CARMEL CITY COUNCIL MEETING
SEPTEMBER 13, 1982
Billy Walker, President of the Council, called the meeting to order
with Council members Johnson, Fleming, Garretson, McMullen, Shepherd
and Kerr present. Also present were City Attorney, Dave Coots and
Clerk-Treasurer, Dorothy J. Hancock.
Invocation was given by Mr. Johnson followed by the Pledged of
Allegiance.
Mrs. Kerr as~ed that the mAinutes of August 16 be amended under
discussion of salary ordinance Ato add the word "percentage" after
"straight" so the line would read "Mrs. Kerr stating she supported a
straight percentage across-the- board salary increase". Mr. Fleming made
a motion to approve the minutes of August 16 as amended and the minutes
of August 23. Motion seconded by Mr. Garretson and passed unanimously.
Public Hearing - Ordinance D-348, Appropriation of Revenue Sharing
Funds Mr. Johnson made a motion to introduce Ordinance D-348. Motion
seconded by Mrs. McMullen. The Clerk-Treasurer explained that the
proposed ordinance carried a total of $40,705 but that $44,705 had been
advertised since a request for $4000 had been made at the use hearing.
Mrs. Kerr made a motion to amend Ordinance D-348 to include the $4000
request for the Carmel Library making a total of $44,705. Motion
seconded by Mr. Garretson and passed 6-1, Shepherd voting nay. Mr.
Walker opened the meeting for public hearing. Mr. Dave Kiely, Janus
Developmental Services gave an update on their request; Linda Koester
spoke on behalf of Hamilton County Senion Citizens; Joan Stubbs spoke
on behalf of Hamilton Centers, and Jackie Nytes spoke on behalf of the
Carmel Library. There being no further comments from the public, the
public hearing was closed. Mr. Shepherd stated he was in favor of all
except the request of the Library to microfilm the News Journal. Mr.
Garretson stated he felt that the project was worthwhile in that it
preserved the history of the City. Mr. Garretson made a motion to
suspend the rules and act on Ordinance D-348 this evening. Motion
seconded by Mr. Johnson and passed unanimously. Vote was taken on
Ordinance D-348 which passed 6-1, Shepherd voting nay.
Public Hearing Ordinance Z-185, Fee Changes for Department of Community
Development Mrs. McMullen made a motion to introduce Ordinance Z-185.
Motion seconded by Mr. Johnson. Mrs. McMullen stated the proposed
ordinance came to the Council with the unanimous approval of the Plan
Commission and that the Executive Committee had spent a great deal of
time on the proposed fees. Mr. Kiphart, Director of Community
Development, presented the proposed fee schedule and answered questions
from the Council. Mr. Garretson pointed out that the last sentence in
29.6.7 was contrary to State statute and felt that it was an effort to
give the Plan Commission an input on buildings erected by the City of
Carmel and the Carmel-Clay Schools. Mr. Kiphart stated the intent was
good public relations in that inspections would be needed for both. Mr.
Johnson stated the schools had inspections during construction
performed by the State. Mr. Shepherd asked if the City incurred
liability for inspections made and the City Attorney answered yes,
pursuant to the extent of tort limitations or other exemptions.
Mr. Walker opened the meeting for public hearing and Mr. Nickell,
builder, addressed the Council. Mr. Nickell stated that when these
fees were tabled last November, it was the desire of the Council to
have input from the builders. Mr. Nickell stated he had been in
constant contact with Mr. Kiphart and the Mayor requesting to have
input, but that the first he knew about any proposed fee changes was
from the newspaper stating they would be discussed tonight. Mr.
Nickell stated he felt most of the proposed fee changes were
equitable, but felt that inspection fees for single family dwellings
were somewhat higher than necessary. Mr. Kiphart stated some
inspections had been lumped together and that the average cost was
$15 per inspection. Rather than charge $30 for two inspections, two
were lumped together to come up with the $25 which, in fact, showed
a savings of $5. Mr. Nickeli suggested a flat fee of $60 be assessed
for the required four inspections and $15 for each extra inspection.
Mrs. Kerr requested that Mr. Nickell put his suggestions in writing
to the Council and that the item be discussed the first meeting in
October. Mr. Garretson requested that Mr. Kiphart look at commercial
vs. residential inspection fees to determine if they should be
separated. Mr. Garretson made a motion to delete the last sentence
in the first paragraph of 29.6.7 which reads "this does not imply
that they are exempt from following procedures or obtainina permits
as required herein". Motion seconded by Mr. Johnson and passed 5-2,
Kerr and McMullen voting nay. Mr. Garretson made a motion to amend
the wording in Item 1, Section 29.6.2 to read "Buildings including
churches and private schools". Motion seconded by Mr. Johnson.
Discussion ensued and vote on the motion was tabled until the first
meeting in October when the Ordinance will return for discussion.
Mr. Coots stated that as the ordinance read in 29.6, a developer
could be charged $50 for each lot in a subdivision if a variance was
needed and this could cause undue hardship. Also, Mr. Coots stated
that an appeal was a right and perhaps should not have a fee
attached. Mr. Garretson made a motion to table Ordinance Z-185 until
the first meeting in October. Motion seconded by Mr. Johnson and
passed unanimously.
The Clerk-Treasurer informed the Council that she had received a
request that the EDC amendment on the agenda had been requested to
be postponed.
Other Business - Mrs. Kerr stated it would be convenient to have a
telephone available at our meetings even if it were a pay phone
outside. The other members voiced their agreement. Mr. Walker
requested that the Clerk-Treasurer inform the Mayor's office of the
opinion of the Council and request that they research the matter.
There being no further business to come before the meeting, the same
was duly adjourned at 9:25 P.M.
