CITY cOUNCIL MEETING
August 21, 1978
The regular meeting of the City Council was called to order at 7:30 PM by
Mayor Pickett, who presided. All members, Clerk-Treasurer ~nd City Attorney
were present.
Councilwoman Do~ue g~ve the invocation. Mayor Pickett led the pledge of
allegiance.
Councilman Garretson moved to approve the minutes of the last regula~ meetiD~,
Councilman Swift seconded it and it passed unanimously.
OLD BUSINESS:
REPORT FROM STANDING COMMITT~ CHAIRMEN: Councilman Garretson stated the
Public Policy Committee would meet Monday, August 28th at 7:30 PM in executive
session to discuss acquisition of land.

a~nexing Mohawk Crossing, Councilman Horvath seconded it and it passed unanimously.
AGENDA ITEM'S2: MCDONALD'S: Mayor Pickett stated this past week he had had
discussion with Mr. RDthenberg and also MroGreggMarsh of MoDon~ld's. Before
they would m~ke any committment en this, they wanted to know if there was a
definite problem there. Mayor Pickett stated he contacted the police chief
on the situation and read a letter from Chief Barney stating there had been
approximately l0 accidents in the area of Carmel Drive and Keystone Way in the
last 12 months, however none were related to the entrance of MdDon~ld's
restaurant. Mr. Hohl stated perhaps a ,,problem" could merely be defined as
them not conforming to what they h~d promised to do when approval was given.
Councilman Ga~retson suggested Councilman Coots send a letter to McDonald's
with copy to Mayor bringing to their attention that a problem exists and that
they a~e in violation of the ~eement to which they were granted permission to
build there. Councilman G~rretson suggested putting this on the next meeti~ agenda
in September.
NEXT MEETING: Inasmuch as the first meeting in September falls on L~bor Day,
Councilm~nSwift moved to dispense with that Sept. ~th meeting, Councilman
G~zTetson seconded it and it passed~ously- Next regular meetiD~will
be September 18th.
NEW BUSINESS:
AGENDA ITEM#l: WATER EXPANSIONENGI~:~TNG FEES: CL~-DE E. WT~,~TA-IvIB & ASSOC:
Mayor Pickett read letter from Clyde E. Williams agreelm~ to accept $25,000.00 now
for engineeri~ fees for design of new water plant. Total fee to be approximately
$199,000.00. Mayor Pickett stated a meeting would be held in the morning
regardi~ land acquisition for a site for the new plant. Mr. Steve Ub~ick was
present and stated the schedule was tight and they were about two weeks behind
schedule now aud urged completion of details so they could get moving. Clerk-
Treasurer stated she felt we should see the proposed 1979 water utility budget
before committing that large a sum to one account. Utilities Manager stated
his budget would probably be submitted in late fall. Mayor Pickett read proposed
Ordinance #~-179 authoriziD~ $2~,000 expenditure from the utility budget.
Councilman Garretson moved to adopt proposed ordinance, Councilman Horvath seconded
it. Councilman Meachammoved to suspend the rules, Councilman Garretson seconded
it, and it passed unanimously. Motion to adopt passed unenimously. 0 [~

AGENDA ITEM,S2: RE-ZONEBLUE C~k~W~_WOODS _ DICE FISHER: Mayor Pickett read
resolution from Plan Commission to re-zone Blue Creek Woods 106th and Gray Rd
from S-1 to S-2. Mayor Pickett then read proposed re-zone Ordinance ~Z-155
re-zoning ~9.39~ acres of the proposed sub-division (Wehking property).
Cotmcilman Ga~,retson moved for adoption, Councilman Coots seconded it. Mayor
Pickett read proposed re-zone Ordinance ~Z-156 re-zoning 39.66 acres of the
proposed sub-division (Carter property). Councilman Garretson moved for
adoption, Councilman Horvath seconded ft. Ordinances were shown as being
introduced.
AGENDA tTEM#3: HAMILTON CABLE TV AVAT?.~iLiTY IN THE CARMEL AWW~ Council-
woman Reiman stated she had a call from a lady in Brookshire who was moving to
Carmel Town Condominiums and wanted to know when Cable TV would be available
there. The Chief Technical Assistant from Hamilton Cable TV was present and
passed out a progress report as attached to the minutes. Mrs. Lennon,
12~07 Teneelot Lane, was present and asked why they were plan_uing to serve
newly constructed areas ~ud not a~eas such as Carmel Town that have been around
for a while. Mr. Schoptopphorst stated because of location of aables.
AGENDA ITEM#U: SALARY ORDINANCE AM~-nMENTS: Mayor Pickett read proposed
Ordinance ~D-178 adding a new position of plant supervisor in sewer utility
at a salary of $13,000.00. Utilities Manager was present and s~ed this
position was requested by State Board of Health persuant to the sewer restrictions
at the north plant. Councilman Garretson moved for adoption, Councilman Coots
seconded it,~ Councilwoman Doane moved to suspend the rules, Coumcilman Swift
seconded it and it passed unanimously. Motion to adopt passed unanimously.
Mayor Pickett read proposed salary Ordinance #D-180 promoting James Morrison
from meter reader to chief meter reader s.nd changing source of funds f~ .
meter reader from federal funds to local utility funds . Council~n G~rrets0n
moved to adopt proposed ordinance, Councilman Horvath seconded it. Councilman
G~rretson moved to suspend the rules, Councilwoman Doane seconded it and it
passed unanimously. Motion to adopt passed unanimously.
AGENDA ITB~{#~: ~RANS~FUNDS ORDINANCE ~B-12~ Ma~or Pickett read proposed
Ordinance ~B-129 transferring funds within the MVH budget. Councilwoman Reim~n
suggested Mr. Hohl check to see if salt could be ordered through the state
highway department to save money. Councilman Garretson moved to adopt proposed
ordinance, Councilman Meacham seconded~it. Councilman Horvath moved to suspend
the rules, Councilman Meacham seconded it and it passed unanimously. Motion to
adopt passed unanimously.
AGENDA ITEM~6: TRAN~'~R FUNDS ORDINANCE ~D-l??: Mayor Pickett read proposed
Ordinance #D-177 authorizin~ additional e~penditures from the utility accounts.
Councilman Meachammoved to adopt proposed ordinance, Councilman Horvath seconded
it. Counci]m~u Ga~retson moved to suspend the rules, Councilma~ Horvath seconed
it and. it Pa~sed unanimously. Motion to adopt passed unan{mously.
AGENDA ITEM~?: BR00KSHIRE-STOP SIGNS: Councilman G~rretson stated he ~d asked
the police department to do a traffic study in the Brookshire area - especially
atthe two intersections they requested - Castle 0verl&ok and at Somerset Way East
and to survey Somerset Way South itself - the idea being- if the survey warranted
it - to drop the speed limit to 20 mph. Police Chief ~ry Barney read the
police department report atatinga patrolman had spent time at the intersection
of Brookshire Parkway and Castle Overlook. ~ifty-six vehicles went through the
intersection. Fourteen were exceeding the 30 mph sp~ed limit - 2 were running
37 mph - rest were running 3~ mph or less. Of the 22 cars tttrning at Castle Overlook,

