickett stated he would reserve Judgment on the report
until he has time to review it and he would then make his personal comments
on it. He stated he did not agree with everythiD~ in the report. Councilman
Coots stated it should be stated that opportunity was givento him on two or
three occasions, and he personally did not propose to accept, at this belated
hour, any comment or suggestion or reputation to this report. Mayor Pickett
stated he didn't care whether Mr. Coots accepted it or not, as chief executive
of the City, it was his prerogative to m~e a report on anything he desired
to and he could do that at any time he desired to.
Councilman Swift moved to adjourn, Councilman Coots seconded it and it passed
unanimously at 8:27 PM.
