CITY COUNCIL MEETING
NOVEMBER 2, 1981
The meeting of the City Council was called to order by Mayor Reiman at
7:30 P.M. on November 2, 1981. Council members Garretson, Fleming,
McMullen, Johnson, Walker, Shepherd and Kerr were present. Also
present was City Attorney, Mike Howard and Clerk-Treasurer.
Police Chief Jerry Lowe introduced Uncle Sonny and Huggy the Robot.
Huggy and Uncle Sonny had visited the schools and talked to the
children about safety.
Mrs. Kerr made a motion to approve the minutes of October 19, 1981.
Motion seconded by Mr. Walker and passed unanimously.
Old Business
Public Hearing - Ordinance Z-180 - Frye Rezone - Mr. Garretson made a
motion to introduce Ordinance Z-180 and waive reading of same. Motion
seconded by Mr. Fleming. Attorney E. Davis Coots made a presentation
for the Petitioner, William Frye. Public Hearing was opened at 8:08
and Moe Silverman, 1507 East 116th Street; Sally Bratton 11535 Ralston
and Judy Silverman 1507 East 116th Street, spoke against the rezone.
Ila Badger, 3039 Rolling Springs Drive stated she felt Mr. Frye was
already in violation of the Home Occupation regulations. There being
no one else from the public wishing to speak on the subject, the
public hearing was closed at 8:21. The Council then discussed tlhe
matter and asked questions of Petitioner's Attorney. This item will
come before the Council for vote on November 16th.
Ordinance C-76 - Annexation at Northeast Corner of 116th Street and
Meridian Mr. Rick Rembusch appeared before the Council with the map of
the property they had requested at the last meeting. After perusal of
the map Mr. Garretson made a motion to approve Ordinance C-76.A Motion
seconded by Mr. Johnson and passed 6-1; Kerr voting nay because of her
disapproval of lasso annexation.
Ordinance D-316 - Ordinance amending Fringe Benefit Ordinance - Mr.
Garretson made a motion to amend Ch-dinance D-316 by striking all of
the Ordinance proposed last meeting and inserting the Ordinance
presented this evening. Motion seconded by Mr. Johnson and passed
unanimously. Mr. Walker made a motion to amend the amendment to insert
the sentence "Compensatory time earned shall be used in same pay
period." and to change the wording so that overtime shall be approved
by "department head" instead of supervisor as the amendment now reads.
Motion seconded by Mrs. McMullen and passed unanimously. Vote was
taken on Ordinance D-316 as amended and passed unanimously.
Ordinance B-206 - Transfer of Funds Plan Commission - MR. Garretson
made a motion to introduce Ordinance B-206. Motion seconded by Mrs.
Kerr. Mr. Walker asked what the money was to be used for and Mrs. Kerr
replied for a study of Keystone Square traffic, an industrial study
and condensation of the sign ordinance. Mr. Johnson made a motion to
suspend the rules and act on Ordinance B-206 tonight. Motion seconded
by Mrs. McMullen and passed unanimously. Vote was taken on Ordinance
B-206 which passed 6-0-1; Walker abstaining because he disapproves of
the money being spent on the Keystone Square traffic study.
Ordinance D-318 - Ordinance regarding traffic signs at 4th Avenue S.E.
and Carmelview Drlve - Mayor Reiman read a letter from Chief Lowe
(attached) regarding the traffic at Carmel Elementary school. Mr.
Johnson made a motion to introduce Ordinance D-318 providing for a
stop sign northbound on Carmel Elementary Driveway at Carmelview Dr..
Motion seconded by Mrs. McMullen. Mr. Johnson made a motion to suspend
the rules and act on Ordinance D-318 tonight. Motion seconded by

Mr. Walker and passed unanimously. Vote was taken on Ordinance D-318
which passed unanimously.
Council meeting was recessed at 9:05 and reconvened at 9:15.
New Business
Public Hearing - Ordinance Z-181 - Carmel Research and Development
Park Rezone Mr. Garretson made a motion to introduce Ordinance Z-181
and waive reading of same. Motion seconded by Mr. Walker. Mr. Leroy
New, Attorney for Petitioners; Al Oak from Paul Cripe, Inc.; Mr. Altum
from Altum Landscaping and Mr. Rick sterns from Bartom~Ashman appeared
before the Council and presented the Petitioners' request for rezone.
Public Hearing was opened at 10:00 and Eugene Skodzus, 509 Oak Drive,
Vice-President of Wilson Village Homeowners Assn.; Dick Geib, 16 Shady
Lane; Karen Huff, 21 Sleepy Hollow; Laurie Hackett, 1309 Lynne Dr; Bob
Blakeslee, 345 Winding Way; Susan Brown, 1030 S. Guilford; Eileen
Takach, 519 Oak Drive; Bill Homrighausen, 335 Winding Way and Steve
Kannard, 921 S. Guilford spoke against the rezone. John Kirby, 21
Lakeshore Court, President of the Carmel-Clay Chamber of Commerce
voiced the Chamber's support in favor of the rezone. John Gradle,
10660 Highland Drive and Ron Rich, 222 Beechmont Dr. also spoke in
favor of the rezone. Paul Estridge, Jr. asked if the covenants
submitted for the project were enforceable. Mr. Howard stated there
were several ways provided for the enforcement of the covenants. There
being no one else from the public wishing to speak on the rezone, the
public hearing was closed at 11:07. The Council asked questions of
Petitioners' representatives. This item will come before the Council
for vote on November 16.
Public Hearing - Ordinance Z-182 - Ed Tutweiler Cadillac Rezone - Mr.
Walker made a motion to introduce Ordinance Z-182. Motion seconded by
Mr. Fleming. Attorney E. Davis Coots made a presentation for the
rezone at 103rd and Meridian on behalf of Petitioner. Public Hearing
was opened at 11:52 with no one wishing to speak to the issue. P~blic
hearing was closed. Council asked questions of Petitioner's
representative. This item will come before the Council for vote on
November 16.
Ordinance B-205 - Transfer of Funds - Police Department - Mr.
Garretson made a motion to introduce Ordinance B-205 and waive the
reading. Motion seconded by Mr. Johnson. Mr. Garretson asked Chief
Lcwe about the transfer into other supplies and Chief Lowe Explained
that it was for ammunition used in training. Mr. Garretson stated he
felt the department should plan the use of ammunition for train m g to
stay within the bound aries of the budget. Mr. Walker made a motion to
suspend the rules and act on Ordinance B-205 tonight. Motion seconded
by Mr. Fleming and passed unanimously. Vote was taken on Ordinance B-
205 which passed 6-1; Garretson voting nay.
Discussion of Sign Ordinance - Mr. Johnson requested that due to the
late hour this item be tabled. Said item tabled until Nov. 16.
Change of Title for Building Commissioner - Mayor Reiman stated that
this Ordinance had first been presented to the Plan Commission for
recommendation.
116th Street-Meridian Street Expansion - Mr. Garretson requested this
item also be tabled. Said item tabled until Nov. 16.
Mr. Walker stated he felt there should be no more than one public
hearing scheduled at any Council meeting.
