CITY COUNCIL MEETING
MAY 3, 1982
The meeting of the City Council was called to order by Mayor Reiman at
7:30 P.M. on May 3, 1982. Council members Kerr, Garretson, McMullen,
Fleming and Johnson were present. Also present was City Attorney, Dave
Coots and Clerk-Treasurer.
Invocation was given by Mr. Johnson followed by Pledge of Allegiance.
Mr. Garretson made a motion to table the approval of minutes until
next meeting. Motion seconded by Mr. Johnson and passed unanimously.
Councilor Ted Johnson presented a proclamation to Billie Francis,
Vice Chairman of H.E.L.P. which proclaimed May 9th to May 15th as
H.E.L.P. week. Mrs. Francis thanked the Mayor and Council for their
support both financially and vocally.
OLD BUSINESS
Ordinance D-327 - Additional Appropriation for Department of Community
Development . Director of Community Development, Chuck Kiphart,
explained the need for the $500.00 for photography equipment in his
department to the Council. Mayor Reiman opened the meeting for public
hearing on Ordinance D-327. There being no comment, the public hearing
was closed. Vote was taken on Ordinance D-327 which passed
unanimously.
NEW BUSINESS
Ordinance D-328 - Additional Appropriation from Cumulative Capital
Sewer Funds . Mr. Garretson made a motion to introduce Ordinance D-328.
Motion seconded by Mrs. McMullen. Mayor Reiman read the proposed
projects for which the money would be used. Mayor Reiman opened the
meeting for public hearing. There being no comment, public hearing was
closed. Mrs. Kerr asked if she could have a breakdown of the proposed
projects. Mayor Reiman stated Mr. Reddick would attend next meeting
with said breakdown. Mr. Garretson asked what would keep this money
from being spent on something other than the proposed projects. The
Clerk-Treasurer explained that this money was restricted by ordinance
for use only for storm sewers.
Curfew Code Discussion - Mrs. Kerr stated that she had met with Chief
Lowe and as they could see by the handouts, the City Code referring to
curfew was in compliance with the State Statutes. Captain Babb
attended the meeting to represent Chief Lowe. Mr. Garretson and Mrs.
Kerr both stated that they felt no need to change the City curfew law.
Mayor Reiman stated that her office had received a call from a
resident in Cool Creek North stating that she felt there should be
sidewalks from Gray Road to Harrowgate on East Main Street. Mr.
Garretson stated there was a definite need for sidewalks on 126th
Street also. Mr. Garretson suggested that this should be something
that is planned and budgeted on a yearly basis.

Weight Load Limit - Mayor Reiman stated that Dan O'Malia from
O'Malia's Grocery had called and stated that some of the
large delivery trucks were using Carmel Drive between
Keystone and 126th Street as a thoroughfare to deliver to
their 126th Street store. He stated that he had written these
people and suggested thay they use either 126th Street or
116th Street but felt the City should be aware of the
situation. Mayor Reiman suggested amending City Code 41.21
dealing with weight limits to include Carmel Drive. Mr.
Johnson stated that without scales the weight limit code was
difficult to enforce and suggested that perhaps a "no thru
trucks" ordinance might be a better idea. Following
discussion, Mrs. Kerr requested that Mr. Coots prepare an
ordinance prohibiting through truck traffic on Carmel Drive
between Keystone and 126th Street.
iMayor Reiman requested that discussion on water sprinkling
rates be added to the agenda. Mr. Garretson made a motion to
add discussion on water sprinkling rates to the agenda. Motion
seconded by Mr. Fleming and passed unanimously. Mrs. Kerr
stated she had difficulty with the idea of suspending the
rates since we had in the last year increased both the sewer
and water rates asking where was the relief for the consumers?
Mr. Garretson stated he agreed but in the emergency situation
we were in, there was really no choice due to the low water
pressure and the added strain on the system. Mr. Johnson
stated that having to pay for the sewer at the regular rate
would be a deterrent
to people using the water when the levels were low although
he hated
to see it happen. Mr. Garretson suggested that a flyer be
sent to the
customers with their June billing explaining the reason for
not granting
the summer rates and what the costs to the consumers might be.
Following
further discussion, Mr. Garretson requested Mr. Coots to prepare a
resolution stating that there would be no special rates during July,
August and September.
Mr. Garretson made a motion to add discussion of hospitals to the
agenda.
Motion seconded by Mr. Johnson and passed unanimously. Mr. Garretson
stated that he had been contacted by a local man who is interested in
putting a hospital in the Carmel area and called attention to an
article in the Sunday Star stating that State Board of Health
Director, Dr. Ron Blankenbaker, was about to grant permission to St.
Vincent's Hospital to locate a satellite medical facility in the
Carmel-Clay area which would eliminate anyone else from locating here.
Discussion ensued as to input from the Carmel-Clay residents.
Following discussion, Mr. Garretson read a resolution he had prepared
regarding input from the community on this decision and made a motion
that the resolution be adopted. Motion seconded by Mr. Johnson and
passed unanimously. Mayor Reiman stated that she was a member of the
St. Vincentls Advisory Board and would not take part in any further
discussion of the matter and would not chair any meetings or hearings
on the subject. Mr. Garretson stated that due to the article stating
that Dr. Blankenbaker was near a decision he would request that the
Clerk-Treasurer send a copy of the resolution, with a cover letter to
Dr. Blankenbaker, the next day by special delivery. The Clerk-
Treasurer stated the next day was election day and there would be no
mail, but the resolution would be in the mail the following day.

ANNOUNCEMENTS
Mrs. McMullen reminded the Council that Mr. Janesek would be
speaking at the Junior High Scool on May 10 and extended an
invitation to all to be present at a dinner being given for
him at Steckley's at 5:45 P.M. on that evening.
Mr. Garretson suggested that since budget time was nearing,
it might be a good idea to look into the salaries of elected
officials and suggested that perhaps a straight salary for
the Council might be a good idea with an additional
compensation per meeting attended.
There being no further business to come before the meeting,
the same was duly adjourned at 9:05 P.M.

Re: Summer Sprink]ing Rates
Due to peak demands during 1980, 1981, we project for 1982
there may be demands on our water system that exceed our
current ability to supply. Therefore, considering the
potential risk of inadequate fire protection during summer
of 1982, I am recommending that summer sewer relief not be
allowed this summer.
The purpose of this recommendation is to encourage water
conservation among the citizenry of Carmel in an effort to
insure adequate water supply for fire fighting and domestic
use.
