CITY COUNCIL MEETING
NOVEMBER 15, 1982
The meeting of the City Council was called to order by Mayor Reiman at
7:30 P.M. on November 15, 1982. Council members Kerr, Shepherd,
McMullen, Walker, Garretson, Fleming, and Johnson were present. Also
present was City Attorney, Dave Coots and ClerkPTreasurer, Dottie
Hancock.
Mr. Johnson gave the invocation which was followed by the Pledge of
Allegiance.
Mrs. Kerr read a Council Resolution commending the State Champion
Girl's Cross Coun try Team, and Mrs. Hancock distributed awards to the
team. Mr. Garretson read a Council Resolution commending the State
Champion Boy's Cross Country Team, and Mr. Shepherd distributed awards
to the team. Mr. Walker read a Council Resolution com mending the State
Champion Cross Country Coach, Chuck Keoppen, and Mayor Reiman pre sented
Coach Koeppen with a "Key to the State" lapel pin. Mr. Garretson made a
motion to adopt the resolutions read. The motion was seconded by Mr.
Walker and passed unanimously.
Mrs. Kerr made a motion to approve the minutes of the November 1,1982
Council meet ing as presented. The motion was seconded by Mrs. McMullen
and passed unanimously.
OLD BUSINESS
PUBLIC HEARING --ORDINANCE Z-189 - REZONE FOR MANUFACTURING ZONE - Mr.
Garretson made a motion to introduce Ordinance Z-189 and dispense with
the reading of same. The motion was seconded by Mr. Shepherd. Mayor
Reiman opened the meeting to a public hearing on Ordinance Z-189. Mr.
Leroy New, attorney for Carmel-Guilford Associates, presented
information in favor of the rezone for the petitioners. Mr. New was
accompanied by Mr. Al Oak from Paul I. Cripe and Mr. John Meyer from
HNTB. Persons speaking against the rezone were: Dave Gagermier, 11
Sleepy Hollow Lane, and Steve Harlow, attorney for Wilson Village
Homeowners, who raised a legal question based on I.C.36-7-4-607. Others
speaking against the rezone were Sally Bratton, 11535 South Ralston,
from the South Central Clay Residents Assn; Mr. Ed Spooth, independent
appraiser for Wilson Village Homeowners; Mr. Steve Kinnaird, 92, South
Guilford; Ann Hartman, 355 Guilford, Michael Clark, 15 Sleepy Hollow
Lane, Jim Bradley, 10124 Guilford Avenue, and Laurie Hackett, 1309
Lynne Drive. The pub lic hearing was closed at 9:25.
The meeting was recessed at 9:25 and reconvened at 9:30.
Mr. Garretson requested that Mr. Coots research the legal question
raised by Mr. Harlow and the legal enforceability of the covenants
attached to the plans for the manufacturing zone. Mr. Garretson also
raised the question of building in the area before a road was built to
U.S.31. Mrs. McMullen stated that one of the criteria for passage by
the Plan Commission was that no building permit would be issued un ~
s~'~ til the road to U.S.31 was completed. Mr. Walker asked Mr. New if
he would re ~ spond in writing to the five listed determinations in 36-
7-4-918(f) by the next meeting. Mr. New replied that he would do so.
Mrs. Kerr stated that she felt the route for the road should be
determined and should go straight throu~h rather than meandering.
Further discussion was had. The vote on Ordinance Z-189 will be on
December 6, 1982.

PUBLIC HEARING - ORDINANCE D-355 -ADDITIONAL APPROPRIATION - Mayor
Reiman opened the meeting for public hearing on the additional
appropriation in the amount of $20,000.00 from the general fund
for a police firing range and $50,000.00 from the MVH for a dump
truck with snow balde for the street department. There was no com-
ment from the public. Mayor Reiman closed the public hearing. Call
was made for vote on Ordinance D-355 which passed un~nimously.
ORDINANCE D-357 - AMENDMENT TO SALARY ORDINANCE - Mr. Walker made
a motion to in troduce Ordinance D-357. Motion seconded by Mr.
Johnson. Mayor Reiman had sup plied the Council with pay rates for
police and fire dispatchers as requested.' Discussion ensued as to
proper wage for a full-time position of secretary in the street
department, or the alternative of hiring another part time person
for the additional 12 hours per week. Following discussion, Mr.
Johnson made a motion to amend Ordinance D-357 inserting the full-
time salary of $10,000.00. Motion was seconded by Mrs. McMullen.
Motion failed 1-6, Mr. Johnson voting aye. Mr. Gar retson made a
motion to table Ordinance D-357, suggesting the Mayor get together
with Mr. Coots to discuss creation of an entry level in the
personnel policy. The motion was seconded by Mrs. Kerr and passed
unanimously.
SIDEWALK DISCUSSION - Mr. Garretson asked the Clerk-Treasurer the
sums in the Cu mulative Capital Fund and Revenue Sharing Fund. Mrs.
Kerr made a motion to table this item until the next meeting shen
the Clerk-Treasurer would have a chance to determine what funds
could be used for sidewalks and the amounts possibly ava able.
Motion seconded and passed unanimously.
NEW BUSINESS
TRANSFER OF FUNDS - FIRE DEPARTMENT - Mr. Garretson made a motion
to introduce Resolution 11-15-82-3 to transfer funds in the fire
department to pay for new radio equipment. Motion seconded by Mr.
Fleming. Following discussion, vote was taken on Resolution 11-15-
82-3 which passed unanimously.
ORDINANCE D- 358 -PROPOSED TAXI ORDINANCE - Mr. Fleming made a
motion to intro duce Ordinance D-358 and dispense with reading of
same. Motion seconded by Mr. Shepherd. Mr. Fleming introduced Mr.
William Lambert, who is a resident of Westfield and owner of the
helicopter service there. Mr. Lambert stated he had operated a
taxi service in Rushville, Indiana for about 13 years before
moving to Carmel. Mr. Lambert stated he was interested in starting
a taxi service in Carmel, but he would like for the existing
ordinance on taxi licensing be repealed and the ordi nance he had
furnished the Council be adopted. Mr. Shepherd suggested that this
be taken up at the December 6 meeting after the Council had a
chance to compare the two ordinances.
OTHER BUSINESS
Mr. Garretson requested Mr. Coots prepare an ordinance for the
first meeting in January changing the speed limit to 35 miles per
hour on Rangeline Road between 116th Street and 126th Street and
on East Main Street between Keystone Avenue and Gray Road.
Mr. Shepherd stated he had received a telephone call from a
resident in Wood Creek Addition asking if the city took care of
snow removal in the area and complaining that the Post Office
refused to deliver mail in the area due to the low number of
houses at this point. Mayor Reiman stated the City did plow the
streets in the addition and that she would look into the matter of
postal delivery.

There being no further business to come before the meeting, the same
was duly adjourned at 11:05 P.M.
