BOARD 01~ PUBLIC WORKS MEETING
July 11, 1978
Tbs regular meeting of the Board of Public Works was called to order at
3:05 PM by M~yor Pickett, who presided. All members and Clerk-Treasurer
were present.
Mr. Kern moved to approve the minutes of the last regular meeting, Pred Hohl
seconded it and it passed unanimously.

M~yor ~Piokett suggested the Board of Public Works approve the Jaycees
roadblock subject to the sane stipulations as last time. Mr. Kern moved
to approve it subject to the conditions we had before as outlined in their
letter of August 23, 1977, Mr. Hohl seconded it and it passed unanimously.
SEWER & WAqmm CONNECTION FOR C~WAL O,W~TSTIAN CHUHCH. 250 EAST 136th STREET-
WEST OF MOUNT CARMEL - MR. BILL JUDD: Mr. Alan Eiler appeared to represent
the Central Christian Church reques b. M~yor Pickett said the only problem he
could see concerning this would be that we have no water or sewer lines out
there. Mr. Kern asked if it had been built yet. Mr. Eiler said the ground
was paid for and they have submitted drawings from an architect to a bonding
company. They are ready to issue bonds and would llke to break ground next
month but they have this problem of water and sewage hook-up. Mayor Pickett
asked if they had contacted Mr. Wilfo~. Mr. Eiler stated that they really
didn't know which way to go but had talked to him preliminarily. They were
informed that they should come here and got permission to eider seek a
hook-up with him or possibly a well with septic tank. Mr. Hohl stated we had
no sanitary sewer available. Mr. Eiler said that they had been informed that
they could run a line from the City's neamest point if they paid for it.
Mr. Kern said we couldn't really make a decision until2.we knew what Wilfong
was going to do. M~yor Pickett said they could 8_rill a well. The City does
not have any jurisdiction out there. Mr. Kern suggosted Mr. Eiler get a
statement from R~lph Wilfong as to whether or not they can hook on to his
sewer end water. If he turns them down or gives them a price that is
unreasonable, simply write a letter to the Mayor giving him the results from
Ralph Wilfong.
MAW~q~AT,I, ANDISH-USE OF UNAPPROVED AT,T,~ff AT 291 SOUTH RANGELIIIE ROAD:
Marshall Andish appeared before the Board. Mr. Kern stated in vie~.~ of the fact
we don't know if we own the alley or not, we would have no objections to him
blacktoppi~ it subject to any private party rights. Mr. Kern suggested that
Mr. Andish write letters to adjoining property owners giving them 20 days
notice and then get b~k to the Board.
BID AWARD ON STORE SEWER - RANGELINE ROAD.: Mr. Hohl stated we had only received
one bid, but it wouldn't be worth it to advertise again~ Mr. Kern moved to
accept the bid of Chandler Construction Co. for storm sewer construction,
Mr. Hohl seconded it and i~ passed unanimously.
PUBLIC WOPdfS INSPECTOR RETURSTING TO WORK: M~yor Pickett stated this was an
employee who quit and went to work for ~-.~.contractor. He was gohe about 3 weeks
and now was wantiD~ to come back to work for the City. Mr. Kern asked if he
gets all his goodies back. The Mayor stated he agreed to hire him back.
Mr. Hohl said he ha~ been hired back. He stated the thing in question is the

accumulated sick leave, which is af lesser significance to him, and the other
is longevity where he would be entitled to 3 weeks vacation. Being just a
new-hire would put him back to one week. Mr. Hohl stated he left in good
standing, was a good employee, and gave proper notice before leaving and we're
very happy to get him back. He stated he would favor continuing his longevity.
The Mayor said it would set a precedent and would create some problems. He
also said he didn't think we could extend sick leave to him that he had
accumulated because he did terminate. The Mayor saidhe theught ~he +~h~ng thefts
really in question is whether he can start accumulating vacation again
and retain this 3 weeks. Mr. Kern a~k~d what authority do we have to vary
all these things. Mr. Hohl stated we don't have any policy that states what
we will do. Mr. ](em said we have a policy that says how long you've been
here, what yqu get. Mr. Hohl said our policy doesn't state that if you've
worked here previously that yo~'.~re credited with that ur not. It doezL~'t
say it doesn't and it doesn't say it does. The~yor stated its assumed when
someone leaves everythi~ is terminated. He stated he thought there is a legal
point here and that ~m~ what he brought up when he talked to Mr. Hohl and the
employee. Mr. Kern stated he thought it was a bad policy. Mr. Hohl stated when
they talked to the employee in the Mayor's office that the Mayor was very
straight forward a~d told Raudy, the employee, that he would do everything he
could to see if we could continue thais but he wanted to check into the legnlity
of this. But that's not what the Mayor is saying now. Mr. Kern asked what
the Mayor wa~ted to do. ~he Mayor asked what the legal implications is here.
Mr. Kern stated he didn't think~ there were any. He stated he didn't think
anyone was goi~ to tske us to court over this. Mr. Kern stated it would be
left up to the Mayor because Mr. Hohl was for it and he was against i~. The
Mayor said we have to be consistent in these things. Mr. Hohl made the motion
that the sick leave be terminated but for the pg~pose of giving vacation,~
that the previous service with the City be co~uted for lengevity, Mr. Kern
seconded it . Motion failed i aye ~ nays, Mr. Kern and the Mayor voting n~y.
AG~ TO BE SIGNED BY LUMB~R MART & HAMILTON COUNTY FOR GRA~ BB: Mr. Hohl
read proposed agreement with respect to road work between the City of Carmel,
Lumber Ma~t and the H~m~lton County Board of Commissioners regardi~ real
estate bounded on the east by Gray Road, on the south by 126th street and the
north by 131st street, copy attached to minutes. Mr. Kern moved the agreement
be approved and that a~ter they have completed the agreement, the City will
ts~ke over maintenance, Mr. Hohl seconded it and it passed unanimously.
CLA~ME: Mr. Eernmoved to approve claims numbering#2818 thru#~2?0 totaling
~¥~,~8.17, Mr. Hohl seconded it and it passed ~uanimously.
RECODI~ICATION OF 0RDTN~NC~.M: Clerk-Treasurer presented rough draft of
recodification of ordinances and asked the Board to review it and place it on
the next meeting a~enda for discussion.
LETTER ~F AGR~ENT - HAVEP~TICK MI~.T~: TEST DR~T.T,TW~: Mayor Pickett read
letter of agreement as attached to minutes giving the City permission to test
drill for water on H~verstick Farms.
~LYDE E. WILLIAMS AG~:~:~EN~: Mr. Hohl read copy of proposed agreement with
Clyde E. Williams regarding engineering services re~ted to test borings for
wells for the new ~ater treatment plant. Mr. Hohl moved to approve agreement
for a cost not to exceed$~,000 subject to financing, Mr. Kern seconded it
and it passed unanimously.

RIDING MOWER: Mr. Hohl recommended purchasing a riding mower to replace the
mower which-~was broken. M~yor suggested checking several places for prices.
Mr. Hohl moved to approve purchasing a riding mower not to exceed $770.00,
Mr. Kern seconded it and it passed unanimously.
There being no further business the meeting was adjourned at 4:45 PM.
