HomeMy WebLinkAboutCCM-02-07-77 MINUTES OF THE CITY COUNCIL MEETING February 7, 1977 The regular meeting of the City Council was called to order at 7:30 PM by M~yor Pickett, who presided. All members except Councilman Coots who arrived at 7:50 PM were present. City Attorney and Clerk-Treasurer were present also. Councilman Reiman gave the invocation. Mayor Pickett led the pledge of allegiance. L & N RAILROAD DEPOT: Mayor Pickett read letter frem L & N P~ilroad ~greei~ to extend the City's option t° purchase the railroad depot to April l, 1977. Mayor Pickett stated he had signed the extended option terms. Councilman Swift recommended the Mayor notify the Carmel Historical Society of his actions. M~yor Pickett stated he would notify Chairman John Holmes. FRINGE BENEFIT PROGRAM: Mayor Pickett stated that in the attempt to get a fringe benefit program put together, it appeared that the police and fire departments have some special situations in working hours, etc. and would need benefits of their own. Councilman Garretson asked if the Council would adopt the program for the employees other than the police and fire department. Mayor Pickett stated he would try to have it ready by next meeting. Councilman Garretson asked if the Council would be adopting the job classification in ordinance form. Mayor Pickett stated yes, in the near future. WA~R FACILITIES IMPROV]~NTS: Mayor Pickett stated that the contractors for the proposed water facilities improvements needed authorization for going ahead with shop drawings and ordering long delivery items. This would be at a total liability cost of $17,000.00 for the City. Mayor Pickett stated the Board of Public Works could go ahead with the authorization but it was felt they would like to be assured we would have financing in the form of a bond issue for the projects and the Council controlled that. Councilman Carretson moved that the Council go on record as favoring the authorization of the $17,000.00 for the water improvement project, Councilman Meacham seonnded it. Councilman Swift asked if McCullough & Associates would be appearing before the Council to discuss the financial analysis. Mayor Pickett stated yes. Councilman Swift stated he didn't feel we should use Revenue Sharing or Cumulative Capital Improvement money funds towards the water utility improve- ments because the utilities were revenue producers and should carry themselves. Motion passed unanimously. Councilman Garretson moved to dispense with the reading of the minutes amd approve them as received, Councilman Doane seconded it and it passed unanimously. pUBLIC OFFICIALS LIABILITY: Councilman Coots stated he had submitted information on the City Council, Boarm of ZoningAppeals and Plan Commission for three quotes on 100,000 - 1,000,000 public officials liability insurance. He received a quote for a total premium of $3,128.40 through the International Sumplus Lines Insurance Company which is a Chicago based company. Basically it is about the only company in the midwest that will write this type of coverage because Tom Quellhorst, Alexander & Alexander and M J United Insurance Agency, Inc. who submitted the information and it all came b~ck from the same company. The policy is for 100,000 per occurance and 1,000,000 accumulative for a period of one year and it excludes discrimination in employee hiring, Page 2 ~/7/77 termination of employment and does not include our utilities. It has a deductible of 2,500.00 per person for one year period of time it covers. The agent that prepared the quote would be willing to go over the terms of the policy. Councilman Coots stated for the dollar value he felt it was worthwhile for the City of Carmel to invest that amount of money to protect the City of Carmel. Councilman Coots then moved that the City Council resolve to purchase this coverage with the International Surplus Lines Insurance Co. through the agency of M-J United Insurance, Inc, 9000 H~gue Rd, Indianapolis, Councilman Meacham seconded it and it passed unanimously. ~ATER SERVICE BOUNDARY ~ME~: Councilman G~rretson stated he had had extended talks with Fred Hohl and others concernin~ the water service boundary area. Two proposed ordinances had been sent to the Council proposing to redraft the water service area. Councilman Garretson stated he had prepared a list of questions for discussion. Mr, Da~re~l,Bakken of Indianapolis Water Company, two representatives from SteegEngineers, City Engineer Fred Hohl and Utilities Manager, James Dougherty appeared