CITY COUNCIL MEETING
September 18, 1978
The regular meeting of the City Council was called to o~der at 7:30 PM by
Councilman Stan Meacham, who presided in the Mayor's absence. All members,
Clerk-Treasurer smd City Attorney were present.
Councilwoman Doane gave the invocation. Councilman Meachamled the pledge of
allegiance.
Councilman Coots moved to approve the minutes of the last meeting, Councilman
Swift seconded it and it passed unanimously.
OLD BusINESS:
AGENDA ITEM#l: REPORT FROM STAI~DING C0~ITTEE CHAIRMEN: Councilman Ge~rretson
stated the Public Policy Committee had met two times in executive session to
consider the potential purchasing of land for both short term and long term needs
of the City. He stated they felt they had made sufficient progress to request
a full meeting of the Council in executive session to discuss the alternatives
the committee is now exploring and to reach a consensus of the COuncil on further
pursuit of these alternatives and he asked that an executive session of the Council
be called following the regular Council session on 0ctober 2nd.
~%uucilman C~rretson stated the ~ublic Policy Committee will, come January, have
the results of the recent census data and will bring to the Council a proposal for
re-drawing the precinct ward boundaries in the City for the 1979 municipal election.
Councilwoman Reiman read letter from Executive Director of Chamber, Dorothy Smith,
which suggested a meeting of their Task ~orce and the City Council members to
discuss the Chamber's priorities for transportation improvements for the Carmel-
Clay a~ea. Councilman Coots suggested inviting the Industrial Commercial Committee
of the Plan Commission to attend the meeting. Board agreed to meet Wednesday,
0ctober hth at 7:30 PM to discuss this.
AGENDA ITE~: MCDONALDS ENTRANCE ON CArd, EL DRIVE: Councilman Meacham read memo
from Mayor which ~tatedMayor Pickett hadmet with-M~. Rothenberg and Mr, Marsh of
McDonald's Corp., Friday, September 15th and discussed with them the curb cut on
Carmel I~ive which had been requested by the Council at last meeting. Mr. Rothenberg
and Mr. Marsh both stated that the curb cut had caused no serious problem and they
didn't feel that a siguwould help. Mayor Pickett's memo stated that he felt
they would file suit if flLrther action was taken to close the entrance. Councilman
G~rre~son moved that the Council urge the City administration to take necessary
legal action through the coumts to bring about McDonald's compliance with the
initial order, Councilwoman Doane seconded it and it passed unanimously.

W00DSI Councilman C~arretson moved for adoption of proposed Ordinance
re-zoning ~9.39h acres from S-1 to S-2 which was introduced at last meetim~,
Councilman Coots seconded it and it passed unanlmously. Councilman Coots moved to
adopt Ordinance ~Z-l~6 re-zoning 39.66 acres from S-1 to S-2 which was introduced
last meeting, Councilwoman Doane seconded it and it passed unanimously.

PARKWAy: CSuncil~n Garretson moved to adopt proposed Ordinance #D-181
authorizing stop sig~s at intersections in Brookshire which had been introduced
at last meeting, Councilwoman Reiman seconded it. Councilman Horvath read a
statement listing reasons why he was opposed to the ordinance. Councilman
Garretson stated he felt the'stop signs would slow people down. Ordinance
passed 6-1. Councilman Horvath voting nay.

