CITY COUNCIL MEETING
SEPTEMBER 17, 1979
The regular meeting of the City Council was called to order
at 7:30 p.m. by Councilman Coots who presided in the absence
of the Mayor. All members and Clerk-Treasurer were present.
Councilwoman Doane gave the invocation, Councilman Coots led
the pledge of allegiance.
Councilman Swift moved to approve the minutes of the last
meeting, Councilman Horvath seconded it and it passed
unanimously.
OLD BUSINESS :
Agenda Item #1 Report from Committee Chairmen : Councilman
Garretson stated the Public Policy Committee had met two
weeks ago and had discussed with the owners of property at
Main Street and First Ave. N.W. the possible acquisition of
property approximately 4 acre. Price being discussed was
$50,000.00. The Mayor i8 to have an appraisal made. Mr.
Garretson moved that the Council go on record as favoring the
purchase as long as the price does not exceed $50,000.00 and
as long as a seperate appraisal shows that it is worth
$50,000.00 and that and the owners of the property
the Mayor
work out an agreement and bring it back to the Council for
approval prior to consumption. Councilman Meacham seconded it
and it passed unanimously. Mr. Terry Beatles was present
representing the owners. Councilman Coots suggested this be
put on the agenda for next Council meeting.
Councilman Coots stated everyone had responded to the letter
he sent regarding the EMS Committee and he would try to have
a meeting next Wednesday. Clerk Treasurer stated the Committee
reviewing the Re-codifying of the City Ordinances met and
finished their review of the rough draft .copies of proposed
new ordinances to be included in the re-codification would be
mailed out within the week to be approved at next Council
meeting.
Councilman Coots stated the sub-division Control Ordinances
and the Zoning Ordinances would be publically heard in
October and hopefully come to the City Council in November
for passage.
NEW BUSINESS :
1: Public Hearing - Ordinance D-226 -

portion of the Moffitt drain referred to was Woodland Section
IV. Mr. Hohl stated yes, precisely the northwest corner of
106th and Haverstick. He stated the situation was such that
the eroding water was eating the sides of the ditch back and
it had reached the point it was about 18~ from the patio of
the house. The owner has spent quite a bit of money rip-
rapping it. There are problems along the creek.

Councilman Coots asked the result of
conversation with the developer. Mr. Hohl stated he thought
the developer had no intention of paying the cost. He
stated he thought there would have to be
a suit filed. Councilman Garretson stated he felt
we were starting a costly precedent if we go
ahead with this and was apposed to spending money
for this project inasmuch as there was a need
in Old Town Carmel for storm drainage
construction. He stated he would urge that it
be withdrawn. Councilman Coots

asked Mr. Hohl to see that the original plat and Plan Commission
minutes be pulled for when that sub-division was platted to see if the
developer made any representation as to what would be done to protect
those homes from erosion. Ordinance was shown as being introduced.
Agenda Item #2: Public Hearing Ordinance D-227 - Appropriating Funds
from Local Road and Street Fund : Councilman Coots read proposed
ordinance D-227 which repeals Ordinance D-217 appropriating funds from
the Local Road and Street Special Distribution Fund and appropriates
$154,000.00 from the Local Road and Street Fund. Clerk-Treasurer
explained the State Board of Accounts recommends there no longer be a
Local Road and Street Special Distribution Fund, therefore the balance
in that fund was transferred to the Local Road and Street Fund and a
public hearing was needed to appropriate the mcney from that fund.
Council man Garretson moved for adoption of Ordinance D-227 Councilman
Horvath seconded it. Councilwoman Doane moved to suspend the rules,
Councilman Swift seconded it and it passed unanimously. Motion to
adopt passed unanimously. There were no comments from the public.
Agenda Item #3: Ordinance #B-150 Transferring Funds Within the MVH and
Fire Budgets : Proposed ordinance B-150 was read by Councilman Coots,
Councilman Garretson inquired as to why the Fire Department needed to
transfer money into the water and sewer accounts. Fire Chief Swails
stated a meter had been placed on fire station one and he received a
$500.00 bill. Mr.Hohl suggested the bill may be in error. Councilman
Garretson moved to amend the ordinance by striking the transfers to
water and sewer, Councilman Swift seconded it and it passed
unanimously. Councilman Swift moved to adopt the amended ordinance
Councilman Meacham seconded it. Councilman Garretson moved to suspend
the rules, Councilman Horvath seconded it and it passed unanimously.
Motion to adopt passed unanimously.
Keystone Square Streets : discussion was held regarding the Board of
Works Aintention to accept the streets in Keystone Square Shopping
Center. Council man Garretson moved the City Council resolve that they
are against the acceptance of Keystone Way into the City until there
has been some kind of formal and acceptable response to the questions
raised in last meeting and this meeting, Councilman Horvath seconded it
and it passed unanimously.
Agenda Item #4: Appeal to the State Tax Commissioners : Councilman
Swift moved that the Council resolve to petition for an appeal to the
State Tax Commissioners prior to the October 1st deadline for relief
from the 1979 state tax laws. Councilman Garretson seconded it and it
passed unanimously.
Added Item : Councilman Garretson stated there is an increasing problem
with bicycle traffic and youngsters not obeying stop and yield signs.
He stated he understood Kokomo had a bicycle ordinance and would share
it with other members of the Council when he receives it for a
possible task force to be appointed.
There being no further business the meeting was adjourned at 8:35 p.m.