before the Council to participate in the discussions. ~uestion ~l Does this new service area prohibit C~C from going north of l~6th in the future? ..Owen Kern: Yes, we can go up into that township with annexation or other- wise. Unless it is serviced by some other area, we could at a later date service that area if requested to. Mr.B~<ken stated IWC would like to enter into an agreement with Carmel as to what areas they would serve. .Question~: Does this new service area obligate C~C to Serve Mt. Carmel? Fred Hohl: We are not obligated to service any area outside the City limits. Question~: What is the additional cost to the Steeg estimates for including this new triangular area south to ll6th Street? .bob Coma ~of Stee~ Co: Just offhand we estimate somewhere between 6 - 700 thousand or i million. ~uestion ~4: How much of this additional area cost will the City have to absorb? Main enlargement? Reinforcement of present system? Treatment plant expansion? Bob Coma : I wouldn't even hazard a guess on that. I'm not familiar enough with the City's policy on re%imbursement policies, etc. Ma.¥or Pickett: We did have some concern over your fire flow figures being lower than Clyde E. William & ~ssociates ~report. ~ob Coma ; It would be a very good idea to have some one from the rating bureau come out and discuss this with you. Question ~: What will happen to the Meridian Corridor in terms of tim8 of development if we include west side of Meridian Street? Mr. Bakken: My reaction is that Meridian Street is a logical boundary beeause it is essentiallyundeveloped and who knows what is goin~ to happen out there? It is a limited access highway so nei!her one of us could lay a main in that right-of-way. Set that as a boundary then let the development come and when it does we can sit down and decide who can best serve it. This is the way we deal on a day to day basis with Cicero, Speedway and Lawrence. Counci}m~n Reiman: You say you work on a day-to-day basis yet a while back you wanted a written statement that we wouldn't extend our boundaries. _Mr. Bakken: We just want a written agreement that sets down the procedure where we work on the day-to-day basis. Page 2/7/77 Question ~6.: What are the comparable costs to a developer to bring water from Carmel to the west side of Meridian as compared to l~WC bri~ingwater to that area? Mr. Bakken: That is hard to answer and goes back to my suggestion of setting Meridian as a bo~uudary then when you have a specific development to talk about you can arrive at an answer. Councilman Dean: ~idelity Bank is on a well and a septic system. Mayor Pickett: Very probably there will not be extensive development there until ~uch time there is a sanitary sewer in the area. Counc_____~lman Coots: If we make the water availability attractive enough someone will come along and want to build badly enough to help finance the sewage there in addition to the federal government. ~uestion #~: What would be the additional cost to Steeg Report for servi~ the area between ll6th Street and lllth Street? Bob Com~: I don't have a cost just because of the time. The best indication you might use as a comparison, we believe it would probably take a new 16" main starting at the proposed new ground storage tar~k. Fred Hohl.; It might be more economical to use an alternative service. Owen Kern_: The reason we began instituting this service area was so the engineers could arrive at an acreage fee for water. When you leave the service area that will present a problem to the people trying to arrive at an actual cost per acre for water service. Mr. Bakken; I don't believe it will effect it that much. It is a give and take thing and wouldu't change it dramatically. Question ~8: Can the City annex an area into the City if it does not provide that area utilities? Councilman Garretsoq: Yes it can, as loD~ as there is a plan to serve the area~ M~yor Pickett asked if there were any comments from the public. Joe Dawson: You might check on that ll6th Street line. A lot of that is developed at the present time and I doubt if those people would want to pay the cost of rur~uing a water main down the streets and tying in. ~-.The ground that is left is not very desirable for such subdivisions. The Steeg Plan closely resembles the M~ster Sewer Plan of Carmel. Councilman Garretson moved for adoption of proposed Ordinance A-48 establishing service area for the Carmel Water system drawing the service line at 106th ~ast of Keystone and ll6th west of Keystone. Councilman Doane