only ~ stopped at the stop sign. The intersection of Royal Oak and Somerset
Way F~st, during this time there were eight vehicles tmrni~ from Royal Oak on
to Somerset Way East. Two vehicles failed to stop at the stop sign. Numerous
children on bikes were observed riding down the center of the street and cutting
back and forth in front of cars. At no time did one of these bicycles stop at
a stop sign. It was the opinion of the officer that the Council should write an
ordinance controlling speed on all city streets in Carmel set~ing the speed at
20 mph on some streets - others at 40 and 30. All Brookshire streets should
have the 20 mph speed limit due to the curvatureof the a~ea. It was the officer's
opinionthe Council should repeal all stop sign ordinances at intersections which
do not warrant 3 and 4 way stop signs. Councilwoman R~iman s~ated part of the
survey wasn't even at the corner requested. The following residents were present:
Linda Quigley - llgl~ Brookshire Parkway; Karen Nelson - 11902 Somerset Way South;
Mike Hussey - 11912 Brookshire Parkway; Dick ~eldt - 1203~ Somerset Way F~st;
M~linda Cravens - 12004 Brookshire parkway.
The residents stated their concern for children's safety. They also told of cats,
dogs aadm~ilboxes being run over.
Mr. Feldt, President of the Brookshire Homeowners Association, stated the
representatives voted 12-1 for the additional stop signs and stated the only
people affected by the ~igns would be the residents inasmuch as the streets are
not thoroughfares.
Councilwoman Reimau stated if Mr. Feldt had not been so fair the last time he
came before the Council and only asked for one stop sign when he could have asked
for more - the residents would probably have had their stop signs already.
Mrs. Ted Johuson stated that since a stop sign had been put at Lexin~ton and Altam
the s~&eding had stopped. S~ne felt even though people might not always stop at
the stop sign, they at least slowed down.
Councilman Swift stated it had been mentioned before but nothing had been done and
he would urge Chief Barney and City Engineer, Fred Hohl, to get together and get
some definite recommendations on speed limits on various streets in Carmel and
let the City Attorney prepare ordinances.

Counci~ Coots moved to adopt proposed ordinance, Councilm~. Garretson seconded
it. Councilmoman Reiman moved to suspend the rules, Councilman Meacham seconded it.
Vote was 6-1. Councilm=n Horvath voting nay. Ordinance was shown as bein~
introduced.
Councilman Garretson stated he would like an ordinance prepared for the September 18th
meeting on the basis of the police survey to lower the speed limits on Brookshire
parkway, Somerset Way South and Somerset Way East to 20 mph. City Attorney stated
~e recalled the Attorney Ce~neral's opinion states the speed l~m~ts are set at 30 ~ph
by state statue. That doesn't mean we can't pass one it just might mean it
couldn't be enforced. Councilman Garretson stated he woul~ like it prepared.

Councilman Coots recommended setting up a priority schedule for conducti~
surveys.
Councilman Coots moved to allow Councilwoman Reiman to add an item to the
~genda, Councilman Swift seconded it and it passed unanimously.
TREES: E~YSTONE SQUARE: Councilwoman Reiman stated she had received a lot of
calls about the trees that had been cut down at Keystone Square beside Noble
Romans and she would like Councilm~n Coots to research whether or not Wilfong
had agreed to leave the trees as a buffer. Mayor Pickett Stated he diS~u't
know wh~t could be done now the trees were already cut down. Councilwoman
Reiman requested the City Attorney research what action could be ta~&n if he
had agreed to leave them.
~MS FUNDS REQUEST: Councilman Swift asked Mayor Pickett if he had sent a letter
to the County Commissioners with~the resolution passed by the City Council
requesting aid from the County Council for ourEmergency Medical Service.
Mayor Pickett stated he had not had time but would get to it possibly this week.
He stated he had talked with Commissioner Davis about it.
There being~no further business the meeting was adjourned at 9:~0 PM.
