Dear John T and Brenda S Reisinger:
The improvement request that you sent in regarding a Swimming Pool, concrete/pavers around
pool and covered pergola was received and approved by the Architectural Control Committee.
The amended request (either concrete or paver) was approved with the following
conditions:
1. There are no permanent structures (i.e. buildings/retaining wall/constructed
improvement with foundation) located with the established drainage easement.
2. The homeowner understands and agrees that if the improvements within the easement
are ever disturbed by any entity having rights to the easement area, there is no obligation
by that entity to restore or replace the disturbed area. All necessary restoration/repair is
the sole responsibility of the homeowner.
3. Homeowner shall provide a copy of the City of Carmel approved Encroachment Permit
to the Board and Robin Guyon for the HOA records.
• You are still required to follow up with your local municipality to determine if a permit is
necessary for your improvement.
• It is highly recommended that you have the property lines properly marked before any
fence installation.
• If your improvement is going into an easement- be aware that if the local utilities or
city/county need access to this easement they can require you to remove your improvement
at your expense.
You have 90 days from beginning of the project to complete the updates unless you apply to the
committee for an extension.