seconded the motion. Mr. Phil Hinshaw who was present, stated that he would like to point out a point of order and suggested the correct parlimentary procedure would be to either amend or repeal the present Ordinance #A-47 passed at an earlier date. Councilman Coots moved to amend the motion so that the title of proposed Ordinance A-48 was amended to read "An Ordinance to establish a service area for the Carmel water system and to repeal Ordinance A-47 passed August 30, 1976" and to the body of the ordinance as to it presently reads add the following language: That Ordinance A-47 passed August 30, 1976 is hereby repealed. Councilman Garretson seoon~ed the amendment and it passed unanimously. Ordinance was shown as bei~ introduced. Page 4 2/7/77 TRANSFER FUNDS: FIRE DEPT.: Mayor Pickett read proposed Ordinance ~B-108 transferring funds within the Fire Department Budget. Co~ucilman Coots moved to adopt proposed Ordinance ~B-108 as read. Councilman Doane seconded it. Councilman Garretson moved to suspend the rules, Councilman Meacham seconded it and it passed unanimously, main motion then passed unanimously. SALARY 0RDINANCE~D-108. Mayor Pickett read proposed Ordinance ~D-108 amending ~977 salary ordinance to authorize the hiring of a civilian communications operator and mechanic in the fire department effective February 15, 1977. Councilman Garretson moved for adoption of proposed salary Ordinance #D-108 as read, Councilman Reimam seconded it. Councilman Garretson moved to suspend the rules, Councilman Doane seconded it and it passed unanimously, main motion then passed unanimously. SALARY ORDINANCE ~D-10~: Mayor Pickett read proposed Ordinance ~D-109 amending the 1977 salary ordinance to increase the salary of Linda Graham to $7,800 effective February 15, 1977. Councilman Meachammoved to adopt proposed Ordinance #D-109, Councilman Swift seconded it. Councilman Doame moved to suspend the rules, Councilman Garretson seconded it and it passed unanimously, main motion passed unanimously. 0RDINANCE~D-110 R~T.~A~ING SEWER & DRAT~AGE RAR~W~ENT: Mayor Pickett read proposed Ordinance ~D-110 entitled ordinance approving partial release of sewer and drainage easement on lot ll in Eden Glen subdivision. Councilman Garretson moved for adoption of proposed ordinance as read, Councilman Doane seconded it. Councilman Coots moved to suspend rules, Councilman Ga~retson seconded it and it passed unanimously, main motion passed unanimously. LYNNWOOD FARM WELL SIT~,: Councilman Garretson :stated he would like to voice his approval of the Mayor's analysis of the Purdue proposal regarding the sale of a 160,000 square foot area on 126th Street, in that he could not go aloD~with their restriction that in the event the seller would develop the property known as Lynnwood Farms, they would be permitted to tap into the City of Carmel's water system for the use of such property for a "no tap fee" other than the actual cost of intercounection. Councilman Reiman asked if perhaps Purdue wasn't aware of the interpretation of the statement. Mayor Pickett stated they were perfectly aware of it. Councilman Garretson stated he didn't believe the Public Service Commission would allow that. INDIANAPOLIS WATER CO. AG~X~IT: Councilman Reiman stated she read the proposed agreement that Mr. Bakken passed out and noticed it stated that Carmel will not render water utility service outside of the Carmel water service area and he had stated earlier he would be agreeable to a day-to-day wait and see attitude as to who could best serve particular areas. Councilman Coots stated that was an agreement he had originally drafted back in May and is a matter that could be worked out. Mayor Pickett stated he was not ready to sign any agreement at this time. TOPICS EDITORIAL SUGGESTIONSy Councilman Coots stated he noted in the Topics~ newspaper a suggestion that the Council hold open meetiD~s to discuss with the citizens whatever problems they might have and he would think ~at after the regular meeting would be a good time for this kind of thing so that another night would not have to be set aside for that type of thing. Councilman Garretson stated he felt if that was done it should occur at the beginning of the meeting rather than at the end, Councilman Coots stated he felt the City's official businees had first priority. Mayor Pickett stated he had noted in the editorial a suggestion Page 2/7/77 to hold Board of Public Works meeti~~s in the evening ~nd he did not have the time for one more evening meeting.
