MINUTES OF THE
CARMEL CITY COUNCIL MEETING
OCTOBER 4, 1982
The meeting of the Carmel City Council was called to order by Mayor
Reiman at 7:3~ P.M. on October 4, 1982. Council members Fleming,
Garretson, McMullen, Kerr, Shephard and Walker were present. Als~
present was CiAty Attorney, Dave Coots and Clerk-Treasurer
representative, Marilyn Martin.
Invocation was given by Billy Walker followed by the Pledge of
Allegiance.
Mayor Reiman introduced a guest, Janet Green who is a student of
Brebeuf, to the Council.
Frank Fleming made a motion to approve the minutes of September 20,
1982. Jim Garretson seconded. Passed unanimously.
Ordinance Z-185, Proposed Fee Schedule for Department of Community
Development Mayor Reiman asked Sue McMullen to update the Council
re~arding this ordinance. Mrs. McMullen explained that questions had
come up regarding the inspection fees and whether residential and
commercial should have the same type of fees, so this ordinance was
referred back to the Department of Community Development to work up
something more palatable to the builders. Chuck Kiphart explained some
recommended changes that had been made after talking to Mr. Nickell, a
Carmel builder, and several other developers. Mr. Nickell asked if he
could present his own fee schedule separately tonight. Discussion
ensued and the Council stated that there were substantial changes from
the document as originally passed by the Plan Commission to the Council
and that the whole document should go back to the Plan Commission to
review the proposed changes made by Mr. Kiphart before the Council
takes it up. Jim Garretson moved that this ordinance be remanded back
to the Plan Commission to review the changes made by Mr. Kiphart and
then brought back to the council after their review. Mrs. Kerr
seconded. Passed unanimously.
Ordinance Z-186, Will Wriqht Rezone - Will Wright addressed the Council
regarding the area located on Haverstick Road North of Blue Woods Creek
to be rezoned from S1 to S2. The area will contain approximately 68
lots. Jim Garretson moved that this ordinance be A.introduced and the
reading be suspended. McMullen seconded. Sue McMullen stated that this
rezoning had been unanimously recommended by the Plan Commission.
D~d~Shepherd moved that the rules be suspended and to act on this
ordinance this evening. Virginia Kerr seconded. Vote taken on Ordinance
Z-186. Passed unanimously.
Transfer of Funds- Department of Community Development - Chuck Kiphart.
Sue McMullen moved for introduction of Resolution 10-4-82-1. Seconded
by Jim Garretson. Discussion ensued in which Mr. Kiphart explained the
reason for the transfer of funds for duct work for his office. The
account of Furniture and Fixtures was questioned as to whether that was
the right account to transfer the money into.
Motion was made by Mr. Garretson to amend the Resolution by striking
the $150 amount from Account 2201 to Account 4501 for duct work,
stating that an account should be created for this item. Seconded by
Frank Fleming. Vote taken on Resolution 10-4-82-1. Passed unanimously.
Review of Noise Pollution Ordinance - Mayor Reiman stated that
her office is receiving calls regarding noise pollution such as
dogs barking, vehicles being worked on at homes at hours that
disturb neighbors, and a restaurant with a loud speaker outside
entertaining the people waiting to enter the restaurant but not
the residents that could hear the speaker noise. Last year IACT
brought on a full time man, Brad Garten, because other cities
received complaints regarding noise pollution. Mayor Reiman said
she would like the Council to appoint a committed of three (3) to
review model ordinances from several other cities so as to bring
ours more in line with regard to noise. She stated that some
cities, such as Frankfort, have a sign as you enter the city
stating they are on the lookout for noise pollution. Jim
Garretson thought we ought to review the ordinances but that we
should consider that some noise is natural and that we couldn't
expect the city to be a "funeral home or a library" and that some
noise cannot be avoided.
Virginia Kerr suggested that if there were enough copies that
each Council member should have one to review and consider if
further action needed to be taken. Discussion ensued and copies
were passed out to the council members. Dave Coots stated he
thought that laws that couldn't be uniformly applied should not
be on the books.
Transfer of funds - Fire Department - Steve Couts. Sue McMullen
moved to introduce Resolution 10-4-82-2. Seconded by Billy
Walker. Jim Garretson asked for the question. Vote was taken.
Passed unanimously.
There being no further business to come before the meeting, the
same was duly adjourned at 8:40 P.M.