item be tabled due to earlier mention in Committee reports, Councilwom~ Reiman
seconded it and it passed unanimously.
AGENDA ITEM,s2: ORDINANCE ESTABLiSNT~G SPEED LIMIT ON BR00ES~,: PARKWAy:
Councilman Meacham read proposed Ordinance #D-183 establishi~ speed limit for
Brookshire Parkway and providin~ penalties for violation. Miles per hour was
blank as was location and fine. Councilman C-arretson moved to adopt the ordinance
to read 20 miles per hour on Brookshire Parkway from Gray Road to l~lst St. and
fine for-~iolation to be not in excess of $2~.00, Councilman Swift' seconded it.
City Engineer, Fred Hohl, stated he disagreed with the 20 mph limit because he
didn't feel it was a real clean way to handle it. He stated he felt also, in
cold weather, no-one can drive their car in the first l0 minutes after starting
under 2~ mph. He felt we shouldn't be lower than school zone limits. Councilman
Garretson stated the police departn~nt probably wouldn't enforce a violation of
speed limits unles& the person was exceeding it by ~ or l0 miles an hour. Therefore,
to get people to drive 2~ or 30 mph he felt they had to drop the limit to 20 mph.
Police Chief Barney stated it had been their experience with the courts that they
just wouldn't take them a few miles over the limit. He stated he f&~t 2~ mph was
low enough. Mr. Feldt stated Brookshire Homeowners felt Somerset Way East ~nd ~""~
South should be posted 20 mph. Brookshire Parkway could be 2~ mph. Mr. John Hensel
stated if he runs a farm tractor on the street at 20 mph he has to have a slow
moving vehicle sign on it. Councilman Swift moved to amend the ordinance to
read 25 mph, Councilman Garretson seconded it. Mr. Jim DeVoe asked if the City
had ever explored looking at Carmel as a whole and reviewing the speed law
requirements for the whole City as far as residential is concerned. Councilman
Garretson stated it had been discussed at about 4 or ~ meetio~s in a row.
Mr. Hensel suggested a committee discussing it with the City Judge and~the Police
Chief. Vote was called for on the amendment to 2~ mph. Vote was unanimous.
Councilman Garretson moved to table the ordinance until the second meeting in
October, Councilman Coots seconded it and itpassed 6-1, Councilman Swift Voti~
nay. Councilman Swift stated the Council should ask the Police Chief and the
City Engineer to proceed to another street of their choice where they think a
speed limit change is w~rranted. Councilman Ga~retson suggested City Engineer
and Police Chief Barney do a survey in the next two weeks on contours of roads
etc, not necessarily traffic studies.

Councilman Ga~Tetson moved for adoption, Councilman Horvath seconded it. Councilman
Garretson moved to suspend the rules, Councilman Swift seconded it and it passed
unanimously. Motion to adopt passed unanimously.

Oouncilnnmu Swift moved for adoption of Ordinance ~D-186 chan~in~ employee
Randy Strong from a superintendent in the Sewer department to a superintendent
in the Water department at the sane salary. Salary to be paid entirely from
Water department.
Police Chief Gary Barney stated an ordinance prepared dealt with his employees and
stated Mrs. Lawlor had explained that the two civilian employees, Sharon Green and
Sharon~ilbur, would be making $8,400.00 and beginnin&0ctober 1, 1978, CETA would
only allow $7,800.00 pay for workers in the Title II progran, therefore he was
requesting the source of funds to be changed to local beginning October let inasmuch
as both people s~re needed in his department. Also, La-ryE vans, policeman, ~ho is
currently being paid by Title VI funds has been on the progran for three years and
the new guidelines for Title VI would not allow anyone to start on the progran this
long and make over $12,000.00, therefore, he was re ues '

Clerk-Treasurer asked why that didn't apply to the Administrative Assistant to the
Mayor who was making $10,000;00 on Title II and there was no request to remove her
from the CETA program.
Mrs. Lawler stated the Mayor had called the Indianapolis office and got that position
exempted. She stated the Manpower office had explained that the position could be
left as is on Title lI until January let and if the City absorbed it then, the amount
of salary paid from Oct let - January let on that position would be subtracted from
the maximum allowed salary of $7,800.00 and the City could then look to hire some-
°ne for the remainder of the salary.
Clerk-Treasurer stated if that could be allowed for one position it should be
allowed for all positions ~n Title II.
Councilman Swift stated he didn't feel we were expending our every effort to get all
the money we can every where we can. He stated the Council deserved Mrs. Lawler's
word that she will expend her every effort to get all these people on a federal
manpower progran if she can.

Mrs. I~awler stated we could not pay CETA workers less than what we are paying other
employees in like positions.
Councilwoman Reiman stated she felt we should deal with all employees in the sane
manner. If we were going to wait until January to transfer one we should wait
until then to transfer the others.
Councilman Swift stated he didn't want to see any of the employees go orgetless than their
proposed salary, he just wanted to make sure all effort was expended to obtain funds
for all employees in a like manner.
Councilman Garretson stated he felt Chief Barney should do some soul searchin~ on
whether or not two $7,800.00 people paid for by federal government could do the job
these people were doing at $8,~00.00 because we are talking about a substantial impact
on our local funds when we came out with a rate bri~ing in less money than what we
budgeted for.

Councilwoman Doane stated she felt they should all be done the same.
Grdinance was not shown as being introduced. Upon ~herecon~endation of Councilman
Coots, Councilman G~rretson moved to amend Ordinance ~D-18~, passed earlier, by
deleting par~raphs numbered 3 and ~, Councilman Coots seconded it and it passed
unanimously.
